The Council of Bal Harbour Village met Saturday, October 27, 19 13 of
9:30 A.M. in the Village Hall.
Present: Messrs. Betty, Brush, Printup and Scott:
Absent: Mr. Taplin
Also present were Fred W. Maley, Village Manager; Mary T. t,% tterer,
Village Clerk; and Thomas H. "neerson, Villagc t:ttornay.
Ou motion of Nx. Beatty, seconded by Mr. Brush and voted,the minutes
of the previous meeting of September 29, 1973 were approved as submitted.
Mr. Phillip Lundell of Neiman Marcus appeared requesting assistance
in obtaining relief from the sewer moratorium so that they could complete their
restaurant on the third floor. Mr. Anderson explained that the Village could
not help them in this matter except.that we would be glad to give a letter or
resolution to the counsel they retain, stating the Village has no objection to
the small amount of food wastes generated.
Pir. Leon Sirkasian requested that he be permitted to construct his
sw,= ng pool in conjunction with his residence on Lot 5 Block 10 on the piles
that were driven as shown on the original plan for the house, submitted before
tha amendment to the zoning ordinance. Due to the circumstances it was moved
by Mr. Beatty, seconded by Mr. Scott and voted, that the permit be granted.
Mr. Maley said that we are proceeding with the preparations for the
bond issue to complete the beach restoration project. Mr. John Kelly of
Freeman, Richardson, Warson, Slade, McCarthy and Kelly in Jacksonville have
been retainad as bond counsel as suggested by the Sun Bank, who will underwrite
the issue. The bond ordinance is being prepared and it is possible that it will
be raady for reading at a meeting that would be held on November 10th, The
president of Great Lakes Dredbing has been contacted and they will extend their
bid for an additional period while financing is being completed. The approval
has been received from )lade County and the Department of Natural Resources to
let the contract and the District Engineer's approval is being drafted.
Mr. Maley said that seven contractors had taken plans for the 96th
Street repaving work. Only two bids were received and opened in the presence
of the Vill.abe Clerk and himself and the two contractors on September 17th.
The bids being as follows:
O'Keefe Paving $ 110752.00
Marks Brothers 12,690.00
The Town of Surfside has agreed to pay approximately $4,784.00 of this amount
plus a proportionate share of the engineering costs. On motion of Mr. Brush,
seconded by Mr. Scott and voted, O'Keefe Paving was awarded the contract for
the 96th Street resurfacing.
On motion of Mr. Beatty, seconded by Mr. Brush and voted, AAA Auto
Leasing d/b /a/ White Cabs was granted 15 taxi permits for 1973 -74. The
applications of Morse, Surf and Yellow Cab had not been returned after having
been sent bank to the company to be properly executed and the Council agreed
to postpone action on granting these permits until the next meeting.
Existing permits will remain in force until the text meeting.
Mr. Maley explained that Harbour House North had requested that we
furnish forty spaces to park employees cars, as the jetty contractor is
utiliz,IM their parking area on the north side of the building. It was
agreed that Mr. Maley should work something m t for them.
A request from the Dade County Board of Public Instruction for a
share of our Federal Revenue Sharing monies was denied on motion of Mr.Beatty
seconded by Mr. Scott and voted.
Mr. Maley requested permission to hire Barton- Asebmann for about two
days to study setbacks along 96th Street and also include a review of Lot 1
of the Oceanfront District. After discussion it was moved by Mr. Scott,
seconded by Mr. Beatty and voted, that Barton- Aschmann be retained fir this
purpose for an amount not to exceed $500.00.
There being no further business on motion of Mr. Beatty,seconded by
Mr. Brush and voted, the meeting was adjourned at 11:15 A.M.

Village CLerk; and Thomas Anderson, Village Attorney.
On motion of Mr. Brush, seconded by Mr. Beatty and voted, the minutes
of the previous meeting of October 270 1973 were approved as submitted.
The Village Clerk reported that applications for taxi permits had been
submitted in proper form for the thine taxi companies operating as North Beach
Yellow Cab, Inc., Surf Cab, Inc., and Morse Taxi and Baggage Transfer.
Mr. Maley said inspections of the taxis had begun and a great many were found
to have defective meters and were in poor condition generally. It was moved
by Mr. Beatty, seconded by Mr. Taplin and voted, that the applications be
approved, however, if all corrections are not made to the cabs, by the date
