SUBJECT: Minor Subdivision —Amended Final Plat and Amended As-Built Plat
MATTER BEFORE BOARD:
We are in receipt of a Minor Subdivision — Amended Final Plat for Lots 3 & 4 Workshire
Acres, Reception # 200006937 and Amended As-built plat for Byers Peek Townhomes
of Fraser Building 3, Reception #2003001453 Town of Fraser, Grand County.
ACTION REQUESTED/EXECUTIVE SUMMARY:
Motion to approve Resolution 2017-01-01, approving the Minor Subdivision - Amended
Final Plat for Lots 3 & 4 Workshire Acres, Reception # 200006937 and Amended As-
built plat for Byers Peek Townhomes of Fraser Building 3, Reception #2003001453
Town of Fraser, Grand County.
BACKGROUND:
For background information, you will need to review some of the other documents in the
packet. See Amended Final Plat Reception # 200006937. This is a plat of Lots 1, 2 and
3 Block 3 Workshire Acres. Subsequently, Lot 3 was re-subdivided in 2003 into a four-
unit townhome structure. See As-Built Plat Reception # 2003004153. The current
owners of lot 4, Matthew & Brianna Priebe, are working with the Byers Peek at Fraser
Building 3 Homeowners Association to purchase a strip of property 19' wide and 103.34'
long in order to add more land to the existing Lot 4. The proposed plat would vacate the
existing north/south lot line of Lot 4 and move the new lot line to the east by 19'. The
owners of Lot 4 were interested in purchasing the other 15.82'; however, that would
leave Lot 3 without the required 55% open space per the subdivision regulations.

This application is being processed as a minor subdivision in accordance with Section
17-4-10 of the Fraser Municipal Code. The purpose and scope of a minor subdivision is
that the resulting subdivision will create a total of not more than four (4) lots or four (4)
dwelling units and no new streets need to be constructed and municipal utilities exist
immediately adjacent to the parcel and do not need to be extended to serve the
subdivision.
The Planning Commission held a public hearing on this matter at their November 9,
2016 special meeting and recommended approval with conditions. All outstanding
issues have been resolved.
RECOMMENDATION:
Staff recommends approval of this Minor Subdivision Amended Final Plat and Amended
As-Built Plat with conditions. See Resolution 2017-01-01.

A RESOLUTION APPROVING THE MINOR SUBDIVISION, AMENDED FINAL PLAT FOR
LOTS 3 & 4 WORKSHIRE ACRES, RECEPTION # 200006937 AND AMENDED AS-BUILT
PLAT FOR BYERS PEEK TOWNHOMES OF FRASER BUILDING 3, RECEPTION
2003001453 TOWN OF FRASER, GRAND COUNTY.
WHEREAS, at a special meeting of the Fraser Planning Commission held on November
9th, 2016, Byers Peek at Fraser Building 3 Homeowners Association and Matthew and Bianna
Priebe requested a recommendation of approval for a Minor Subdivision, Amended Final Plat
for Lots 3 & 4 Workshire Acres, Reception # 200006937 and Amended As-Built Plat for Byers
Peek Townhomes of Fraser Building 3, Reception #2003001453 Town of Fraser; and
WHEREAS, Byers Peek at Fraser Building 3 Homeowners Association are the owners of
Lot 3 and Matthew and Bianna Priebe are the owners of Lot 4 Workshire Acres; and
WHEREAS, the owners are requesting approval of a Minor Subdivision Amended Final
Plat and Amended As-Built Plat in order to move the lot line between existing Lot 3 and 4 over
19' to the east to increase the size of Lot 4; and
WHEREAS, Staff has determined that this application is in compliance with the
subdivision regulations of the Town of Fraser; and
WHEREAS, the Planning Commission recommended approval via Resolution 2016-11-
01.
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF
FRASER, COLORADO THAT:
The Town Board of Fraser, Colorado hereby approves the Minor Subdivision, Amended Final
Plat for Lots 3 & 4 Workshire Acres, Reception # 200006937 and Amended As-Built Plat for
Byers Peek Townhomes of Fraser Building 3, Reception #2003001453 Town of Fraser with the
following conditions:
1.Payment of all applicable fees
2.Execution of all documents within 90 days of the adoption of this Resolution.
3.Provide 911 mylar and electronic copy of the plat in accordance with the
Subdivision Regulations.
If such conditions are not satisfied, the approval provided by this resolution is no longer valid.
DULY MOVED, SECONDED AND ADOPTED THIS 4th DAY OF January, 2017.

A RESOLUTION RECOMMENDING APPROVAL OF THE AMENDED FINAL PLAT
FOR LOTS 3 & 4 BLOCK 3 WORKSHIRE ACRES, RECEPTION # 200006937 AND
AMENDED AS-BUILT PLAT FOR BYERS PEEK TOWNHOMES OF FRASER
BUILDING 3, RECEPTION #2003001453 TOWN OF FRASER. GRAND COUNTY,
COLORADO.
WHEREAS, Byers Peek at Fraser Building 3 Homeowners Association are the owners of
Lot 3 Workshire Acres and Matthew and Brianna Priebe are the owners of Lot 4 Workshire
Acres; and
WHEREAS, the owners of Lot 4 are requesting this recommendation of approval in order
to shift the lot line between existing Lots 3 and 4 over 19' to the east to increase the size of Lot
4;
NOW THEREFORE BE IT RESOLVED that the Fraser Planning Commission has voted
to recommend approval of this plat with the following conditions:
1. Change the name of the plat to the following:
Amended Final Plat for Lots 3 & 4 Block 3 Workshire Acres, Reception # 200006937
AND Amended As-Built Plat for Byers Peek Townhomes of Fraser Building 3,Reception
2003001453
2. The dedication needs to reference Lots 3 and 4 instead of Lots 2 and 3.
3. Delete Planning Commission Certification.
4. Change ownership of Lot 4 to include Brianna Priebe.
5. Delete ownership information on Lots 1 and 2.
6. Provide a warranty deed and legal description for the part of Lot 3 to be transferred
to Lot 4 and record in conjunction with this plat.
APPROVED AND ADOPTED THIS 9th DAY OF November, 2016.
