Appendix No. 3 - Boundary Adjustment and Cost Share
THIS AGREEMENT is made and entered into this /.2.01' day of
, 2002 by
and between the CITY OF McCALL, an Idaho Municipal Corporation (CITY) and PAYETTE
LAKES RECREATIONAL WATER AND SEWER DISTRICT, a political subdivision of the
State of Idaho (DISTRICT).
WHEREAS the DISTRICT presently has excess capacity at its Lift Station No. 1 (vicinity of
Lick Creek and Davis); and
WHEREAS the CITY and the DISTRICT have previously entered into a Memorandum of
Understanding in September of 1996, in which the DISTRICT allowed the CITY to route sewage
flow to such lift station and beyond to alleviate a collection problem with the CITY's system in
that area on an interim basis; and
WHEREAS Holladay Engineering Co., the CITY's engineering consultant, has reviewed the
status of the present arrangement and recommended an equitable cost sharing solution providing
for an annual fee based on 20% of the user fees collected by the CITY from their patrons using
this station; currently this represents $9,584.00, to which the parties are agreeable; and
WHEREAS Holladay Engineering Co. further recommended the consolidation of certain
service boundaries for more efficient operation of each entity as defined in correspondence of
November 26, 2001 (Exhibit A) and further identified on the attached Map (Exhibit B).
NOW THEREFORE, in consideration of the foregoing and the terms and conditions which
follow, the parties agree to perform, each for the other, as follows:

1. The DISTRICT shall continue to accept sewer flow from the CITY's Lick Creek
Road sewer line, into its lift station #1 for an annual charge of $9,584.00, (20% of
user fees) payable in advance quarterly installments commencing 1 January, 2002.
2. The CITY agrees to pay such sum for the services being provided.
3. The CITY agrees to work to determine a suitable estimate of Infiltration and Inflow
(I&I). If I & I is substantial, a mutually agreed upon amount of compensation will be
due the DISTRICT for pumping flows in excess of standard users.
4. Either party may withdraw from this agreement accepting flow into lift station No.1
by providing prior written notice at least ninety (90) days prior to January 1 each year
hereafter: actual service termination date shall be mutually negotiated to avoid
interruption of service to users; alternatively, the parties agree to renegotiate from
time to time based on any material changes on use, user fees, or cost of pumping.
5. Both parties agree to execute and deliver such other and further documents, permits,
and instruments as may be necessary to fully effectuate the objectives set forth above.
6. In anticipation of the Districts provision of sewer services to the properties described
in Exhibit B, an area presently serviced by the City, the parties agree as follows;
a. The City consents to the District expanding its service area and boundaries to
the University Loop properties and other nearby customers presently serviced
by City owned Lift Station No. 2A.
b. Upon completion of the inclusion process bringing the customer lands into the
District the City shall convey Lift Station No.2A and its related works and
City owned collection lines and easements to the District.
c. The District in accepting the foregoing works, agrees to maintain them in
connection with the servicing of the customer properties involved; the District
agrees that no inclusion fees will be imposed on these University Loop
properties.
d. Both parties agree to execute and deliver such other and further documents,
permits and instruments as necessary to fully implement the contemplated
boundary adjustment and service obligations.
