Please respond to this public record request in a singular manner and do not combine this public record request with any other public record requests when responding. Before making this public record request, I first searched the public records portion of your agency's website hoping I could locate the public record I seek without having to trouble you for it. Unfortunately 1 can not find the records I wish to examine. I request you provide for my inspection the public record which is: 10 most recent communications received from any Town resident(s) regarding the Town Budget or litigation. I make this request pursuant to Article 1, Section 24 of the Florida Constitution and Chapter 119 of the Florida Statutes. If you contend that any of the records I am seeking, or any portion thereof, are exempt from inspection or disclosure please cite the specific exemption as required by § 119.07(1)(e) of the Florida Statutes and state in writing and with particularity the basis for your conclusions as required by S I I9.070)(f) of the Florida Statutes. Please take note of 4119.07(1)(c) Florida Statues and your affirmative obligation to (1) promptly acknowledge receipt of this public records request and (2) make a good faith effort which "includes making reasonable efforts to determine from other officers or employees within the agency whether such a record exists and, ifso, the location at which the record can be accessed." I am, therefore, requesting that you notify every individual in possession of records that may be responsive to this public records request to preserve all such records on an immediate basis. If the public records being sought are maintained by your agency in an electronic format please produce the records in the orieinal electronic format in which they were created or received. There is no easy fix to this problem. Make no mistake here, the problem is not the Town, the be the forty plus law suits that the Town is forced to deal with. That would be fine if you weren't playing with other people's money and more relevant needs weren't going unattended. As a preliminary matter, to paraphrase one of the other Town residents who spoke at the meeting, I don't think I have ever seen anything quite like the exercise in representative government that took place at the meeting. The personal attacks, invective and sanctimonious and self-serving re -hash of the slights and perceived slights suffered by Messrs. O'Hare and O'Boyle, on the one hand, and the members of the Commission, on the other hand, were not at all helpful or productive. Mr. Ganger's statement that we all needed to remember that we were at a budget meeting (the implication being that any discussion of how the litigation might be resolved was out-of-bounds) was also not helpful. When the Commissioners laid out the propaganda table in the Town Hall foyer and when Mr. Morgan invited residents to put forth their thoughts on the budget in his September 17 open letter to Town residents, they should have realized that they were inviting residents to speak their mind on the causes of the legal budget line item, which is exactly what happened. What you saw is that the overwhelming majority of residents who came to the meeting were very upset about the escalating litigation and what it is doing to the community from a livability standpoint as well as a financial standpoint. The only dog that I have in this hunt is my desire, as a Gulf Stream resident and taxpayer, to live in harmony with my neighbors in a well-managed and well - governed community. At this point, it does not seem to me that Gulf Stream has any of these characteristics. As I mentioned at the meeting, I have been practicing law for over 34 years. During that time, I have served as the general counsel of three public companies and two private equity firms, as a director of many corporations, and as a member of the national advisory board of a law school. In addition to my legal role, I am a partner TEL 561-400-6236 EMAIL PWKLEINDGMAILCOM Commissioners, Town of Gulf Stream Martin O'Boyle Christopher O'Hare September 25, 2015 Page 2 of 3 in a private equity firm and have been a partner or senior executive of private equity firms since 1986. 1 am a corporate transactional lawyer, not a litigator, but I have been around litigation for my entire career. As a general counsel, I managed a large annual legal budget and I have managed litigation matters ranging from securities litigation to class action lawsuits, public interest lawsuits and nuisance lawsuits. I have been involved in the prosecution and defense of lawsuits, as well as numerous alternative dispute resolution proceedings, including mediations, arbitrations and negotiated settlements. 1 have been a decision maker in deciding to take cases "to the mat" (which I have done) or to settle them. I have negotiated many settlements and many, many business transactions. With that background in mind and based on my experience, here are my thoughts and opinions on the current situation: 1. The past is the past. It doesn't matter any more. All of the parties need to let it go and move on. 2. Neither the Town nor Messrs. O'Boyle or O'Hare has a "slam dunk" case with regard to any of the pending matters (although depending on the particular case, each of them may have a relatively stronger argument than the opposing side). 3. If the cases are not settled, the litigation will last for an extended period of time, making it virtually certain that the entire $1 million reserve will be spent and highly likely that the Commission will be coming "back to the trough" next year or the year after. 4. The litigation is a drain on the Town's non-financial resources as well as its financial resources. The human capital devoted to this fiasco and the opportunity cost of those who preside over it when they could be doing other things to better this community is huge. 5. The reputational damage to the Town and the community from this war will eventually have economic implications. This has already become a joke up and down the barrier island. Ultimately, the homeowners will suffer more than they already have if this is not resolved and resolved quickly. 6. Litigation is a dangerous game when one of the litigants is determined to take the case to the mat as a matter of principle. When both parties have that intent, it is like Russian roulette. 1 could care less if Messrs. O'Hare and O'Boyle want to spend all of their time and money on these cases, but 1 feel very differently when it comes to the Commissioners spending my money. 7. Expecting Mr. O'Boyle and Mr. O'Hare to settle by agreeing to a mutual suspension of hostilities and no more is like expecting Donald Trump to apologize to anyone. It isn't going to happen. There has to be a sweetener and I have a few ideas on that score. Bad idea from a strategic standpoint. I may be wildly optimistic, but i believe that despite this these cases can be settled once and for all for a fraction of that amount. I have met Mr. O'Boyle once and I have never met Mr. O'Hare, yet despite the rhetoric, i believe that they really do want this to end. I also believe that a properly constructed settlement agreement would mitigate the risk of "re -openers" as has happened in the past. 9. The parties should get started on serious good faith settlement discussions now, with a goal of wrapping things up by the end of the year at the latest. I think Mr. O'Boyle's suggestion of putting a couple of residents on a settlement committee is a good one. Despite the fact that I have an active law practice and plenty of other things to do, I am willing to volunteer my services — without compensation — to serve on such a committee, provided that I receive adequate assurances of no legal reprisals by the O'Boyle/O'Hare camp for my services, whatever the outcome. You are all intelligent successful people. Surely you have better things to do than to fight a war of attrition until no man or woman is left standing. The problems that this country and the world face offer high contrast to the parochial and downright stupid little drama this has become.
