VACATING A PORTION OF EAST ELM STREE
BOROUGH OF CARTERET
THEREFORE, BE IT ORDAINED, by the Mayor and Coun il of ~e Borough of
Carteret, as follows:
That parts of the street and tracts ofland situated in t e Boíugh of
Carteret, County of Middlesex, and State of New J Isey, od known as a
portion of East Elm Street, as depicted on Sche ule and as more
particularly described in the Schedule B, aJl to be att ched od made a part
of this Ordinance upon its adoption, and which is a ailabl¡ for inspection
at the Carteret Borough Clerk's Office located 61 ooke Avenue,
Carteret, New Jersey, between the hours of 8:3 a.m. to 4:00 p.m.,
Monday through Friday, be and the same arc hereby vacate and all public
rights therein extinguished, subject, however, to th~ reservations
hereinafter set forth.
The Borough of Carteret. for itself, its successors and adsigns, reserves
unto itself the right to construct, install, build, 0 erate,l maintain, use,
repair, replace and relocate such public utilities and c~ble television
facilities, within the described premises, which 't ma , at any time
hereafter, deem necessary for the public health, sa ety, c nvenience and
welfare, and the Borough of Carteret further reserv s unto itself the right
to use, maintain, repair, replace and relocate all exis ing ut" ities and cable
television facilities o\vned or controlled by it locate in, a 'acent to, upon
or through said land, and further reserves unto its If an asement over,
under, through and across the portion of the land de cribe herein as may
be necessary or expedient for the purpose of n aintai 'ng, replacing,
relocating, installing, leveling, constructing and epam g its utilities,
mains and appurtenances, if any, wherever there exists such utilities,
mains and/or pipeline(s) and appurtenances thereto eneat the surface of
the aforesaid described land. The Borough further xpress y reserves and
excepts from vacation all rights and privileges now osses ed by any and
all public utilities, as defined in RS. 48:2-13, and b any table television
company, as defined in the "Cable Television At," P. .1972, c. 186
(C.48:5A-l et seq.), to maintain, repair and replace heir e isting [acilities
in, adjacent to, over or under the aforesaid land. All fthe foresaid rights
shaH be unaffected by this ordinance. I

The Borough Clerk is hereby directed to file w' hin 6~ days of this
Ordinance becoming effective a certified copy of the same In the
Middlesex County Clerks Office. ¡
All Ordinances or parts thereof inconsistent with the rovisiLn of
this Ordinance are hereby repealed limited to the ext nt of ¡y
such inconsistency.
