HomeMy Public PortalAboutResolution 00-39691 1 1 RESOLUTION NO. 00 -3969 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING THE NEGATIVE DECLARATION AND AMENDING THE GENERAL PLAN (GENERAL PLAN UPDATE 2000) The City Council of the City of Temple City does hereby resolve: WHEREAS, the State mandates that cities periodically update their General Plan; and WHEREAS, Temple City's Ceneral Plan was last revised in 1987; and WHEREAS, the Planning Commission conducted a noticed public hearing on September 26, 2000 and recommends amendments as contained herein; and WHEREAS, the City Council has conducted a public hearing to consider the recommended modifications, deletions and additions to the General Plan; and WHEREAS, the City is currently embarking upon an expanded redevelopment effort within a portion of the City, this General Plan amendment is quite timely. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL AMENDS THE GENERAL PLAN AS FOLLOWS: 1. The maximum residential density as delineated on Page LE -4 shall be modified to reflect the current maximum residential density of 18 dwelling units per acre. 2. Maximum floor area ratios (F.A.R.) relative to commercial developments shall be modified: In the Land Use Element, Page LE -5, floor area ratio (F.A.R.) criteria is established for commercially -zoned properties. Specifically, the reference to a maximum floor area ratio (F.A.R.) of 2.8 on commercially -zoned properties shall be eliminated. This change is suggested in light of current development trends, land costs, contemplated redevelopment action and the need for the City to remain competitive with other communities if it is to retain the current level of services. 3. Established goals, policies and implementation measures relative to residential development shall be revised and updated to include the following: a) Table L -3 which illustrates the Zoning Ordinance /General Plan consistency shall be expanded to clearly delineate that any land use category or zoning category is consistent with and/or compatible with a redevelopment project area designation. Further, reference on Page LE -13 to a "Revitalization Plan Committee" shall be deleted. More specifically, a commercial use or any other use which is consistent with an Adopted Redevelopment Plan shall be deemed consistent and compatible with the City's Land Use Element of the General Plan, regardless of the Land Use Designation. Further, within a designated redevelopment area, mixed uses such as residential and commercial shall be deemed to be consistent with the Land Use Element Map even though the land use map may only reflect a single land use category. The General Plan shall be amended to specifically state that the furtherance of any Adopted Redevelopment Plan is consistent with the purpose and intent of the General Plan. 4. Allowance for the creation of redevelopment areas shall be specifically noted in the Land Use Element. Specifically, Goal 3 as enumerated on Page LE -13 shall include the following: Policy 3f - Consideration shall be given to forming additional redevelopment areas in order to Resolution No. 00 -3969 General Plan Amendment Page 2 revitalize the downtown business district along Las Tunas Drive and/or expand commercial opportunities elsewhere within the City. On Page LE -13, Implementation Measure 3a should read as follows: The City will continue with efforts to revitalize the Las Tunas Drive commercial area, which may include the creation of one or more redevelopment project areas; said redevelopment project area could incorporate abutting or adjacent residendal properties so as to expand the depth of any new development to better accommodate a broader range of uses and appropriate parking, landscaping, etc. Parcels designated as reside-itial land use areas on the City's Land Use Element of the General Plan may be improved w.th ,:ommercial uses or mixed uses within ai: adopted redevelopment area. 5. Goals and objectives and policies relative to recreational services shall be updated and information relative to recreational facilities, including improvements at Live Oak Park, shall be mentioned in the revised Adopted General Plan document. More specifically, the Resource Management Element shall be revised to specifically note the recently- constructed Live Oak Park community building. 6. Traffic counts shall be updated to reflect the most recent counts as opposed to those noted in the Adopted Element, which were from 1986. The Circulation Element shall be amended to update the map noted as Figure C -2 (Page CE -4). 7. Traffic operational improvements as noted in Table C -1 of the Adopted Element shall be deleted and updated at a later date. 8. The General Plan shall be updated to specifically reference new programs which will further improve the environment, such as the Congestion Management Program (CMP), the National Pollutant Discharge Elimination System (NPDES) and the Standard Urban Stormwater Mitigation Plan (SUSMP). Specifically, the Resource Management Element shall be amended to read that any new development within the City, unless otherwise exempt, shall be in full compliance with the Congestion Management Program (CMP), - the National Pollutant Discharge Elimination System (NPDES) and the Standard Urban Stormwater Mitigation Plan (SUSMP). SECTION 1. This project should not result in significant effects upon the environment, and a Negative Declaration has been prepared in accordance with the State CEQA Guidelines. The initial statement as prepared indicates there is no potential for adverse impact to the environment as it relates to all wild animals, birds, plants, fish, amphibians, and related ecological communities, including the habitat upon which the wildlife depends for its continued viability. SECTION 2.
