Mayor Dennis called the regular meeting of the City Council to order at 7:30 p.m. on Tuesday, April 1, 1975, in the Council Chamber of the City Hall. III 2. The invocation was given by Reverend David Brinkley, Church of Christ, 5272 N. Sereno Drive. 3. The Pledge of Allegiance to the Flag was led by Mayor Dennis. 4. ROLL CALL: Present: Councilmen - Gilbertson, Greenberg,Merritt,Tyrell,Dennis Absent: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Assistant to the City Manager Biel, Planning Director Dragice- vich, Parks and Recreation Director Kobett, Public Works Coordinator Leonetti, Deputy City Engineer Kriegel 5. APPROVAL OF MINUTES: Councilman Merritt directed attention to an which should have stated Chevron station at Tunas and Alessandro rather than Oak Avenue moved to approve the minutes of the regular Council held on Tuesday, March 18, 1975, as by Councilman Greenberg and carried. REORGANIZATION: 1 APPOINTMENTS: error in Item 17 -G the corner of Las . Councilman Merritt meeting of the City corrected, seconded At this time the City Clerk assumed the Chair and opened nomina- tions for the Office of Mayor for the coming year. Councilman Tyrell nominated Councilman Gilbertson for the Office of Mayor, seconded by Councilman Merritt. Councilman Merritt moved that nominations be closed and a unanimous ballot be cast for Councilman Gilbertson, seconded by Councilman Greenberg and carried. Mayor Gilbertson accepted the gavel, and as a first duty in office, presented a plaque to outgoing Mayor Dennis on behalf of the Coun- cil in appreciation of the dedicated leadership he had provided for the past year. Mayor Gilbertson called for nominations for the office of Mayor Pro Tem. Councilman Merritt nominated Councilman Greenberg for the office of Mayor Pro Tem, seconded by Councilman Dennis. Councilman Mer- ritt moved that nominations be closed and that a unanimous ballot be cast for Councilman Greenberg, seconded by Councilman Dennis and carried. Merritt, seconded by Councilman Dennis and carried„ Councilman Tyrell moved to adopt Resolution No. 75 -1442 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, APPOINTING A MEMBER OF SAID COUNCIL OF SAID CITY TO THE RTD CITY SELECTION COMMITTEE PURSUANT TO PART 3 OF DIVISION 10 OF THE PUB- LIC UTILITIES CODE,; namely Councilman William I. Dennis, with Councilman Louis T. Gilbertson serving as alternate, seconded by Councilman Greenberg and carried. UNFINISHED BUSINESS: 7. ORDINANCE NO. 75 -397: 2nd read. CHANGE OF ZONE IN ZONE CHANGE CASE 74 -432 - Community Redevelopment Agency, applicant City Attorney Martin presented Ordinance No. 75 -397 AN ORDINANCE OF THE CITY OF TEMPLE CITY PROVIDING A CHANGE OF ZONE IN ZONE CHANGE CASE NO. 74 -432 for second reading by title only. Coun- cilman Greenberg moved to waive further reading and adopt, sec- onded by Councilman Merritt and carried. 8. PUBLIC HEARING: 7:30 p.m. PROPOSED ORDINANCE RE: ABATEMENT OF ABANDONED AND NONCONFORMING CURB CUTS AND DRIVEWAYS City Manager Koski presented background :information, stating the Planning Commission, at their regular meeting held February 25, 1975, held public hearing and adopted Resolution No. 75 -607PC recommending adoption of ordinance relating to the abatement of abandoned and nonconforming curb cuts and driveways. The pro - posal came originally from the Traffic Commission because aban- doned and nonconforming curb cuts contribute to front yard parking violations and at the same time may disqualify an applicant for an overnight parking permit, and eliminate 20 to 40 lineal feet of on- street parking at each location. Mayor Gilbertson declared the public hearing open. Planning Direc- tor Dragicevich gave staff report advising when the use of any curb cut, curb removal, driveway or driveway approach has been discon- tinued for a period of 180 consecutive days it is considered to be abandoned; that the ordinance proposed allows for the City to declare the same to be a public nuisance pursuant to the procedures set forth in Section 9480 of the Municipal Code. Council Minutes, April 1, 1975 - Page 3 There being no one come forward to speak in favor of, or in opposi- tion to the proposed ordinance, Councilman Greenberg moved to close the public hearing, seconded by Councilman Dennis and carried. Councilman Tyrell moved to certify the Environmental Impact Report, seconded by Councilman Greenberg and carried. City Attorney Martin introduced Ordinance No 75 -398 AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING NEW SECTIONS 9296.1, 9296,2, AND 9296..3 TO THE TEMPLE CITY MUNICIPAL CODE RELATING TO DRIVEWAYS AND CURB CUTS, by title only, Councilman Tyrell moved to waive further reading, seconded by Councilman Merritt and carried. 9 PUBLIC HEARING: 7:30 p.m. ESTABLISH UNDERGROUND UTILITY DISTRICT NO, 3 City Manager Koski presented background information, stating the City Council, at their regular meeting held March 4, 1975, adopted Resolution No, 75 -1432 declaring intention to establish Underground Utility District #3; the underground district calls for removal of all poles and overhead facilities within the district; the proposal includes additional highway lighting along Rosemead Boulevard and upgrading the lighting on Las Tunas Drive from the Eaton Wash to Rosemead Boulevard, the cost for lighting to be funded from Gas Tax revenues; the cost of the undergrounding will be borne by Southern California Edison Company out of Public Utilities Commis- sion allocations, as well as those for Pacific Telephone Company; property owners and tenants within the underground utility district received the Resolution of Intent and copies of the City's ordinance pertaining to regulations and procedures for removal of overhead utility facilities, as well as estimated costs for removal and installation of the underground facilities, Mayor Gilbertson declared the public hearing open. Deputy City Engineer Kriegel gave staff report including district boundaries, extent of utility participation, property owner costs, and an esti- mated time schedule. There being no one come forward to speak in favor of, or in opposi- tion to the proposed district, Councilman Tyrell moved to close public hearing, seconded by Councilman Greenberg and carried. Councilman Greenberg moved to adopt Resolution No. 75 -1443 A RESO- LUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 3, seconded by Councilman Merritt and carried. City Attorney Martin advised the affected property owners involved have 90 days in which to show they will perform the required con- version work, 10. PUBLIC HEARING: 7:30 pomp ALLEY IMPROVEMENTS: ALLEY SOUTH OF BROAD- WAY, ROSEMEAD BOULEVARD TO SULTANA AVENUE (pursuant to Chapter 27, Streets and Highways Code) City Manager Koski presented background information, stating the City Council, at their regular meeting held March 4, 1975, set public hearing April 1 for the construction of alley improvements in the east -west alley south of Broadway between Rosemead Boulevard and Sultana Avenue; petition has been filed with the City with the signatures of 57.5% of the owners whose properties are affected; property owners have been notified of the public hearing. Mayor Gilbertson declared the public hearing open, and invited any - one wishing to speak for or against the proposed improvements to come forward. Robinson, 9022 Broadway, questioned the validity of the 57.5% signatures, stating a neighbor told him he was withdrawing his support. Mr. Robinson was advised that no one who had signed the petition had withdrawn his support. There being no one else to speak, Councilman Tyrell moved to close the public hearing, seconded by Councilman Merritt and carried. Councilman Dennis moved to certify the Environmental Impact Report, seconded by Councilman Greenberg and carried. Councilman Merritt moved to find the project in the public interest because of easier access to the commercial properties•at the west end of the alley and improvement of the overall appearance of the neighborhood, approve the project and instruct the Superintendent of Streets to cause the work to be done, seconded by Councilman Tyrell and carried. 11. EMERGENCY OPERATIONS PLAN FOR THE CITY OF TEMPLE CITY City Attorney Martin presented revised Section V -B (2) as requested by Council at their regular meeting held March 18, 1975, said sec- tion providing conformance.with Government Code Section 8630. Councilman Tyrell moved to approve the amendment to the Emergency Operations Plan and adopt the Emergency Operations Plan for the City of Temple City, seconded by Councilman Dennis and carried. 12. TEMPLE CITY CHAMBER OF COMMERCE - EDUCATION FAIR: Request for Restricted Parking on Las Tunas Drive, April 25 -26, 1975 City Manager Koski advised that subsequent to City Council meet- ing of March 18, 1975 when Council received a request from the Chamber of Commerce to restrict traffic on Temple City Boulevard, the Chamber of Commerce promotional committee met and has with- drawn their request for closure of Las Tunas Drive and now request restriction of parking lanes between Camellia and Primrose, use of barricades, and permission to post signs on light standards. Mr. Albert Anspach, 9565 Las Tunas Drive, advised the request for permission to conduct the Edu -Fair is in conjunction with the Tem- ple City School District during Public Schools Week; that approxi- mately 20 demonstrations will be on display. Councilman Tyrell moved to approve Chamber of Commerce request as outlined in their letter of March 26, 1975,, subject to neces- sary insurance and removal of signs on light standards immediately following the program, seconded by Councilman Merritt and carried. NEW BUSINESS: 13. RECOMMENDATION FROM PARKS & RECREATION COMMISSION - Meeting of March 19, 1975 REQUEST FOR USE OF TEMPLE CITY PARK - Y.M.C.A. Indian Princesses City Manager Koski advised the Parks and Recreation Commission, at their regular meeting held March 19, 1975, redommended to the City Council that the request received from the Temple City Y.M.C.A. Indian Princesses for use of Temple City Park on April 19,'1975 from 2:00 -4:00 p.m. to present their Eighth Annual Costume and Craft review, be approved subject to the conditions that the Indian; Princesses be totally responsible and liable for all expenses related to the event, that the park be cleaned at the conclusior . of the event, and that a certificate of insurance be filed with the.. City Clerk naming the City of Temple City additionally insured. Councilman Merritt moved to approve the request of the Y.M.C.A. Indian Princesses as recommended by the Parks and Recreation Com- mission, seconded by Councilman Greenberg and carried. Council Minutes, April 1, 1975 - Page 5 14. RECOMMENDATION FROM PLANNING COMMISSION - Meeting of March 25, 1975 - ZONE CHANGE FROM R -3 TO C -2, 5200 through 5230 N, Rose - mead Boulevard City Manager Koski advised the Planning Commission, at their regular °meeting 'held March 25, 1975, held public hearing and adopted Resolution No. 75 -614PC recommending to the City Council a change of 'zone from R -3 to C -2 for the area outlined above for the reason the proposed site is abutting a primary road (Rosemead Boulevard) and is suitable for commercial development, the pro- posed zone is compatible with the existing development, and the proposed zone is compatible with the provisions of the General Plan. Councilman Tyrell moved to set public hearing April 15, 1975 to consider zone change from R -3 to C -2 for subject property, seconded by Councilman Dennis and carried. 15. TREE PLANTING ON LOWER AZUSA ROAD - STREET CONSTRUCTION PROJECT City Manager Koski presented - background information, stating the City Council at *their regular'meeting held February 18, 1975 reviewed recommendation for planting Bottle Brush trees along Lower Azusa Road from the Eaton Wash to Camellia Avenue and con - tinued the matter to allow staff to present other alternatives. Staff has prepared a list of five trees which would be suitable for planting along Lower Azusa Road. Councilman Dennis moved to authorize the planting of 46 Carrot - wood trees as determined from the listed choices, on Lower Azusa Road from Eaton Wash to Camellia Avenue, and authorize including the cost of planting the selected trees in each of the next two phases of the Lower Azusa Road construction project, seconded by Councilman Tyrell and carried. 16. RESOLUTION NO. 75 -1444: EMPLOYMENT OF PERSONNEL Councilman Tyrell moved to adopt Resolution No. 75 -1444 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL, seconded by Councilman Dennis and carried. 17. RESOLUTION NO. 75 -1445: WARRANTS & DEMANDS, Demand Nos. 1733 thru 1840 in the amount of $72,865.32 Councilman Merritt moved to adopt Resolution No. 75 -1445, A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $72,865.32, DEMAND NOS. 1733 THRU 1840, seconded by Councilman Dennis and carried, 18 COMMUNICATIONS: There were no communications. 19. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Marianne Milch, Chamber of Commerce, expressed appreciation of the ("51-)T5iTairETET working with Mayor Dennis during the past year, stating the Chamber looks forward to working with Mayor Gilbertson in the coming year. Mrs. Milch advised further, the Chamber is sponsoring a seminar, Adventures in Achievement, to be held Tues- day, April 22, 7:30 p.m. to 11:15 p.m. Mr. Ron Ci riano, Pacific Outdoor Advertising, stated his company e s t at a compromise reached in July of 1971 for the abatement of outdoor advertising structures had been breached by the City of Temple City. Mrs Marcia Dennis, 5310 Welland, 'stated that she had enjoyed being Temple City s First Lady" during the past year.. Council Minutes, April 1, 1975 - Page 6 RECESS TO CRA: The City Council recessed at 9:10 p.m. to meet as the Community Redevel- opment Agency, all members being present, approved the minutes of the regular meeting held March 18, 1975, 'approved first amendment to agree- ment for legal services, approved proposal to provide auditing services for fiscal year 1974 -75, adopted resolution approving warrants and demands and denied claims received from property owners within the Rosemead Boulevard Redevelopment Project area. Minutes are set forth in full in the minutes of the Agency. RECONVENE AS CITY COUNCIL: 20. ACTION ON REQUESTS BY CRA: A. Request for Advance of Funds Councilman Merritt moved to approve an advance of additional funds in the amount of $13,290.94 to the Community Redevelopment Agency and amend the agreement with the Agency accordingly, seconded by Councilman Greenberg and carried. 21. MATTERS FROM CITY OFFICIALS: A. California Contract Cities Seminar, Palm Springs, April 10 -13, 1975 - Request for authorization for advance registration Councilman Tyrell moved to authorize pre - registration and attendant expenses for city officials attending the California Contract Cities Seminar to be held in Palm Springs, April 10 -13, 1975, seconded by Councilman Dennis and carried. B. Resolution No. 75 -1446: Urging A Change in Laws regarding the Incarceration and Release of Juveniles charged with Felonies Councilman Tyrell moved to adopt Resolution No. 75 -1446 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, URGING A CHANGE IN LAWS REGARDING THE INCARCERATION AND RELEASE OF JUVENILES CHARGED WITH FELONIES, seconded by Councilman Dennis and carried. C. Conference Attendance - 1975 Calchapter, American Institute of Planners, Fresno-CA April 30 -May 3, 1975 City Manager Koski presenteT-e request for attendance of George DragiceVich., Planning Director, .to attend 1975 Calchapter Confer - ernce of American Institute`•of Planners, to be held in Fresno, California, April 30- May 3,-1975, with attendant expenses paid, as set forth in memo dated March 27, 1975. Councilman Greenberg moved to approve, seconded "by "Councilman Merritt and carried. D. Housing and Community Development Act of 1974 City Manager Koski presented-agreement to HUD received subsequent to Council authorization of City's participation in the Housing and Community Development Act of 1974 (HCD) and execution of coop- erative agreement with the County of Los Angeles. Council continued the matter to be discussed at a future study session. E. City Manager Koski expressed thanks, on behalf of the City staff, for the pleasue of working with Councilman Dennis and his cooperation during his term of office as Mayor. F. Councilman Greenberg stated-he had read an article on the approach "the City of Laguna Beach has taken in their attempt to eliminate unsightly newspaper stands and suggested Council's reading the article published in the Western Cities Magazine. G. Mayor Gilbertson stated he had a communication from Southern California Association of Governments requesting names be submitted for various committees for 1975 -76. Council Minutes, April 1, 1975 - Page 7 Mayor Gilbertson. stated he had received communication from Ameri- can Revolution Bicentennial Commission of California announcing a Bicentennial Workshop to be held in Fresno, CA, May 30 -June 1, 1975, and suggested Margie Calamia, Chairman of the Temple City Bicenten- nial Committee attend. Councilman Tyrell moved to approve registra- tion and attending expenses for Chairman of the Bicentennial Com- mittee, seconded by Councilman Greenberg and carried. H. Councilman Tyrell moved to direct City Attorney prepare an appropriate resolution opposing AB 625 which would establish a Bay Area Planning agency, seconded by Councilman Greenberg and carried. 1. Councilman Merritt moved to authorize registration for City staff wishing to attend seminar sponsored by the Chamber of Com- merce, seconded by Councilman Dennis and carried, 22. ADJOURNMENT: On motion by Councilman Dennis, seconded by Councilman Merritt, City Council adjourned at 9:35 p.m. Next regular meeting of the City Council will be held Tuesday, April 15, 1975, 7:30 p.m. in the Council Chamber of the City Hall.
