HomeMy Public PortalAboutResolution 2017-02-01 APPROVING THE FINAL PLANNED DEVELOPMENT PLAN (FINAL PLAN), AMENDMENT 1 ELK CREEK AT GRAND PARKTOWN OF FRASER RESOLUTION NO. 2017-02'01 A RESOLUTION APPROVING THE FINAL PLANNED DEVELOPMENT PLAN (FINAL PLAN), AMENDMENT 1 ELK CREEK AT GRAND PARK, PLANNING AREA 5W, 4W.1A, 4W.2A, AND A PORTION OF 23W AND THE FINAL PLATS ELK CREEK -AT GRAND PARK FILINGS NO. 3 AND NO. 4 At the special meeting of the Fraser Planning Commission held on January 11, 2017, Grand Park Development LLC requested a recommendation of approval for a Final Plan, Amendment 1 Elk Creek at Grand Park and Final Plats Elk Creek at Grand Park Filings No. 3 and Filings No. 4; and WHEREAS, Grand Park Development LLC is the current owner of Planning Area 5W, 4W.1A, 4W.2A and a portion of 23W; and WHEREAS, Staff has determined that this application; is in compliance with the subdivision and zoning regulations of the Town of Fraser; and I WHEREAS, the Fraser Planning Commission approved Planning Commission Resolution 2017-01-01 recommending approval of the Final Plan Amendment 1 and the Final Plats Elk Creek at Grand Park Filing No. 3 and Filing No. 4. NOW THEREFORE BE IT RESOLVED BY THE BOARD OF ;TRUSTEES OF THE TOWN OF FRASER, COLORADO THAT: The Town Board of Fraser, Colorado hereby approves the Final Plan Amendment 1 Elk Creek at Grand Park, Planning Area 5W, 4W.1A, 4W.2A, and a portion of 23W and the Final Plats Elk Creek at Grand Park Filings No. 3 and No. 4 with the following conditions: 1. All engineering documents to be approved by Town Engineer. 2. All legal documents (including SIA and HOA documents) to be approved by Town Attorney prior to recordation of each Final Plat. The SIA required improvements and collateral associated with those improvements shall be subject to Town Engineer and Town Attorney approval prior to execution and the schedule for completion of said improvements shall be within one (1) year of execution of the SIA. 3. Payment of all applicable fees 4. The Final Plats for Filing No. 3 and Filing No. 4 shall be executed and recorded within five (5) years from January 20, 2016 or they shall expire unless an extension is approved by the Board of Trustee's. 5. Provide updated title commitment and 911 Mylars and electronic copy of the plats in accordance with the Subdivision Regulations. 6. The Board of Trustees authorizes the Town Manager and Town Attorney to negotiate the final terms of the conservation easement and to authorize appropriate Town officials to accept and execute such easement upon approval of the terms thereof by the Town Manager and; Town Attorney. 7. Elk Ranch Road shall be improved from CR72 through Filing No.1 as a twenty- four foot (24') wide all-weather surface (CDOT!Class 6 road base) access road constructed to the lines, grades and vehicle weight loading requirements of the Town of Fraser Design and Construction Standards -for a Local Street. This roadway improvement shall be included in the SIA for Filing No.3. At the completion of Filing No. 4 the all-weather surface access road shall be I paved in accordance with Town of Fraser Standards and said improvements shall be included in the SIA for Filing No. 4. Until such time as the access road is paved, it shall be maintained by the HOA or Developer for year-round public access. This does not satisfy the PDD requirement to connect County Road 72 and Old Victory Road unless'a trail/sidewalk connection from County Road 72 to Old Victory Road is provided. 8. The Town is not requiring formal identification of an easement for the Elk Creek Ditch No. 2, at this time. However, by virtue of its ownership of decreed Elk Creek Ditch No. 2 water rights, the Town owns, and claims, all rights-of-way and easements associated with, or used for, the historical delivery of the water associated with these water rights. 9. The Town Board is committed to working with Grand Park to negotiate potential restrictions and initiatives for the attainable housing lots 63-69 Elk Creek at Grand Park Filing, No. 3. 10. Sheets 18, 19 and 20 of the previously approved Construction Plans must be revised to correctly depict the amended lot locations, the revised water service line tap locations and the revised sanitary sewer service line tap locations. These three sheets shall be prepared, sealed and signed by the Engineer of Record and then submitted to Fraser as a construction plan addendum for review and approval prior to construction. PENDING FRASER APPROVAL. 11. Revise the Side Setback language on plat note413 on the Final Plats to state the following: Side setback: 5 feet (Minimum distance between structures is 10 feet unless fire-resistant construction is utilized). Side setbacks on lots adjacent to dedicated open space tracts may be reduced to 3 feet and fire- resistant construction is not needed. 12. Grand Park Development, LLC., will provide a�trail easement to Fraser for a trail/sidewalk connection along Elk Ranch Road, or a comparable and possibly more direct alignment, once this improvement'is constructed and prior to release of surety associated with the final Subdivision Improvement Agreement (SIA) for Elk Creek at Grand Park subdivision. This condition is required in order to satisfy the PDD requirement for a connection between CR72 and Old Victory Road (See Resolution 2016-01-02). If such conditions are not satisfied, the approval provided by this resolution is no longer valid. DULY MOVED, SECONDED AND ADOPTED THIS 1st DAY,OF FEBRUARY, 2017.
