A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD REJECTING
THE BID SUBMITTED BY BANNAOUN ENGINEERS-CONSTRUCTORS CORP.,
AWARDING A CONTRACT TO .ELITE BOBCAT SERVICE (EBS), INC. AS 'THE
APPARENT LOWEST RESPONSIBLE BIDDER, IN THE AMOUNT OF $567,567 FOR
THE MARTIN LUTHER KING, JR. BOULEVARD IMPROVEMENT PROJECT,
PROJECT NO. 4011.67.872, FEDERAL PROJECT .NO. 07-LA-0-LYN-ESPL 5250
(014) AND AUTHORIZING THE MAYOR TO EXECUTE THE AGREEMENT
WHEREAS, the Martin Luther King, Jr. Boulevard Improvement Project is
scheduled for completion during fiscal year (FY) 2009-2010 and funded with the Federal
American Recovery and Reinvestment Act funds; and
WHEREAS, the City Council of .the City of Lynwood adopted the plans,
specifications and working details for said project on August 18, 2009, and Public Works
staff advertised the project on August 21; 2009; August 27, 2009 and on September 3,
2009; and

WHEREAS, twenty-three contractors received project .plans and contract

WHEREAS, the bid opening took place in the Office of the City Clerk on
September 24, 2009, and eleven contractors submitted bids; and
WHEREAS, Bannaoun Engineers-Constructors Corp. submitted the lowest bid at
$553,993.50, but did not meet the federal requirement relating to the use of
Underutilized Disadvantaged -Business Enterprises, rendering its bid non-responsive;
and .` , _
WHEREAS, the Director of Public Works /City Engineer has ascertained that
Elite Bobcat Service, Inc. was the lowest responsible bidder at $567,567; and
WHEREAS, .a reference check has revealed that this contractor has the
necessary experience and contractor's license for this type of project.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS:
Section 1. That the City Council rejects the bid submitted by Bannaoun
Engineers-Constructors Corp. '
Section 2. That the contract for the Martin Luther King, Jr. Boulevard
Improvement Project, Project No's. 4011.67.872, Federal Project No. 07-LA-0-LYN-
ESPL 5250 (014), be awarded to Elite Bobcat Service, Inc. for its apparent lowest
responsible bid of $567,567.
Section 3. That the Mayor is hereby authorized to execute the agreement
between the City Council of the City of Lynwood and Elite Bobcat Service, approved as
to form by the City Attorney.
Section 4. This resolution shall take effect immediately upon its adoption.
Section 5. The City Clerk shall certify as to the adoption of this City Council
Resolution.
