Home My Public Portal About20130513 - Conservation Commission - Meeting Minutes Conservation Commission Hearing 13 May 2013 Page 1 of 3 MINUTES – 13 May 2013 Called to Order: 7:30 PM Hopkinton Town Hall, 2nd Floor Adjourned: 9:30 PM Members Present: Jeff Barnes, Frank D’Urso, Craig Nation, Melissa Recos, Marcus Waldron, Bob Ingram: Conservation Scientist, Don MacAdam: Conservation Administrator Members Absent: Andre Griben, Kerry Reed 7:30 PM Commission Business • The Commission signed the following documents:  PRC Building, 294 Hayden Rowe St (Lot B) – Order of Conditions (188-1516)  Hopkinton DPW, School St, West Main St – Determination of Applicability (RDA 2013- 3)  Mill Creek RT, 0 Lumber St – Determination of Applicability (RDA 2013-3)  Remaining Land of Abbott Realty Trust Elmwood Farm, Ash St – Conservation Restriction • A discussion was held regarding the proposed project change submitted by Prime Properties LP, Highland Park IV (188-1186) as identified on the engineered plan dated 11 June 2001 with a final revision date of 05 April 2013. Mr. Nation made a motion to determine the revision to the wetland replication area as an insignificant project change. The motion was seconded by Mr. Waldron and it passed unanimously • Mr. Waldron made a motion to endorse the 2013 Open Space and Recreation Plan as drafted. The motion was seconded by Ms. Recos and it passed unanimously. • A discussion was held regarding the status of the NSTAR Gas, East Main Street (RDA 2012- 12) site work. The Commission determined not to initiate any enforcement proceedings. • A discussion was held regarding a request for minor project exemption from Murphy, 45 Oakhurst Road dated 30 April 2013. The Commission determined that the installation of a hot tub under the existing deck qualified as a minor project exemption. • Mr. D’Urso entered the meeting. 7:50 PM Pyne, 4 Christian Way, 189 and 191 Pond Street DEP File No. 188-1518 Abbreviated Notice of Resource Area Delineation-continuation David Marquedant, J. D. Marquedant & Associates; Scott Heim, Northeast Ecological Services; James Pyne, applicant/owner Conservation Commission Hearing 13 May 2013 Page 2 of 3 Mr. Marquedant provided an overview of the StreamStats report dated 19 November 2012 and the letter from Mr. Pyne dated 08 May 2013. A discussion was held regarding the status of the intermittent stream and the pond not exhibiting vernal pool habitat characteristics. Mr. Nation made a motion to close the hearing and issue an Order of Resource Area Delineation. The motion was seconded by Ms. Recos and it passed unanimously. 7:58 PM Commission Business • The Commission reviewed the wetland remediation plan dated 15 April 2013 for Rosewood Management, 63-65 South Street that was submitted to MA DEP under the enforcement review. • The Commission reviewed the response letter from Golden Pond, 50, 58 60 West Main Street (188-1436) dated 10 May 2013 regarding the construction status of the detention basin. 8:10 PM Olson, 0 Spring Street DEP File No. 188-1508 Notice of Intent-continuation Joseph P. Marquedant, J. D. Marquedant & Associates Mr. Marquedant provided an overview of the site plans dated 20 March 2013 with a final revision date of 12 April 2013, and his two (2) memos dated 08 May 2013. The hearing was continued to 24 June 2013. 8:25 PM Perkins, 201, 215 Hayden Rowe Street DEP File No. 188-____ Notice of Intent-continuation Joseph P. Marquedant, J. D. Marquedant & Associates; William Perkins, applicant/owner Mr. Marquedant provided an overview of the Notice of Intent and site plans dated 03 December 2012 with a final revision date of 18 March 2013. A discussion was held regarding the amount of buffer zone disturbance proposed for the detention basin located west of the condominium units and that the roadway crossing will need to meet the stream crossing standards. The hearing was continued to 24 June 2013. 8:45 PM South Mill Street LLC, 0, 74, 82 and 84 South Mill Street DEP File No. 188-1519 Notice of Intent-continuation Mr. Craig Nation recused himself from the Commission Peter Lavoie, Guerriere & Halnon Inc.; Scott Goddard, Goddard Consulting LLC; Ron Nation, South Mill Street LLC Conservation Commission Hearing 13 May 2013 Page 3 of 3 Mr. Lavoie provided an overview of the revised site plans with a final revision date of 09 May 2013 and which were submitted on 10 May 2013. Mr. Goddard provided overviews of his response memo dated 13 May 2013, the map entitled “Wetlands to the East of South Mill Street” dated 13 May 2013, and the Cumulative Buffer Zone Impact Analysis dated 13 May 2013. The Commission determined more time was needed to review the submitted information. The hearing was continued to 03 June 2013. Mr. Craig Nation rejoined the Commission 9:10 PM Ofria, 202 Wood Street DEP File No. 188-1517 Notice of Intent-continuation Joseph P. Marquedant, J. D. Marquedant & Associates, Inc. Mr. Marquedant provided an overview of his memo dated 14 November 2012 with a final revision date of 10 May 2013. Mr. Waldron made a motion to close the hearing and issue an Order of Conditions with the standard and noted special conditions. The motion was seconded by Mr. Nation and it passed unanimously. 9:20 PM Commission Business • A discussion was held regarding the Board of Selectman notification for reappointments to the Commission. The Commission determined to recommend to the Board of Selectman that Mr. D’Urso, Mr. Griben and Ms. Recos be reappointed to the Commission. • Mr. MacAdam provided an overview of the comments he submitted to the Planning Board in response to the Planning Board’s request for comments on the application for Minor Site Plan Review Application from the Hopkinton Pediatric Dental Associates, 79 Hayden Rowe Street.
