THE CITY OF BEL AIRE, KANSAS
ORDINANCE NO. 468
AN ORDINANCE CALLING FOR A SPECIAL ELECTION TO
BE HELD IN THE CITY OF BEL AIRE, KANSAS, FOR THE
PURPOSE OF SUBMITTING TO THE QUALIFIED
ELECTORS OF SAID CITY A PROPOSITION TO
AUTHORIZE THE CITY OF BEL AIRE, KANSAS, TO LEVY A
NEW ONE PERCENT (1 %) SPECIAL PURPOSE CITY
RETAILERS' SALES TAX WITHIN THE CITY OF BEL AIRE,
KANSAS, AND TO USE THE REVENUE FROM THE NEW
TAX TO FUND A STREET IMPROVEMENT PROGRAM
CONSISTING OF NEW CONSTRUCTION AS WELL AS
RECONSTRUCTION OF STREETS AND CURBS, SUCH
NEW TAX TO TAKE EFFECT ON JANUARY 1, 2009; SUCH
NEW TAX TO END DECEMBER 31, 2018; REQUESTING
THE SEDGWICK COUNTY ELECTION COMMISSIONER TO
CONDUCT SAID ELECTION AT THE SAME TIME AND
PLACE AS AND IN CONJUNCTION WITH THE GENERAL
ELECTION TO BE HELD ON THE 4th DAY OF NOVEMBER,
2008.
WHEREAS, K.S.A. 12-187 et seq. authorizes cities, including the City of
Bel Aire, Kansas ("City"), to submit to the qualified electors of the City the
proposition of levying a special purpose retailers' sales tax within the City in
increments of 0.05%, but not to exceed 1 %, such tax to expire after 10 years
from the date such tax is first collected; and
WHEREAS, K.S.A. 12-187 et seq. requires the City to specify the
purposes for which any special purpose retailers' sales tax is imposed within the
City; and
WHEREAS, the Governing Body of the City has determined that additional
revenue in the amount of approximately One Hundred and Twenty Thousand
Dollars ($120,000.00) is needed for the purpose of funding the design,
construction and inspection of a street improvement program consisting of new
construction as well as reconstruction of streets and curbs; and
WHEREAS, it is in the best interest of the City to raise the additional
revenues by a levy of a new one percent (1 %) Special Purpose City Retailers'
Sales Tax, such new tax to take effect on January 1, 2009; and
WHEREAS, it is in the best interest of the City to call an election for the
authority to levy such new tax; and
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF
THE CITY OF BEL AIRE, KANSAS:
Section 1. A special election is hereby called to be held in the manner
prescribed by law at the same time and place as and in conjunction with the
general election to be held on the 4th day of November, 2008, for the purpose of
submitting to the qualified electors of the City of Bel Aire, Kansas, a proposition
to authorize the City of Bel Aire, Kansas, to levy a new Special Purpose City
Retailers' Sales Tax within the City of Bel Aire, Kansas, in the amount of one
percent (1 %) and to use the revenue from the new tax to fund a street
improvement program consisting of new construction as well as reconstruction of
streets and curbs; and such new tax, if approved by a majority of the electors
voting thereon, to take effect on January 1, 2009; such new tax to end on
December 31, 2018.
Section 2. The proposition to be voted upon at the special election shall
appear on the ballot as follows:

Shall the City of Bel Aire, Kansas, be authorized to levy a one
percent (1 %) Special Purpose City Retailers' Sales Tax within the
City of Bel Aire, Kansas, and to use the revenue from the new tax
to fund a street improvement program consisting new construction
as well as reconstruction of streets and curbs; such new tax to take
effect on January 1, 2009; such new tax to end December 31,
2018?
Section 3. In accordance with the provisions of K.S.A. 12-187 et seq.,
the Sedgwick County Election Commissioner is requested to give notice of the
special election and conduct the special election at the same time and place as
and in conjunction with the general election to be held on the 4th day of
November, 2008.
Section 4. If approved by a majority of the electors voting thereon, such
new tax shall be subject to all applicable state laws and administrative rules and
regulations of the Kansas Department of Revenue which shall be utilized to
administer, enforce and collect such new tax.
Section 5. Upon publication, the City Clerk is hereby directed to deliver
a certified copy of this Ordinance to the Sedgwick County Election
Commissioner.
Section 6. This Ordinance shall take effect and be in force from and after
its publication in the official city newspaper.
