RESOLUTION NO. 01 -3992
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TEMPLE CITY REVERSING THE DECISION OF THE
PLANNING COMMISSION AND APPROVING CONDITIONAL
USE PERMIT 00 -1440 TO ALLOW THE ESTABLISHMENT OF
A MONTESSORI SCHOOL AT 9677 LONGDEN AVENUE
(RANDALL/LACHTMAN)
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE:
SECTION 1. Based upon information contained in the staff report to the City Council
and information contained in the Planning Commission staff report as well as the Planning
Commission minutes and based upon testimony received at a noticed public hearing before the
Planning Commission on January 23, 2001 and testimony received at a noticed public hearing
before the City Council on February 20, 2001, the City Council approves the Conditional Use
Permit based upon the following:
1. That the site for the proposed use is adequate in size, shape, topography and
circumstances in that the site contains 39,600 square feet of land area and is improved
with existing facilities to accommodate the proposed use; and
2. That the site does have sufficient access to streets and highways, adequate in width
and pavement type, to carry the quantity and quality of traffic generated by the proposed
use in that the site contains vehicular access from Longden Avenue, a collector street;
and
3. That the proposed use will not have an adverse effect upon the use, enjoyment or
valuation of adjacent or neighboring property or upon the public welfare in that the
proposed use is limited in magnitude to no more than 24 pupils at any given time; the
proposed private school is comparable with existing activity at this facility, which is
designated as institutional on the City's General Plan.
SECTION 2. This project is Categorically Exempt from CEQA requirements.
SECTION 3. Accordingly, Conditional use Permit 00 -1440 is approved subject to the
following conditions:
1. The proposed use of the subject property shall be substantially in accordance with the
Plot Plan and Floor Plan.
2. The maximum pupil enrollment shall be limited to 24 students at any given time.
3. The hours of operation shall be limited to between 8:00 a.m. to 5:00 p.m., Monday
through Friday only. No child shall be permitted on the premises or in the designated
play area before 8:00 a.m. or after 5:00 p.m. daily.
4. The delivery and pick up of children shall not be conducted at curbside, but shall occur
within the parking lot area.

5. Staff shall conduct a site inspection and determine where the block wall terminates
along the west property line; if it is determined that additional block wall area is
necessary, it may be scheduled for a Fast -Track Committee review.
6. The existing westerly driveway shall be maintained for entrance only and the easterly
driveway for exit only. Appropriate entrance and exit signs shall be installed.
7. All indoor school facilities shall be continuously maintained with heating and air
conditioning to the satisfaction of the City's Building Inspector.
8. Building permits shall be obtained for all tenant improvements. An occupancy permit
shall be obtained from Building & Safety.
9. Any proposed building modifications, alterations or remodeling shall be subject to the
review and approval of the Building and Community Development Departments.
10. Any new exterior signage shall be subject to the review and approval of the
Community Development Department.
11. This Conditional Use Permit shall expire 24 months from the date of approval. If the
project is not commenced prior to the expiration date, the applicant may apply in writing
for an extension of time at least forty (40) days prior to the expiration date.
12. The conditions of approval contained in this Resolution may be enforced by the
Sheriff's office as well as City Staff. Any violation of any condition is a misdemeanor and
may be processed directly by criminal complaint.

adopted at a regular meeting of the City Council of the City of Temple City held on the 3rd day of
April, 2001. It was duly passed, approved and adopted by said Council, approved and signed by
