A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD REJECTING
THE BID SUBMITTED BY BANNAOUN ENGINEERS-CONSTRUCTORS CORP.,
AWARDING A CONTRACT TO ALL AMERICAN ASPHALT AS THE APPARENT
LOWEST RESPONSIBLE BIDDER, IN THE AMOUNT 00= $253,052.05 FOR THE
OTIS STREET IMPROVEMENT .PROJECT, PROJECT NUMBER 4011.67.873,
'FEDERAL PROJECT NUMBER 07-LA-0-LYN-ESPL 5250 (015), AND AUTHORIZING
THE MAYOR TO EXECUTE THE AGREEMENT

WHEREAS, the Otis Street Improvement Project is scheduled for- completion
during fiscal year (FY) 2009-2010 and funded with the Federal American Recovery and
Reinvestment Act funds; and
WHEREAS, the City Council of the City of Lynwood adopted the plans,
specifications and working details for the Otis Street Improvement Project on August !18,
2009, and Public Works staff advertised the project on August 21, 2009, August 27,
2009 and. on September 3, 2009;-and
WHEREAS, nineteen contractors received project plans and contract documei ts;

WHEREAS, the 'bid opening. took place in the Office of the City Clerk' on
September 24, 2009, and eleven contractors submitted bids; and
WHEREAS, Bannaoun•,Engrieers-Constructors Corp: submitted the lowest bid at
$235,937, but did not meet the federal requirement relating to the use of Underutilized
.Disadvantaged :Business Enterprises, rendering its bid non-responsive; and
WHEREAS, the Director of Public Works /City Engineer has ascertained that All
American Asphalt, Inc. was the lowest responsible bidder at $253,052.05; and'
WHEREAS, a reference cheek has revealed that this contractor has ;the
necessary experience and aontractor's~license for this type of project; and

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS:
Section 1. That the City Council rejects the bid submitted by Bannaoun
Engineers-Constructors Corp.

Section 2. That the contract for the Otis Street Improvement Project, Project
No. 4011.67.873, Federal Project No. 07-LA-LYIV-ESPL 5250 (015), be awarded to All
American Asphalt, Inc. for .its apparent lowest responsible bid of $253,052.05.
Section 3. That the Mayor is hereby authorized. to execute the agreement
between the City Council of the City of Lynwood and All American Asphalt, Inc.,
approved as to form by the City Attorney.
Section 4. This resolution shall take effect. immediately upon its adoption.
Section 5. The City Clerk shall certify as to the adoption of this City. Council
Resolution.
