AN ORDINANCE CHANGING THE ZONING
CLASSIFICATION OF CERTAIN PROPERTY LOCATED
WITHIN THE CORPORATE LIMITS OF THE CITY OF BEL
AIRE, KANSAS FROM THE PRESENT "AG" ,
AGRICULTURAL DISTRICT COMBINATION TO THE "C-1",
NEIGHBORHOOD COMMERCIAL DISTRICT AND
AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF
BEL AIRE, KANSAS.
WHEREAS, notice of an December 14, 2006 Bel Aire Planning Commission public
hearing on Zoning Case Number 05-06 changing the zoning classification of the herein
described real property located within the corporate limits of the City of Bel Aire, Kansas
from the present "AG", Agricultural District to the "C-1 ", Neighborhood Commercial District
was published in the official city newspaper on November 23, 2006 and mailed on
November 23, 2006 to all owners of record of lands, within the corporate limits of the City
of Bel Aire, located within 200 feet of the proposed zoning change and outside the
corporate limits of the City of Bel Aire, located within 1,000 feet of the proposed zoning
change. '
WHEREAS, the Bel Aire Planning Commission conducted a public hearing on
December 14, 2006 on changing the zoning classification of the herein described real
property located within the corporate limits ofthe City of Bel Aire, Kansas from the present
"AG", Agricultural District to the "C-1", Neighborhood Commercial District, and thereafter,
based upon the public hearing and a discussion of the factors to consider in re-zoning,
voted to approve said zone change subject to the condition that the property be properly
platted.
WHEREAS, more than 14 days has elapsed since said public hearings and no
protest petition has been filed with the Bel Aire City Clerk.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE
CITY OF BEL AIRE, KANSAS:

Section 1. Zone Chanoe
The official zoning classification of the property hereinafter described is hereby
changed from the present zoning classifications of "AG", Agricultural District to the "C-1",
Neighborhood Commercial District, subject to the condition that the property be properly
platted. Said property is legally described as follows:
The South 390.02 feet of the West 403.02 feet of the West half of the Southwest
Quarter of Section 13, Township 26 South, Range 1 East ofthe 6th P. M., Sedgwick
County, Kansas. all being subject to road rights-of-way of record.
Section 2. Zonino Map Amendment
The official zoning map of the city of Bel Aire, Kansas is hereby amended in
accordance with Section 1 of this Ordinance.
Section 3. Effective Date
This Ordinance shall take effect and be in force thirty (30) days from and after its
publication in the official city newspaper.
