RESOLUTION NO. 00 -3813
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY UPHOLDING THE PLANNING COMMISSION DECISION AND
DENYING A MODIFICATION OF THE CONDITIONAL USE PERMIT
AND ZONE VARIANCE WHICH WOULD ALLOW A BILLIARD CLUB
WITH AN ENTERTAINMENT USE AND ON- PREMISES ALCOHOLIC
CONSUMPTION TO OPERATE WITH A REVISED FLOOR
PLAN; THIS RESOLUTION ALSO ADDRESSES A REQUIRED
FINDING OF "PUBLIC CONVENIENCE AND /OR NECESSITY' FOR
THE ISSUANCE OF AN ON -SALE LIQUOR LICENSE AT 5449
ROSEMEAD BOULEVARD (MOD CUP 97 -1305) AND (ZV 97 -1307)
(SMALDINO/PHAM)
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE:
SECTION 1. Based upon information contained in the staff report to the City Council and
information contained in the Planning Commission staff report as well as the Planning Commission
minutes; and based upon testimony received at a noticed public hearing before the City Council on April
4, 2000, the City Council denies the requested modification of the Conditional Use Permit /Zone Variance
and is unable to make the fmding of "public convenience and/or necessity," requested and required by the
Department of Alcoholic Beverage Control based upon the supporting documentation and fmdings
contained in Planning Commission Resolution No. 00- 1945PC and the lack of any justification therefor
submitted by the applicant as demonstrated by the minutes of the City Council meeting.
SECTION 2. The City Clerk shall certify to passage and adoption of this resolution and enter
it into the book of original resolutions.

Council of the City of Temple City at a regular meeting held on the 18th day of April, 2000 by the
following vote:
AYES: Councilman- Brook, Gillanders, Wilson, Souder
NOES: Councilman -None
