THE CITY OF BEL AIRE, KANSAS
ORDINANCE NO. 462
AN ORDINANCE APPROVING AND ADOPTING
THE COMPREHENSIVE DEVELOPMENT PLAN
UPDATE: 2007-2027 OF THE COMPREHENSIVE
DEVELOPMENT PLAN FOR BEL AIRE, KANSAS:
1994-2010 AND AMENDING SECTIONS 18.3.2,
18.3.3 AND 18.3.4 OF THE CODE OF THE CITY OF
BEL AIRE, KANSAS.
WHEREAS, the provisions of K.S.A. 12-747 et seq., authorizes and
empowers the Planning Commission of the City of Bel Aire, Kansas and the
Governing Body of the City of Bel Aire, Kansas to adopt and amend a
. Comprehensive Plan for the Bel Aire Planning Area; and
WHEREAS, pursuant to the provisions of K.S.A. 12-747 et seq., the
Planning Commission of the City of Bel Aire, Kansas did by a Resolution dated
March 13, 1995 adopt the Comprehensive Plan for Bel Aire, Kansas: 1994-2010;
and
WHEREAS, pursuant to the provisions of K.S.A. 12-747 et seq., the
Governing Body of the City of Bel Aire, Kansas did by Ordinance Number 256
adopt the Comprehensive Plan for Bel Aire, Kansas: 1994-2010; and
WHEREAS, the Planning Commission of the City of Bel Aire, Kansas held
a public hearing on the 11th day of October, 2007 at the Bel Aire City Hall, 7651
E. Central Park Avenue, Bel Aire, Kansas to receive comment on the
Comprehensive Plan Update: 2007-2027 of the Comprehensive Plan for Bel Aire,
Kansas: 1994-2010; and
WHEREAS, proper notice of the proposed Comprehensive Plan Update:
2007 -2027 of the Comprehensive Plan for Bel Aire, Kansas: 1994-2010 and the
public hearing was published in the official city newspaper; and

WHEREAS, the Planning Commission of the City of Bel Aire, Kansas has
determined that the Comprehensive Plan for Bel Aire, Kansas: 1994-2010 should
be updated by the proposed Comprehensive Plan Update: 2007-2027 and

. submitted the same to the Governing Body of the City of Bel Aire, Kansas for
consideration.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF
THE CITY OF BEL AIRE, KANSAS:
Section 1. Update Approval
The Comprehensive Plan Update: 2007-2027 of the Comprehensive Plan
for Bel Aire, Kansas: 1994-2010 which was submitted by the Planning
Commission of the City of Bel Aire, Kansas and is currently on file with the City
Clerk of the City of Bel Aire, Kansas, is hereby approved as an official update of
the Comprehensive Plan for Bel Aire, Kansas: 1994-2010.
Section 2. Amendino Section 18.3.2 of the Code
Section 18.3.2 of the Code of the City of Bel Aire, Kansas is amended to
read as follows:
"Section 18.3.2
Update Approval

The Comprehensive Plan Update: 2007-2027 of the Comprehensive Plan
for Bel Aire, Kansas: 1994-2010 which was submitted by the Planning
Commission of the City of Bel Aire, Kansas and is currently on file with the City
Clerk of the City of Bel Aire, Kansas, is hereby approved as an official update of
the Comprehensive Plan for Bel Aire, Kansas: 1994-2010, adopted pursuant to
the provisions of Ordinance Number 256."
Section 3. Amendino Section 18.3.3 of the Code
Section 18.3.3 of the Code of the City of Bel Aire, Kansas is amended to
read as follows:
"Section 18.3.3
Distribution
Attested copies of the Comprehensive Development Plan for Bel Aire,
Kansas: 1994-2010 and the Comprehensive Plan Update: 2007-2027 of the
Comprehensive Plan for Bel Aire, Kansas: 1994-2010 documents shall be sent to
all other taxing subdivisions in the Planning Area which shall request copies as
required by K.S.A. 12-747 (c)."
. Section 4. Amendino Section 18.3.4 of the Code

. Section 18.3.4 of the Code of the City of Bel Aire, Kansas is amended to
read as follows:
"Section 18.3.4
Annual Review
At least once a year, the Planning Commission of the City of Bel Aire,
Kansas shall review or reconsider the Comprehensive Plan Update: 2007-2027
of the Comprehensive Plan for Bel Aire, Kansas: 1994-2010 as part of its review
of the Comprehensive Plan for Bel Aire, Kansas: 1994-2010."
Section 5. Effective Date.
This Ordinance shall take effect and be in force from and after its
publication in the official city newspaper.
Passed by the City Council this 4th day of December, 2007.
Approved by the Mayor this 4th day of December, 2007.
