RESOLUTION NO. 00 -3951
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY MAKING CERTAIN FINDINGS IN ACCORDANCE WITH
HEALTH AND SAFETY CODE SECTION 33445 AND EXPANDING
THE EXISTING UNDERGROUND UTILITY DISTRICT NO. 4; AND
AMENDING RESOLUTION NO. 98 -3725
WHEREAS, the City Council of the City of Temple City has noticed a public hearing to determine
whether the public necessity, health, safety, and welfare requires the removal and undergrounding of poles,
wires, and associated overhead utility structures and facilities for the supply and distribution of electric,
communication and related services within the proposed amended Underground Utility District No. 4; and
WHEREAS, the location of the District is more fully described on the maps and legal descriptions
on file with the City Clerk; and
WHEREAS, the City Council has determined that it is necessary and appropriate for the
improvement of the District to be expanded at the earliest possible date; and
WHEREAS, the City Council has given public notice of its intention to expand the District and
has conducted a public hearing thereon in the manner required by law.
NOW, THEREFORE, the City Council of the City of Temple City does hereby resolve as follows:
SECTION 1. All affected property owners were notified in the manner required by law of the
intention of the City to establish the District, and the City Council has conducted duly noticed public
hearings held on December 4, 1979, and December 2, 1980, regarding the formation of the District.
SECTION 2. The City Council hereby fmds and determines the undergrounding to be
accomplished with the proposed expanded District will avoid and eliminate an unusually heavy
concentration of overhead distribution and transmission facilities and that the street, roads, and rights -of-
way in said District are extensively used by the general public and carry a heavy volume of vehicular
traffic.
SECTION 3. The City Council hereby reaffirms the existing District and further fords and
determines that the public necessity, health, safety, and welfare warrants the expansion of said District
1) to facilitate the removal of poles, overhead wires, and associated structures, and the underground
installation of wires and utilities for supplying electric, communication and similar or associated services
on such public streets, rights -of -way and private properties as are described and shown on the maps on
file with the City Clerk, which are incorporated by this reference; and 2) for conversion (connection) of
customer meter panels.
SECTION 4. The City Council hereby declares that all poles, overhead wires, and associated
overhead structures shall be removed and underground installation, and customer conversions made no
later that forty -two (42) months from and after the date of adoption of this Resolution upon all properties
in the area of the expanded District located on Encinita Avenue, between Las Tunas Drive and Broadway,
a described on the maps on file with the City Clerk and made a part hereof.
SECTION 5. The City Council hereby fords and determines that the construction of the District
is categorically exempt in accordance with Section 15302(d) of the State Guidelines for the implementation
of the California Environmental Quality Act of 1970, as amended. The City Council hereby further finds
and determines that pursuant to Government Code Section 65402(b), the District includes utility
improvements of a minor nature and therefore, the provisions of Government Code Section 65402

requiring submission to and report upon said project the City Planning Commission are inapplicable to the
District. The City Clerk shall submit Notice of Exemption with respect to the District for filing with the
Clerk of the County of Los Angeles in the manner required by law.
SECTION 6. The City Clerk shall certify to the passage and adoption of this resolution.
