HomeMy Public PortalAboutOrd. 179 - Retail Sale of BeerVILLAGE OF MoCALL ORDINANCE NO.242Y AN ORDINANCE AMENDII' q SECTION 2-105 OF THE VILLAGE OF MoCALL CODE OF 1949 RELATING TO RETAIL SALE OF BEER; PRESORIBING UNLAWFUL `'RACTICES; PROVIDING Ri;GULATIONS FOR CONDUCT OF PLACE OF BUSINESS AND INSPECTION OF SAME AID PROVIDING FOR CHECK OF AL- COHOLIC CONTENT OF BEER; PROVIDING WOR POSTING OF LICENSES ISSUED HEREUNDER AND REGULATING TRANSFER OF SAME. BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF TRUSTEES OF THE VILLAGE OF McCALL, IDAHO: section 1. That Section 2-105 of the Village of McCall Code of 1949 be and the same is hereby amended to read as follows: Section 2-105 Regulations. (a) It shall be unlawful for any person to suffer or permit any person under 20 years of age to consume beer in or upon his premises, or far any person to sally serve or dis- pense beer to or by any person under 20 years of age or to any person who is intoxicated. (b) That every person to whom a license shall be granted shall at all times conduct a quiet and orderly place of business which shall be open to the inspection at all times of any police officer of the Village of McCall, the State of Idaho, or of the United States, and that said persons, or either of them shall have the right at any time to make an examination of the said licensed premises to ascertain if the licensee of said premises is conforming to the provisions of this ordinance, the laws of the State of Idaho, or the laws of the United States, aDplicable thereon, and to check the alcoholic content of any beer being kept for the purpose of sale or distribution on said premises. (c) T_iat all licenses issued under this ordinance shall be posted in a conspicuous place on the premises, and kept posted during the full period of time for which the same is issued, and that said license shall not be sold, transferred or ;assigned without the written consent of a. majority of the Board of Trustees; that in case of the receivership, assignment, bankruptcy, or incompetency of the licensee, the lioenseeTa business may be carried on under the license by the duly appointed qualified and acting receiver, seeignee, trustee in bankruptcy, guardian, executor or administrator of the licensee, providing that such receiver, aseignoa, trustee, guardian, executor or ad- ministrator shall file with the, Village Clerk a certified copy of his appointment and secure the written consent of the said Board of Trustees, Passed and approved this 14.th r of Septo nb r 1953.
