The invocation was given by Pastor Robert E. Adventist Church, 9664 E. Broadway. Knox, Seventh Day The Pledge of. Allegiance to the Flag was led by Mayor Dennis. . Leonetti.. APPROVAL OF MINUTES: Councilman Merritt moved to approve the minutes of the regular . meeting of the City Council . held on Tuesday, March 4, 1975, as written, seconded by Councilman. Gilbertson and. carried. Prior to the consideration of those items listed on the agenda, Mayor Dennis requested a minute of silent prayer in memory of Mr. Ralph.. Beckman, former Planning Commissioner who passed away Sunday:,. March 16, 1975. UNFINISHED BUSINESS: 6. ORDINANCE NO. 75 -397: 1st read. CHANGE OF. ZONE IN ZONE CHANGE. CASE NO. 74 -432 Pursuant to instruction of City Council at their regular meeting. of March 4, 1975, City Attorney Martin presented Ordinance No. 75 -397, AN ORDINANCE OF THE CITY OF TEMPLE CITY PROVIDING A CHANGE OF ZONE IN ZONE CHANGE CASE NO. 74 -432. Councilman Gilbertson moved to. introduce Ordinance No.. 75 -397 by title only, and waive further reading, seconded by Councilman Merritt and carried. FINAL ACCEPTANCE OF WORK: RESURFACING OF 'TEMPLE CITY BOULEVARD - Live Oak Avenue'to Eaton Wash et al City Manager Koski presented background information stating the •.City Council,'at their regular meeting.held March 4, 1975, authorized.. payment of 9O7 of the final . contract amount to the' Griffith Company for the resurfacing of Temple City Boulevard and a portion of Lower Azusa Road, however, before final acceptance of the contract; Council requested staff investigate bumps in. the new surface on the. east side of Temple City Boulevard,-north of Broadway.. Upon . investigation, staff learned the bumps were. caused by sewer manholes. incorrectly graded; however because the manholes ware below the existing-pavement grade prior to the resurfacing, staff would. recouuuend authorization be given for Los Angeles County Road Department Maintenance forces to adjust the manhole covers to.grade. Councilman Merritt.moved to approve final acceptance of the re- - of Temple City Boulevard as performed by Griffith Company. and authorize the payment.of 10% retention after the 35 -day lien period, and to authorize the County Road Department. to adjust the manhole covers to grade, seconded by Councilman Greenberg and carried.; Council Minutes, March 18,.1975 - Page EMERGENCY OPERATIONS PLAN FOR CITY OF TEMPLE CITY City Manager Koski advised the Emergency Operations. Plan for the City of Temple City as presented to City Council at their regular meeting scheduled March 4, 1975, was developed and revised to meet the latest guidelines of the Office of Emergency. Services (OES) and the Defense. Civil Preparedness Agency (DCPA)., and has . been review and approved as to form by OES. Council, following brief discussion of Section V. B (2) wherein the Director may request .City Council to proclaim the .existence or threatened existence of a local emergency if the Council is in . session, or issue such a proclamation if the Council is not in session, subject to its ratification within seven days, requested City. Attorney to review that particular section to determine . whether an inconsistency exists with Section 2730 -A of the Temple City Municipal Code. The Emergency Operations. Plan will be considered by. City Council at their regular meeting .to.be held Tuesday, April 1, 1975. RECOMMENDATION FROM PLANNING COMMISSION - Meeting of March 11, 1975 ZONE CHANGE FROM R -1 to R -2, 9619 through. 9633 Broadway. (north side) City Manager Koski presented . background information, stating the Planning Commission, at their regular meeting held March 11, 1975,. held public hearing and adopted Resolution No 75 -613PC recommending the City Council a change of zone from R -1 to R-2 for the aubject property for the following reasons: 1) the proposed zone change is compatible with the applicable provisions of the general plan; 2) the proposed zone change is compatible with existing development of the subject property and the neighborhood; and 3) will provide a buffer between the R -3 and R -1 zoning in that area Councilman Tyrell moved to set public hearing April 15, 1975 relating to Planning Commission. Resolution No 75- 613PC, seconded by Councilman Greenberg and carried... RECOMMENDATION FROM RELOCATION APPEALS BOARD:. AMENDMENT TO BY- LAWS,. RESOLUTION 75 -2 RAB City Manager Koski: advised the Temple City Relocation Appeals Board, at their meeting held February 25, 1975, passed Resolution No. 75 -2 RAB relating to some administrative relocation procedures in conjunction with the 30 -day period allowed to the Board to act after the filing of a complaint. It was their feeling that findings and recommendations be transmitted to the Temple City Redevelopment Agency within 30 days after completion of the public hearing by the Appeals Board rather than as presently written which is 30 days after a complaint has been submitted to the Executive Director. Councilman Tyrell moved to concur with the Relocation Appeals Board action and amend the By -laws as outlined in Resolution No. 75 -2 RAB, seconded by Councilman Gilbertson and carried. 11 RESOLUTION NO. 75 -1436: OPPOSING SENATE BILL 275 PERTAINING TO EMPLOYER- EMPLOYEE RELATIONS Councilman Merritt moved to adopt Resolution No 75-1436 A RESOLUTION OF THE TEMPLE CITY CITY COUNCIL OPPOSING SENATE .BILL 275 PERTAINING TO EMPLOYER- EMPLOYEE RELATIONS and directed that copies be trans - mitted to the Governor of the State of California,` members of the Senate Committee on Governmental Organization and others, seconded. by Councilman Greenberg and carried. RESOLUTION NO 75- 1437:. EMPLOYMENT OF PERSONNEL Councilman Tyrell moved to adopt Resolution No 75 -1437 A RESOLUTION OF THE CITY OF TEMPLE CITY. APPOINTING PERSONNEL, seconded by Councilman Gilbertson and carried. Council Minutes March 18, 1975 Page RESOLUTION NO. 75 -1438: WARRANTS 1732 in the amount of $2.0,696.39 Councilman Merritt moved to adopt Resolution No. 75 -1438 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS`. AND DEMANDS: IN THE SUM OF $20,696.39, DEMAND NOS.'1662 THRU` x'732 seconded by Councilman Greenberg and carried. COMMUNICATIONS A. Temple City Chamber of Commerce - Education Fair, April 25 -26, 1975 'City Manager Koski presented communication from the Temple City Chamber of Commerce requesting permission to conduct an Education Fair. in conjunction with a sidewalk sale to be held Friday and Saturday, April,25 and 26. The request includes demonstrations by grade levels kindergarten through 12th, with barricades blocking: off the parking lanes, or alternatively, setting up displays in . the parking lane or sidewalk with Las Tunas blocked off to through traffic. from. Camellia to Temple City Boulevard or Temple City: Boulevard to Primrose Avenue. Mrs. Penn Graham, Chamber of Commerce representative, advised the, Chamber did not feel there would be as much attention to their program if .it were set up in the mall; hence their request to block off to through traffic ... Councilman Tyrell moved �to continue the matter �to the next regular meeting of the City Council, when more information may be available, seconded .by.Councilman Greenberg and carried. & DEMANDS, Demand Nos. 1662.thru Supervisor Schabarum re: SCAG resolution relating.: to creation of new ... regional agencies. City Manager Koski presented communication from Supervisor Schabarum regarding recent SCAG General Assembly which adopted a resolution . to. statutorily create a regional agency with . mandatory membership by a vote of 30 to 17 which is not a_ majority of the membership, requesting the City Council take a formal position on the matter and make its feelings known to SCAG Executive Committee and the.. Board of Supervisors. Councilman Gilbertson moved to concur with the policy adopted by. the Board of Supervisors and direct a letter be transmitted by the Mayor to Supervisor Schabarum and Southern California Association of Governments, seconded by Councilman Greenberg and carried. RECESS TO CRA: The City Council recessed at 8:08 p.m. to meet as the Community Redevel- opment Agency, all members present, approved the minutes of, the regular.:. meeting held March 4, 1975, held public hearing and approved agreement for sale and off-site relocation of structure, held public hearing and upheld denial of Relocation Appeals Board for replacement housing payment,, requested City Council to adopt resolution setting public hearing to vacate a portion of Live Oak Avenue, approved warrants and demands. Minutes are set forth in full in the minutes of the Agency. . `.RECONVENE AS CITY COUNCIL: ACTION ON REQUESTS BY CRA: A. Request for Advance of Funds Councilman Gilbertson moved to approve an advance of additional funds in the amount of $56,657.85 pursuant to request by Agency at their meeting held March 4, 1975, as a loan to the Community Redevelopment... Agency and amend the agreement with the Agency accordingly, seconded by Councilman Merritt and carried. Councilman Greenberg moved to approve an advance of additional funds in the amount of $38,079.35 as a loan to the Community Redevelopment. Agency and amend the agree- ment. with the Agency accordingly, seconded by Councilman Merritt ;.and .Council Minutes, March 18, 1975 - Page 4 B. Councilman Gilbertson moved to adopt Resolution No. 75- 1439 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING ITS INTENTION TO VACATE A PORTION OF LIVE OAK STREET WESTERLY OF ROSEMEAD BOULEVARD, AND FIXING A TIME AND PLACE FOR. HEARING OF OBJECTIONS TO THE PROPOSED VACATION, setting public hearing for April 15, 1975, seconded. by Councilman Merritt and carried. I7. MATTERS FROM CITY. OFFICIALS: A. Golden West Avenue, south of. Hallwood.Drive. .Select ..System Street Improvements City Manager Koski presented background information, stating that . pursuant to Council's request for action to be taken to correct the drainage on Golden West Avenue, south of Hallwood Drive,, the two remaining property owners have agreed to dedicate right of way for street improvements predicated on the City's funding the costs for street improvements. Staff proposes that curb and gutter be extended from existing curb on Golden West Avenue terminating approximately 460' south of Hallwood Drive with a simple radius... cul -de -sac, involving the construction of a modified catch basin into which Golden West Avenue will be channeled for a connection to a pipe down the existing Golden West right of way to eliminate'. the erosion which presently occurs on pavement south of the pro- posed improvement. Councilman Tyrell moved to authorize survey and design for curb and gutter improvements, authorize staff to obtain dedication from the two remaining property owners in exchange for the . improvements, and instruct the Superintendent of Streets to notify all the property owners of the imp -nding project, . and to authorize staff, if dedication is not obtained to proceed under the provisions of Chapter 27, Streets and Highways Code, seconded by Councilman Greenberg and carried. B. San Gabriel Valley Health Services. Region ,City Council received and filed notice of public hearing from the. Los Angeles County Health Department regarding proposed boundary changes to the San Gabriel Valley Health Services Region which would change the boundaries 'with respect to administration to more accurately reflect the use of health facilities -and determine. criteria for the budget in allocating funds to the respective regional health district based upon patronage. C Sanitation District Report City Council received and filed report from Mayor Dennis regarding . new federal requirements that all municipal wastewater must receive secondary treatment by 1977. Sanitation District #15 presently provides secondary treatment Of 22% and the District is faced with the immediate mandatory requirement to proceed to construct as well as operate and maintain new and extensive treatment facilities, and financial requirements are now being determined by the District. D. Resolution No 75 -1440 -.Opposing SB. 175 (Brown Act) Councilman Tyrell moved to adopt Resolution No. 75 -1440 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY EXPRESSING OPPOSITION OF SB 175 NOW PENDING BEFORE THE STATE LEGISLATURE and directed copies be transmitted'to legislative representatives of.Temple City,. seconded by Councilman Gilbertson and carried. E. .League of California Cities Committee on International Municipal. Cooperation City Council. confirmed Mayor Dennis' appointment of Councilman Greenberg to represent Temple City on the League of California Cities Couuuittee on International Municipal Cooperation, which'is composed of one elected official from each city in the state. that . has .a Sister City. Council Minutes, March 18, 1975 - Page 5 F. .Abatement of Outdoor Advertising Structures in C -2 Zone Councilman Merritt moved to reject compromise offer for the removal of outdoor structures dated March 14, 1975 from Pacific Outdoor Advertising Co., and instruct the City Attorney to initiate the necessary legal action to enforce the provisions of the letter of agreement dated July 1, 1971,. seconded by Councilman Tyrell.and carried. G. Councilman Merritt. directed staff's attention tc the unsightly conditions at the former.Chevron station. at the corner of Las.Tunas and Oak, and the fanner Exxon station at Lower Azusa and Baldwin. • 18.
