Mr. Maley said the proposed Excise Tax Revenue Bond Ordinance to finance the balance of the beach restoration project had just been received. The Village Manager read the ordinance in full and several changes were dis- cussed. It was moved by Mr. Taplin, seconded by Mr. Beatty and voted that passage of the ordinance be continued until November 24, 1973s with all the changes to be approved and inserted by Mr. Anderson by that time. Mr. Maley reported that we had received the approval of the District Engineers to let the contracts for the balance of the project. There being no further business on motion of Mr. Taplin, seconded by Mr. Beatty and voted the meeting was adjourned at 11:35 A.M. ATTEST: Village Clark Mayor December 8, 1973 The Council of Bal Harbour Village not Saturday, December 8, 1973 at 9:30 A.M. in the V111W Hall. Present: Messrs, Beatty, Brush, Printup, Scott and Taplin Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village Clerk; and Thomas H. Anderson, Village Attorney. On motion of Mr. Beatty, seconded by Mr. Brush and voted, the minutes of the previous meeting of November 10, 1973 were approved as submitted. Ordinance No. 162, which had been read in full at the November 10th meeting, was presented to the Council. Mr. Maley told the Council that Mr. Kelly, the bond attorney, had agreed to the changes requested by the Council regarding the levy of the special assessment only in the event of insufficiency of the Resort Tax, and the hiring of an individual Certified Public Accountant instead of a firm. Mr. Scott said he would like the properties located on the west side of Collins Avenue, specifically exempted from a possible special assessment. Mr. Anderson explained to the Council the legal process involved in special assessments and suggested that the ordinance be passed as presented. It was moved by Mr. Beatty, seconded by Mr. Taplin, that ORDINANCE NO. 162 establishing an Excise Tax Bond Issue for the beach restoration project be adopted. 46 The ordinance was adopted on the fllowing vote: Messrs. Beatty, Brush, Printmp and Taplin "yes "; Mr. Scott "no ". Mr. Maley reported that as of November 8, 1973 Hardaway Contracting Company, who is constructing the metty, had shut down due to lack of stone delivery. He explained that the core and cap stones are available at the quarry, but there were no railroad cars available for transportation and the weight of the stones precludes any other type of ground transportation. ORDINANCE NO. 163 requiring certain type of containers for collecting garbage in the ocean- front district was read in full by the Clerk on motion of Mr. Brush, seconded by Mr. Taplin and voted the ordinance was adopted. Mr. Dan Paul, representing Neiman Marcus, and Mr. Wheeler, consulting" engineer, asked the Council to approve a soakage pit for a proposed restaurant In the store. They explained that the effluent would run into a holding tank where the grease would be filtered out and then to a soakage pit under the landscaped area at the store. Mr. Anderson said it did not appear that them is a prohibition against soakage pits in the Zoning Ordinance. Mr. Beatty moved that since it appears that this does not consist of sanitary effluent, the permit be granted. The motion was seconded by Mr. Scott and voted. On motion of Mr. Brush, seconded by Mr. Beatty, and voted, Mr. Maley was authorized to advertise for bids for the water pumping station with bids to be opened on Wednesday, January 9,1974. Mr. Maley said that due to the fact that the Barton-Aschmann report on the 96th Street setbacks and the Shopping Center expansion had just been received, he would like to send the report to the Council for discussion at the next meeting. Mr. Harold Potter of White Cabs requested the Council to allow him to increase rates for their cabs and all taxis operating in Bat Harbour to 60c for the lot 1 /7th =its and 20c for each additional 2 /7th mile and an $8.00 an hour waiting tins. After discussion it was moved by Mr. Beatty, seconded by Mr. Taplin and voted, that Bat Harbour would approve the increase as soon as Miami Beach granted the same increase. On motion of Mr. Beatty, seconded by Mr. Taplin, and voted, the Americana Hotel was granted permission to use the garage area for exhibition purposes for two conventions through June, 1974. Mr. Malay.said that he had requested bids for storm drainage work at 96th Street and Harding Avenue and had received proposals from O'Keefe Paving in the amount of $50650. and Clifton Ughtsey, Inc. for $3,750. It was moved by Mr. Taplin, seconded by Mr. Beatty and voted to accept the proposal of Clifton lightsey for the work. Mayor Printup reported he had contacted the various commercial properties in the Village and had received excellent responses on what they were doing to conserve fuel and power during the energy crises. Mr. Maley and Police Chief Staubesand also outlined steps that had been taken in the municipality. December 8, 1973 On notion of Mr. Taplin, seconded by Mr. Brush, Mr. Maley was voted a Christmas bonus of $600.00. Dr. Lewis Elias appeared before the Council and asked that he be allowed to construct a residence on Lot 9 Block 11, Residential District, with a septic tank, until the building moratorium is lifed for sewer hook-ups. Dr. Elias outlined his service to the community and explained that he was unable to find another rental property for his family. Mr. Beatty suggested that the Zoning Ordinance be amended to permit septic tanks for single family dwellings. After discussion, it was moved by Mr. Brush, seconded by Mr. Scott, that Dr.Eliss be granted a variance to construct a temporary septic tank in conjunction with a single family residence on Lot 90 Block 11, until he is permitted to hook up to the Bal Harbour sewer line. The motion was passed by Messrs. Brush, Printup, Scott and Taplin voting "yes "; Mr. Beatty "no ". Mr. Anderson reported that he had obtained an opinion from Secretary of State Shevin stating that municipalities in Dade County were not bound by the Home Rule Powers Act, which means it will. not be necessary to publish our intent to pass various ordinances. Chief Staubesand told the Council that the trial work schedule for the police department utilizing 9 hour shifts each day would terminate on December 15th. Individual approval of the program was about 50% and it did not appear to be workable on a permanent basis. By common consent Village employees were granted Monday, December 24th as a legal holiday for 1973. There being no further business on motion of Mr. Beatty, seconded by Mr. Scott and voted, the meeting was adjourned at 12:15 P.M.
