Staff Recommendation:
Motion to Recommend Approval of a Special Exception to 118 SF of covered, unenclosed
area that exceeds the maximum floor area ratio (Section 70-72 (b) (2)).
Motion to Recommend Approval of a Level 3 Architectural/ Site Plan based on a finding that
the proposed 2 story single family Georgian style dwelling with attached 2 car garage,
consisting of 5,565 SF, and a swimming pool meet the minimum intent of the Design Manual
and applicable review standards with the following conditions:
1. Prior to the issuance of a certificate of occupancy, the owner of the property shall
prepare and record a deed restriction which shall provide that all roof projection
areas shall remain unenclosed as per approval of the special exception for as long
as the structure is in existence or exceeds the maximum FAR.
2. The electric service lines shall be buried.
3. Any minor modifications in the landscape plan shall be submitted to the Town Manager
for review and approval and any major modifications shall be brought back to the ARPB
for review and approval, prior to commencement of landscaping.

NOTICE OF APPLICATION FOR DEVELOPMENT APPROVAL
NOTICE IS HEREBY GIVEN that the Architectural Review and
Planning Board of the Town of Gulf Stream will hold a Public
Hearing on THURSDAY, SEPTEMBER 24, 2015 AT 8:30 A.M., and the Town
Commission will hold a Public Hearing on FRIDAY, OCTOBER 9, 2015
AT 9:00 A.M., both in the Commission Chambers of the Town Hall,
100 Sea Road, Gulf Stream, Florida, at which the following will be
considered:
An application submitted by Seaside Builders LLC as agent for
3180 Gulf Stream, LLC, owner of property located at 3180 Polo
Drive, Gulf Stream, Florida 33483, legally described as Lot
1, 3140-3180 Polo Dr. according to plat thereof as recorded
in Plat Book 119, Page 195, Public Records of Palm Beach
County, Florida for the following:
SPECIAL EXCEPTION to allow 118 square feet of covered,
un -enclosed area that exceeds the maximum allowed floor
area ratio.
LEVEL 3 ARCHITECTURAL/SITE PLAN REVIEW to permit
construction of a 5,565 sq. ft. 2 -story, single family
Georgian style dwelling with attached 2 car garage and
a swimming pool.
The Architectural Review and Planning Board shall make a
recommendation to the Town Commission, and the Town Commission
shall make a final decision regarding the subject application at
the meetings noticed above. These meetings may be adjourned from
time to time and place to place as may be necessary to hear all
parties and evidence.
The complete application materials are on file in the Office
of the Town Clerk located at 100 Sea Road, Gulf Stream, Florida
33483, and may be reviewed during regular business hours, which
generally include non -holiday weekdays from 9:00 A.M. to 4:00 P.M.
ALL PARTIES INTERESTED IN THESE MATTERS may appear before the
Architectural Review and Planning Board and the Town Commission of
the Town of Gulf Stream at the times and place aforesaid and be
heard.
SHOULD ANY INTERESTED PARTY SEEK TO APPEAL ANY DECISION MADE BY
THE ARCHITECTURAL REVIEW AND PLANNING BOARD OR THE TOWN COMMISSION
WITH RESPECT TO ANY MATTER CONSIDERED AT THESE PUBLIC HEARINGS,

This is to confirm that at the Public Hearing held by the Town
Commission on October 9, 2015, your application for a Level 3
Architectural/Site Plan Review to permit construction of a 5,565
square foot, 2 story, single family Georgian style dwelling with
attached 2 car garage and a swimming pool at 3180 Polo Drive was
considered.
The application was approved conditioned upon the following: 1)
Prior to the issuance of a certificate of occupancy, the owner of
the property shall prepare and record a deed restriction which shall
provide that all roof projection areas shall remain unenclosed as per
approval of the special exception for as long as the structure is in
existence or exceeds the maximum FAR. 2) The electric service lines

This approval shall expire on October 9, 2016 if a Building Permit
Application, including the aforementioned improvements, has not

The following are requirements to be complied with:
1. Payment to or for the account of the grantors or mortgagors of the full consideration for the estate or
interest to be insured.
2. Instrument(s) creating the estate or interest to be insured must be properly executed, delivered and

i. Proof that the LLC was in existence in its state of organization at the time it acquired title and

agreement of the LLC and any amendments thereto.
iii. Record an affidavit from the person executing the proposed deed on behalf of the LLC certifying:
(a) the name and state of organization of the LLC; (b) whether the LLC is member -managed or
manager -managed; (c) the identity of the member or manager and the person authorized to
execute the deed; and (d) neither the LLC nor any member signing the deed have filed bankruptcy
since the LLC acquired title.
iv. If the member or manager of the LLC is also a business entity, present proof of the entity's good
standing and the appropriate entity documents to establish signing authority.
If the proposed deed will be executed by anyone other than a member or manager, those portions
of the operating agreement or other documentation evidencing the authority of the signatory must
be attached as an exhibit to the affidavit.

A. Record a notice of termination, together with a contractor's final payment affidavit (with lien
waiver). A separate notice of termination, and contractor's affidavit, is required for each notice of
commencement.
B. Obtain an owner's construction affidavit identifying all parties who gave a notice to owner and all
parties who had a direct contract with the owner.
C. Obtain final waivers/releases from (i) all lienors showing as unpaid in the contractor's final
payment affidavit, and (ii) all those who gave a notice to owner or had a direct contract with the owner
as listed in the owner's construction affidavit.
D. Obtain the Company's indemnity agreement signed by the owner/borrower
NOTE: If the notice(s) of commencement is being terminated prior to completion of the construction or
if the subject transaction exceeds your agency's authorized limits, then approval of a Company State or
Regional Underwriter is required.
6. No open mortgage(s) were found of record. Agent must confirm with the owner that the property is
free and clear.
An Affidavit in form acceptable to Chicago Title Insurance Company ("Company") and executed by or
on behalf of the current record owner(s) of the subject property stating that: (A) there are no parties
in possession of the subject property other than said current record owner(s); (B) there are no
encumbrances upon the subject property other than as may be set forth in this Commitment; (C) there
are no unrecorded assessments which are due and payable and; (D) there have been no improvements
made to or upon the subject property within the last ninety (90) day period for which there remain any

must be furnished to the Company, or, in lieu thereof, an exception to those matters set forth in said
Affidavit which are inconsistent with or deviate from the foregoing requirements will appear In the

S. Issuing agent must obtain from the Company or perform themselves a title update three (3) business
days prior to closing, to verify that no adverse matters or defects appear in the public records.
9. A survey, satisfactory to the Company, must be furnished. If said survey should disclose building
setback lines, easements, encroachments, overlaps, boundary line disputes, or other adverse matters,
they will appear as exceptions in Schedule B of the Owner's Policy and Schedule B, Part 1 of the Loan
Policy to be issued.
10. This is a preliminary commitment that requires the review and approval by the underwriting
department for the company and/or state underwriting counsel. Accordingly, this commitment is not
effective to bind the Company until the necessary approval is obtained from the underwriting
