The motion was seconded by Mr. Waldron and it passed unanimously. Ms. Recos entered the meeting • The Commission signed the following documents:  Mangold & Martin, 3 Pond St – Invalid Certificate of Compliance (188-433)  Mangold & Martin, 3 Pond St – Certificate of Compliance (188-595)  Sung, 206 Wood St – Certificate of Compliance (188-1429)  Town of Hopkinton, town-wide drainage – 3rd renewal of Determination of Applicability (RDA 2003-20) Mr. Nation entered the meeting • Ms. Recos made a motion to approve the Minutes of 25 February 2013 Corrected, 11 March 2013, 25 March 2013, and 08 April 2013. The motion was seconded by Mr. Nation and it passed unanimously. • An informal discussion was held with Ms. Beth Biedelman regarding the installation of a mooring post and a dock in Lake Maspenock. The Commission determined that an after-the- fact Notice of Intent could be filed for the mooring post and dock. 7:38 PM Ofria, 202 Wood Street DEP File No. 188-1517 Notice of Intent-continuation Joseph P. Marquedant, J. D. Marquedant & Associates, Inc. Conservation Commission Hearing 29 April 2013 Page 2 of 4 Mr. Marquedant stated that the applicant was considering options to scale back the amount of proposed site work under the Notice of Intent (NOI). A discussion was held regarding not dredging the pond, not replacing but repairing the pond’s earthen berm and removing the existing boulders along the northern edge of the pond. Mr. Marquedant stated that he will submit revised information to document the revised NOI. The hearing was continued to 13 May 2013 7:50 PM Pyne, 4 Christian Way, 189 and 191 Pond Street DEP File No. 188-1518 Abbreviated Notice of Resource Area Delineation-continuation David Marquedant, J. D. Marquedant & Associates; James Pyne, applicant/owner Mr. Marquedant provided an overview of the Abbreviated Notice of Resource Area Delineation filing and the wetlands resource plans dated 01 March 2013. A discussion was held regarding the need for the submission of a StreamStats report and supplemental information regarding the status of the pond as a potential vernal pool. The hearing was continued to 13 May 2013. 8:15 PM South Mill Street LLC, 0, 74, 82 and 84 South Mill Street DEP File No. 188-1519 Notice of Intent-continuation Mr. Craig Nation recused himself from the Commission Peter Lavoie, Guerriere & Halnon Inc.; Scott Goddard, Goddard Consulting LLC; Ron Nation, South Mill Street LLC Mr. Lavoie provided an overview of the Notice of Intent filing, the site plans dated 13 March 2013, and his memo dated 29 April 2013 in response to the peer engineering review letter from BETA Group dated 04 April 2013. Mr. Ingram provided an overview of his review letter dated 29 April 2013. The hearing was continued to 13 May 2013. Mr. Craig Nation rejoined the Commission 8:20 PM PRC Building, 294 Hayden Rowe Street (Lot B) DEP File No. 188-1516 Notice of Intent-continuation Scott Goddard, Goddard Consulting LLC Mr. Goddard provided an overview of the letter from Attorney George Connors dated 28 March 2013. Mr. D’Urso made a motion to close the hearing and issue an Order of Conditions, subject to the submittal of a revised plan, with the standard and noted special conditions. The motion was seconded by Mr. Nation and it passed unanimously. Conservation Commission Hearing 29 April 2013 Page 3 of 4 8:35 PM Commission Business • A discussion was held regarding a request for minor project exemption from Emrick, 8 Winter Street dated 08 April 2013. The Commission determined that the installation of the proposed fence qualified as a minor project exemption. • A discussion was held with Ms. Sandra Altramura, 33 Elm Street, regarding standing water within and the operational status of the constructed infiltration basin under DEP File Number: 188-1436. The Commission determined to request the applicant to provide a status overview on the existing conditions of the infiltration basin. 8:55 PM Town of Hopkinton DPW, HCC File No. RDA 2013-3 Intersection of School Street and West Main Street Request for Determination of Applicability John Westerling, Town of Hopkinton DPW Director Mr. Westerling provided an overview of the Request for Determination of Applicability application and the site plans dated 27 March 2013. A discussion was held regarding the proposed roadway expansion project. Ms. Mary Plummer, 295 West Main Street asked a question about the existing catch basin adjacent to her property and Mr. Westerling responded to her question. Mr. D’Urso made a motion to close the hearing and issue a negative Determination of Applicability with the standard and noted special conditions. The motion was seconded by Mr. Waldron and it passed unanimously. 9:03 PM Commission Business • A discussion was held regarding the request from the Town of Hopkinton DPW for the Commission to consider issuing a three year renewal for the Determination of Applicability under HCC File Number: RDA 2003-20. Mr. Waldron made a motion to issue a three year renewal for the Determination of Applicability. The motion was seconded by Mr. D’Urso and it passed unanimously. 9:05 PM Mill Creek Realty Trust, 0 Lumber Street HCC File No. RDA 2013-4 Request for Determination of Applicability Mark Allen, Allen Engineering LLC; Scott Goddard, Goddard Consulting LLC Mr. Allen provided an overview of the Request for Determination of Applicability application and the site plans dated 08 April 2013. A discussion was held regarding site access for soil testing. Mr. D’Urso made a motion to close the hearing and issue a negative Determination of Applicability with the standard and noted special conditions. The motion was seconded by Mr. Waldron and it passed unanimously. Conservation Commission Hearing 29 April 2013 Page 4 of 4 9:15 PM Commission Business • A discussion was held regarding the draft Conservation Restriction from the Hopkinton Area Land Trust for the Deneen-Scarlata Subdivision, Oakhurst Road (188-1316). • Mr. Griben made a motion to have Mr. Ingram review the “Forest Ridge” Concept Plan and Special Permit Application, for Capital Group Properties LLC, 149 Hayden Rowe Street and provide comments to the Planning Board in response to their request. The motion was seconded by Mr. Nation and it passed unanimously. • Mr. Waldron made a motion to have Mr. MacAdam review the Major Project Site Plan Review, for S.F. Management LLC, 78 West Main Street and provide comments to the Planning Board in response to their request. The motion was seconded by Ms. Recos and it passed unanimously. • A discussion was held whether the request to prepare an area for two parking spaces with adequate gravel sub-base material and a crushed stone top layer within the roadway right-of- way adjacent to 97 Ash Street qualified under the town-wide Determination of Applicability under HCC File Number: RDA 2004-7). The Commission determined that the installation of the two pervious parking spaces qualified under the Determination of Applicability. • A discussion was held regarding a request for minor project exemption from Ferrari, 6 Barbara Road received on 23 April 2013. The Commission determined that the removal of the two sapling trees next to the driveway qualified as a minor project exemption. Minutes Approved: 29 July 2013
