Honorable Council Members:Please give your support to CalTrans' efforts to install bike lanes on El Camino Real (ECR). Our neighbors in Mountain View and Los Altos have already committed to doing so, and weshould continue those lanes in Palo Alto. The current layout is not even good for Motorists. To have cars pulling in and out of parallelparking on a 35 MPH street is not safe. And, when using the parking lots behind, the parked cars on the street often completely block the view of the lanes when pulling out of thedriveways, making it feel like a game of Russian Roulette. California has committed to making its streets "complete streets" -- i.e. streets that are safe forall users. I don't think anyone would describe the current ECR as such. I was spurred to write today after biking with my friends to the Slice House on ECR. We were forced to ride on thesidewalk for a bit, as high speed traffic was bearing down in the lane. ECR currently does not appear to be a thriving business environment, as evidenced by the many dilapidated and/orvacant storefronts. I grew up in Palo Alto and returned in my 30s when my wife and I bought our current home. At no point during all this time has ECR been what I would describe as anice street. Personally I rarely shop or eat there because its businesses are not easy to drive to, bike to, or walk to. I believe the improvements envisioned by CalTrans would put ECR onthe way to being a better component of Palo Alto's transportation and business infrastructure. We should work with CalTrans to adjust their designs where we feel it is needed, but weshould not lose this opportunity to make ECR a lot safer for cyclists and all users. Dear Mayor, Vice Mayor, and Council Members: Aug 7, 2023 This is a review of the Traffic Demand Management plan (TDM) as written and submitted to the city by Castilleja School December 2022 and which is in your packet, and the Fehr&Peers monitoring report dated 4/15/23, which is not in your packet; here's the link: https://www.cityofpaloalto.org/files/assets/public/planning-amp-development-services/new-development-projects/1310-bryant-street/castilleja_tdm_monitoring_winter2023_20230415.pdf). Bothdocuments taken together reflect how errors in the TDM get amplified bythe school's traffic consultant. The school states that they will do what the city tells them to do. However, history shows usthat the city has to be very specific. For example, the 6/6/22 City Council MOTION #3: “ifstudents are moved off site during construction, then they can go to 450 enrollmentimmediately”. Because this sentence doesn’t say “if all students are moved offcampus.....”, the school has actually increased enrollment and is staying on campusanyway. Moving all the students shortens the construction timeline and eases the impactson the neighbors and was offered to the school as an incentive. Please require these clarifications listed below to the language of the TDM to tighten up loopholes and ensure all car trips are counted. ROLUA: “No net new trips”, which was hard-won and which the school agreed to, will reduce impacts to the neighbors from a 30% enrollment increase. However, it depends entirely upon how car trips are counted. The TDM only counts some of the trips. The TDM is based on the Record of Land Use Action. On page 26, both 22b and 22d, state one method of calculating car trips is to use electronic driveway counters. The very next sentence states “Refer to condition 24 regarding the monitoring report for the ways ADT shall be calculated”, which talks about monitoring drive-and-park cars and street drop-offs. However, the school is ONLY counting driveway car trips towards the ADT and AM peak caps. Please add verbiage that includes “add all additional car trips to the ADT and AM peak car trip counts", so that monitoring methods that result in witnessing car trips, like cars parking and cars dropping students off in the street, get included into the totals. It was never intended that only some car trips would be counted towards Average Daily Traffic, but unless it is stated, the school will only use driveways. The Fehr & Peers report bears this out (see below). TDM TDM page 5, #3, "Data Collection Methodology" states they are only using driveway counters. Cars driving to the school and parking don't get counted. Cars dropping kids off in the streets don't get counted. TDM pages 7 and 8, and in many places throughout the document, refer to cars that drive to the school without passing over driveways, but doesn’t require the school to count them as car trips, only to monitor them. The school will only do what they are specifically required to do. Add the words “count towards car trips” every time the TDM uses the word “monitoring” or refers to driving and parking and street drop-offs. TDM, page 3, bottom of the page, bullet 2, states that the TDM incorporates "all applicable Mitigation Measures from the Certified Final EIR, particularly MM4a and 7a”. 1. MM7a states that the driveway counters are “part of the monitoring” (not the only monitoring), using the term “monitoring” as counting car trips. Yet the school interprets this to mean ONLY driveway counters can count car trips. Need to clarify, as cars are being under-counted. 2. MM7a states that the TDM plan is implemented during construction and in perpetuity. However, bottom of page 4, Performance Standards, third bullet: construction trips are excluded (your staff report, third page, footnote 5 links to the MMRP, see 7a.) Please delete the exclusion of construction vehicles from the TDM to be consistent with MM7a. Fehr & Peers TDM Monitoring Report (see link at top of this email): An important safeguard to keeping impacts to the neighborhood at current levels, asagreed to by Castilleja, is counting car trips. The counts are useless if only some of the cartrips are counted. Here’s an example of why we can’t rely on this report: 1. Page 7, 4.1.2 describes the AM peak period as between 7 and 9 am.2. Page 11 reports the average AM peak hour volume is 197 car trips and the cap is383, which is so low it inspired a look at the data.3. Page 12 shows Fig. 3 and a graph, showing low AM Peak car trips. Testing a random sampling of the raw data against Fig. 3 shows that 197 AM peak car tripsas reported does not reflect the raw data. See graph attached: Fehr & Peers reported car trips from Fig 3, pg. 12 in the report (grey line). Fehr & Peers actual data, from downloading and counting 7 am to 9 am car trips,shows higher results, closer to 335 average (blue line) Fehr & Peers actual data plus 53 (the number of spaces on the street around theschool; a minimum of drive-and-park car trips easily counted) (red line). Dotted line shows the cap of 383. As you can see, the counts go over the cap on this sampling, in violation of the ROLUA andthe TDM, and that doesn’t even include the drive-and-park car trips and street drop-offs. Page 14 “Morning Arrival Mode Share” shows a zero for cars that “drive and park on street”,indicating that no one arrived by car and parked on the street, which is easily refutedbecause 53 cars park on the streets surrounding the school every school day (see pg 17,Table 6). We don’t mind that they park around the school, we just want them counted. If we cannot trust these counts, how can we trust the reports? Please require that the Transportation Department review this report and auditthe data. If the report can’t be relied upon, hire a new traffic consultant, so boththe school and the neighbors can trust and feel comfortable that the reports areaccurate. Palo Alto Weekly Editors and Mr. Gennady: I am concerned about the miss information and miss characterization accompanying many articles regarding the 2013 Measure D Referendum on the 60-unit Affordable Senior Housingbuilding, in Barron Park. Only 36 surface parking spaces were planned for the entire building!! Seniors had to be 62 years old to live there; one person of a couple could be lessthan 62 years old. Assuming [on average] 90 residents, more parking would have been needed for residents with jobs, social activities, family responsibilities and on-site care givers. Seniorswould have had to park on surrounding residential streets, walking several blocks to and from their cars, at night, in the rain, etc. Prior to the Referendum, the developer falsely promotedthe idea “seniors don’t drive” and that “it was too expensive” to provide adequate underground parking. The lack of adequate parking was a very significant planning blunder.The inappropriate site location, being a third of a mile from El Camino public transportation and other services jeopardized senior’s safety and put seniors at risk. The other reasons for thesuccess of the Referendum were extremely important, but the inadequate parking issues should not be ignored. We should not allow developers to paint us as anti-development andNIMBYs. Nothing could be further from the truth. Affordable senior housing was welcome, but not the way it was being planned. Since the Referendum, I believe all residential buildingnow have underground parking. I hope the Palo Alto Weekly will include this information in their future articles. Dear Council Members, Thank you for inviting me to submit my ideas to your study session. I would like to speak partly against this project and would appreciate it if my name does not get out of your study chamber. In return I would like to invite you to come and see how phase 1 of an internal renovation affects us the residents in our daily activities without any benefits for the duration of construction which will take us into Phase 2 and 14 additional apartments. Palo Alto Commons is a Shangri-la for us old folks in the heart of urban Palo Alto. The present management who I believe owns our community has different ideas as an absentee Utah landlord. Phase 1 of a renovation internal project started in July and so far has been a mayhem of destruction of mature landscaping and other pleasant relaxation sites. In addition it provided for the setting up of a tunnel to funnel all destruction and construction materials in or out, said tunnel cutting our building in two halves and taking the place of our living and activity rooms, depriving us of much indoor space wile projected to provide two 2 bedroom 2 bath additional apartments for the sole benefit of Wellquest, our management. While the tunnel is very ingenious for this construction project, being a one way road slows the construction time and increases the time of our inconvenience. We have not been told when this Phase 1 will be completed nor when the tunnel will be eliminated in order to restore our living area and activity rooms. I suspect that the tunnel will stay in place to serve through the completion of phase 2 which you are considering right now. I must concede that the construction company did everything possible to protect the residents except for the fact that the tunnel went right through what was our living room plus the room for all our activities. We are really deprived of a lot of living space and will be during the duration of the construction work. I am 73 years old. I don't know how many golden years I have left to enjoy life at Palo Alto Commons. If I live past 75, will I really enjoy the 4 golf putting holes part of the much reduced barren courtyard shown on one of the pictures submitted by Wellquest? Now our absentee management wants to add fourteen more units but we haven't seen blueprints where exactly they will go or to show which outdoor areas will be affected or lost, areas that were judged to be needed for the wellness and enjoyment of Sr. citizens when the city of Palo Alto issued the original building permit. Also when will this project end? It boils down to the question: Don't we the residents need that outdoor space anymore or the quiet enjoyment of our facility so that the Management company can reap greater profits with more apartments? No matter what the City's final decision, there will be only two elevators to service the present residents and staff in addition to a minimum of at least 14 residents or more with the required staff in the prospective new units. Conclusion: terrible overcrowding in what used to be a lovely airy facility. My present quarrel is with Wellquest NOT with the local executives and staff some of whom have worked with devotion for many years at PAC and are all contributing to our well being and happiness. In fact I believe that Wellquest and this whole construction project puts all of them under a lot of stress too. Unfortunately I am not savvy enough to tune into your meeting but I am trying to attach pictures of our courtyard before total destruction or forward under separate email. Please watch for it. City Council and Park Recreation Commission Members, Terman Park needs to be preserved, it is an important resource for Green Acres I,II and Terman Apartment residents. If Terman Park loses it's status as a park, many could lose a source of recreation. It is the only open space within adjacent walking distance to exercise dogs, play basketball and tennis. It eliminates the need to drive elsewhere for the sameactivities. If the area is no longer a park, it would be subject to development and a loss of open space. Also, access to Los Altos via the perimeter path could be restricted. It is used by residents as safe access to bike and walk to Los Altos avoiding traffic.Please save Terman Park. DONATE BY BETH SCHWARTZAPFEL Last month, a federal judge overseeing a court settlement seeking to make New York City’s notorious Rikers Island jails safer signaled that she is losing patience with the city’s corrections department. After years of dysfunction and disorder at the complex, Judge Laura Taylor Swain said she was beginning to question whether city officials “are capable of safe and proper management of the jails.” Close observers knew exactly what Swain was hinting at: a federal receivership. Advocates of this measure and attorneys for people locked up at Rikers have long called for a takeover of the jails by a neutral, court-appointed expert, known as a receiver. But judges are generally reluctant to take this drastic step, which hands control to an administrator who answers to the judge, not elected officials. It’s only been done a handful of times across the country at prisons and jails with the most intractable problems. “A receiver has extraordinary powers. It has to be a last resort and it’s a big thing to do,” Elizabeth Glazer, former director of the New York City Mayor’s Office of Criminal Justice, told The City. In 2006, a federal judge made history by placing California’s entire $1.2 billion prison health care system into receivership as part of a landmark class-action lawsuit. Experts at the time testified that, on average, a person in California state prisons died from medical neglect or malpractice every week. Receivers can spend money, hire and fire staff, and write policies as they see fit. They can also ask the judge to override union contracts or state rules that get in their way. “That freedom from bureaucratic morass is partly why receivers, answerable only to the court, usually make progress where agencies simply can’t,” wrote Hernandez D. Stroud, an attorney and law professor who studies prison oversight, in a New York Daily News editorial arguing in favor of a receivership at Rikers Island. But receivers sometimes come with controversy, too. Since they only have to answer to the judge, critics argue that receivers are not accountable to the people and their elected representatives. And receivers’ spending can raise concerns. California’s first receiver didn’t endear himself to state officials when he threatened to hold them in contempt of court and said he would “‘back up the Brink’s truck’ to the state’s treasury, if need be,” The New York Times reported at the time. The $500,000 annual salary he paid himself didn’t help, either. A second receiver in that California case has done the job for over a decade, transferring oversight of health care back to the state as facilities meet certain standards. The state now runs health care at 20 facilities, and the receiver still manages 13. “It's off-the-charts better care than they would have ever had before,” Don Specter, the lead attorney for the plaintiffs in the California suit, told The Arizona Republic last year. “It's not Cadillac care or anything like that, but it's decent care.” Specter is also a lead attorney in a similar class-action lawsuit regarding prison health care in Arizona. In 2021, the judge in that case ruled that Arizona’s health care was “plainly grossly inadequate” and laid out required changes, hinting that she could appoint a receiver in the future. Not every receivership drags on for as long as California’s has, though. In 1995, a federal judge ordered a receiver to run Central Detention Facility (CDF), the jail in Washington, D.C., after concluding that some city officials “don’t give a damn.” At the height of the AIDS crisis, for example, there was “a chronic shortage of life-saving supplies, medication and equipment,” the judge’s order said. In 2000, five years after the receiver took over, the judge returned control of the jail to the city, expressing reservations but acknowledging that conditions had improved. But the improvements didn’t last. In 2021, in what one Washington Post op-ed columnist called “deja vu,” U.S. Marshals were so appalled by conditions at the jail that they transferred 400 people to a federal prison. They found “‘large amounts of standing human sewage … in the toilets of multiple occupied cells’ and many cells in which water ‘had been shut off for days.’” Those reports echo news coming out of Rikers Island. A class- action suit regarding conditions at the jail complex has dragged on for years, with a federal monitor issuing regular reports and the judge giving the city multiple opportunities to avoid a federal takeover by fixing conditions on its own. Yet since the COVID-19 pandemic began, Rikers’ conditions have worsened. Stabbings and slashings are common; people have been packed into unsanitary cells that some have said are “like a slave ship”; record numbers of people have died. With mounting public pressure and sharp criticism from the monitor tasked with keeping an eye on jail conditions, the city recently said it would stop announcing deaths at the jail. A longtime Rikers doctor was fired after criticizing correctional officers and jail administrators on social media with the hashtag #ReceivershipNow. “Rather than fix the problems plaguing the jails, Mayor Adams and his DOC commissioner have sought to hide them,” wrote gabriel sayegh, co-executive director of the Katal Center for Equity, Health and Justice, an organization that advocates for closing Rikers, in a recent op-ed calling for a federal receiver. Mayor Eric Adams has pushed back against a receivership, saying assaults and stabbings at Rikers are down and change takes time. “Now you have a mayor that’s leading from the front and saying, ‘I’m going to be responsible for DOC,’ and you’re seeing the results that we are doing and saying, ‘We are going to take it away from you, Eric,’” Adams told the New York Post. His administration cites a staffing shortage, even though the city’s corrections department has more staff than almost any other jail system its size. The federal monitor said there was no staffing shortage, but rather “deeply ingrained patterns of mismanagement and dysfunction.” The next hearing in the Rikers Island class-action suit is scheduled for Aug. 10. Lawyers for the people held at the jail and New York’s top federal prosecutor have said they will formally request a receivership on that day. Reducing the qualifying time to 6 months from 12months conflicts with the city’s own legislation that requires every property owner, like me, to provide a minimum lease term of one year. Providing the just cause protection after a 12-month period provides for more sustainabletenancies. That is exactly what I look for in tenancies because turning over a unit is costly and time consuming. As a college student, I interned at the District Attorney’s Office, Bureau of Investigations. Nate Newman was the Assistant Chief. He warned many of us about the racism in that office. I sued the Sheriff’s Office in 2001 and 2015, partly for discrimination. I was called O.J. Simpson by a Sergeant assigned to backgrounds and recruiting because he found out I received a “Finding of Factual Innocence” for an arrest that occurred ,when I was 19. Another Sheriff’s Office Sergeant walked around the jail using the “N” word, referring to Hispanics as “Wet Backs” and calling female employees “Useless broads”, “Bitches” and other derogatory terms. This was a topic during my 2001 lawsuit. Former Sheriff Lauri Smith admitted to knowing about this Sergeant’s conduct. Yet, she promoted him three more times. When the Sheriff’s Office took over the jails in 2010, this same person (Ed Perry) was the Assitant Sheriff (aka to some as Deputy Chief) assigned to oversee the jails. That foundation leaves no surprise to the culture today!! Then there's the fact that three of the individuals named in this article remain employed by the Sheriff’s Office. Since the incident, all three have been assigned to coveted units. One was promoted to Sergeant, the other two to Training Officer, Use of Force Instructor and the Gang Intelligence Unit. It is 2019, and I am sitting in my office watching discovery for a clinic case on which I am the supervising attorney. In the body camera video, the men are arresting a boy who had been the passenger in a car reported stolen. The boy had no weapons, and the police had no concrete reason to suspect he did. The house in the residential community of Ladera was surprisingly affordable compared to most others in the area, and the neighborhood was scenic, rural-feeling and close to the conveniences of neighboring Portola Valley. But then she came across something that gave her pause: The property deed contained restrictions from an earlier era prohibiting anyone who wasn't "Caucasian or white race" from owning or occupying land in the neighborhood. We believe they have a STRONG background to collectively identify when 'criminalcops' are the problem in the process of justice being served. This includes Commanders who were/are involved with Civil Rights violations and have/harbordeep rooted beliefs that they should/would uphold, for which they have contributed to the systemicproblems. The placement of the orange temporary fence as of this writing is incorrect. It is partly located 3 feet + 2 inches from the sidewalk. Per our understanding, it is supposed to be 4 feet away from the sidewalk. It is also placed in a curve instead of a straight line as the architect’s drawing indicates with the yellow line. We have tried to expedite matters by asking City staff to correct this situation. On Thursday, July 27, 2023, an email on behalf of Ellsworth Residents was sent to both Planning and Code Enforcement, and another Ellsworth Homeowner also emailed Code Enforcement directly on that day. (See two attached PDFs). Per the response of Amy French, she was going to make a site visit and she thanked me for my “patience.” There has not been any follow-up to this and nothing has changed on the Ellsworth Place site. 3. A voicemail was left for Sylvia Star-Lack, Transportation Planning Manager, on the afternoon of August 1, 2023, asking for a follow-up site visit. We hope this can occur prior to the commission hearing so that residents can ask more detailed questions about the proposed road and other changes in advance and thus be able to comment on those at the hearing. 4. Regarding the story poles or visual aids, Chair Doria Summa said, “Leave that up for 6 weeks or whatever is standard Miss French and then have the, have everyone comment on it.” While Palo Alto does not appear to have a standard for how long to leave up the story poles, Los Altos requires 20 days, which seems like a reasonable amount of time once the proper installation has occurred. 5. A key issue commissioners have raised is whether the utility pole nearest to Middlefield can be moved, as that would allow for a 26-foot wide road extending for 100 feet and provide passing and improved safety and visibility. The feasibility of moving the utility pole needs to be properly asked of CPA Utilities Engineering. Per emails with Cesar Magdaleno, no application has been submitted to inquire about this within the Electrical Engineering Department. (There are solutions available for this scenario according to an online search.) Can any application fee for this assessment be waived on behalf of the greater good of Midtown, Palo Alto? (See attached PDF of this email communication.) The utility pole does have guy lines, but the electrical lines appear to stop at the pole prior to it, with only the telephone line and Comcast lines actually routing to this end pole. Eliminating this pole would open up circulation to the entrance of the Ellsworth Place road and solve a lot of safety and other foreseeable problems, such as the potential banning of delivery trucks on Ellsworth Place, as was discussed during a site visit by City Planning on July 3, 2023. Having the Ellsworth Place “PC” on the PTC meeting agenda for August 9, 2023, is too short of notice to accomplish the above and it would be a waste of everyone’s time and taxpayer money to have the meeting without the ability for us to give proper feedback. I must emphasize the importance of Terman Park to Terman Apartment, an apartment complex on the edge of the park. This apartment complex is mainly occupied by seniors, manyof whom are people of color and are on Medi-Cal. If you take a walk in the park, you will see senior residents from Terman Apartment taking a relaxing morning stroll, or afternoon chat inthe park. Yesterday we were informed that there is an intent to award the new contract to the incumbent, SWA. We at DMS have concerns that in light of the wage theft of the janitorial staff that the services of SWA were retained. DMS has been signatory to the union contract for decades, and we feel we are the best choice to guide the city into the era of having a union signatory janitorial contractor. SWA, has only recently become signatory on a probationary basis. This can create a myriad of issues. We also fail to understand why the city decided not to name finalists, or even conduct vendor interviews. We can’t help but draw the conclusion that this RFP was merely an exercise for optics purposes only. It’s of great concern that the city didn’t take a whole hearted approach in the interest of seeking the best fit or even what options a new vendor could provide to enhance services and make across-the-board improvements. Rather, it seems, the decision makers made the choice of least resistance, instead of using the process to find the best possible vendor. I would love an opportunity to voice my concerns to the council, and learn more about why this decision was made in such haste.
