Mayor Gilbertson called the regular meeting of- the City Council to order at 7:37 p.m. on Tuesday, July _ 1, `975, in _the Council Chamber of the City Hall. 2. The invocation was given by Reverend Mortimer C.- Dean, First United Methodist Church, 5957 N. Golden West Avenue. 3. The Pledge of Allegiance to the Flag was led by Mayor Gilbertson. 4. ROLL CALL: 1 1 Present: Councilmen- Dennis, Greenberg, Merritt, Gilbertson Absent: Councilmen - Tyrell Also Present: City Manager Koski, City Attorney Martin, Assistant City Manager Biel, Planning Director Dragicevich, Parks and Recreation Director Kobett. Councilman Merritt moved to excuse Councilman Tyrell for cause, seconded by Councilman Greenberg and carried. 5. APPROVAL OF MINUTES: Councilman Dennis directed attention to an error on page 7, Item 11, which states he made the motion and the second, which should be corrected to show Councilman Merritt made the motion, seconded by Councilman Dennis. Councilman Merritt moved to approve the minutes of the regular meeting of the City Council held Tuesday, June 17, 1975, as corrected, seconded by Councilman Greenberg and carried. UNFINISHED BUSINESS: 6. PUBLIC HEARING: 7:30 p.m. CODIFICATION OF MUNICIPAL CODE City Attorney Martin advised this would be the first of two hearings; the second to be held when the codification of the Zoning Code has been completed, the purpose of the public hearing to determine whether there are any objections to the codification and contents placed in the documents. Mayor Gilbertson declared the public hearing open. City Manager: Koski advised the first of the two documents is available in the City Cierk's office for review; that the City Attorney has put the ordinances adopted by the City since incorporation into a concise, indexed Muni- cipal Code, no basic changes having been made. There being no one come forward to speak to the subject, Councilman Dennis moved to close public hearing, seconded by Councilman Merritt and carried. Councilman Dennis moved to continue until the second portion, the Zoning Code and Subdivision section, is completed and public hearing held, to take action to accept the recodification, seconded by Councilman Greenberg and carried. PUBLIC HEARING: 7:30 p.m. AMENDMENT TO MUNICIPAL CODE RE: SIGN ORDINANCE (Pursuant to Planning Commission Resolution No. 75- 360PC) City Manager Koski presented background information, stating this matter was brought to the attention of the Planning Commission by the Chamber of Commerce; study session was held with the Planning Commission and the Chamber of Commerce to receive their input; the Planning Com- mission, at their regular meeting of May 29, 1975, held public hearing and adopted Resolution No. 75 -630PC recommending to the City Council an amendment to the Sign Ordinance revising the definition of window signs and limits temporary signs to a period not to exceed 30 days instead of 7 consecutive days as it is presently written. City Council, at their regular meeting. of June 3, 1975, set public hearing for this evening. Mayor Gilbertson declared the public hearing open. Councilman Green- berg moved to include the minutes of the Planning Commission as a part of the hearing, seconded by Councilman Dennis and carried. Planning Director Dragicevich explained the amendment basically is to conform with reasonable practice, most businesses having temporary signs for not more than 30 days. Mrs. Oliver Grant, 5434 N. El Monte Avenue, inquired whether this amendment included signs posted on trees and poles throughout the City, and was advised this amendment was for signs in the commercial and industrial zones; however the signs she is referring to are not allowed and the City's zoning enforcement officer conducts a weekly enforcement program to eliminate the problem. There being no other persons come forward to speak, Councilman Green- berg moved to close the public hearing, sec onded by Councilman Merritt and carried. City Attorney Martin introduced Ordinance No. 75 -407 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 9326 AND 9321 OF THE TEMPLE CITY MUNICIPAL CODE. RELATING TO COMMERCIAL AND INDUSTRIAL SIGNS by title only. Councilman Merritt moved to certify the negative declaration pursuant to the Environmental Quality Act of 1970 and waive further reading of Ordinance No. 75 -407, seconded by Councilman Dennis and carried. 8. PUBLIC HEARING: 7:30 p.m. AMENDMENT TO MUNICIPAL CODE RE: MOTORCYCLE SALES AND SERVICE UNDER CONDITIONAL USE PERMIT CATEGORY (Pursuant to Planning Commission Resolution No. 75- 361PC) City Manager Koski presented background information, stating as a result of a number of complaints made by residents regarding noise and traffic problems generated by the operation of a motorcycle shop, the Planning Commission felt this use should be more stringently regulated. Planning Commission held public hearing May 29, 1975, and adopted Resolution No. 75 -631PC recommending to City Council amendment to the Municipal'Code to place the subject use under the conditional use permit category. City Council, at their regular meeting held June 3, 1975, set public hearing for this evening. Mayor Gilbertson declared the public hearing open. Councilman Dennis moved to include the minutes of the Planning Commission as a part of the public hearing, seconded by Councilman Merritt and carried. There being no one come forward to speak to the subject, Councilman Merritt moved to close the public hearing, seconded by Councilman Greenberg and carried. Council Minutes, July 1, 1975 - Page 3 City Attorney Martin introduced Ordinance No. 75 -408 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 9202 AND 9390 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO CONDI- TIONAL USES by title only. PUBLIC HEARING: 7:30 p.m. VACATION OF A PORTION OF WEDGEWOOD AVENUE WESTERLY OF ROSEMEAD BOULEVARD 1 City Manager Koski presented background information, stating the City Council, at their regular'meeting held June 3, 1975, at the request of the Community Redevelopment Agency, adopted Resolution No. 75 -1461 declaring the City Council's intent to vacate a portion of Wedgewood Street; notices were published and posted pursuant to the Streets and Highways Code. An easement is to be reserved for ingress and egress to the Sheriff's Department sewer utilities, and on a temporary basis for the Flood Control District; the vacation is necessary in order to provide clear title to the building pad area when the developer takes possession of the property. Mayor Gilbertson declared the public hearing open. There being no one come forward to speak to the subject, Councilman Dennis moved to close public hearing, seconded by Councilman Merritt and carried. Councilman Greenberg moved to certify the Council read and reviewed the Environmental Impact Report as approved by the Comuaunity Redevelop- ment Agency on March 28, 1974 and they find no significant change to require supplement thereto or new report and they considered same in arriving at their decisions, seconded by Councilman Merritt and carried. Councilman Dennis moved to continue the adoption of Resolution No. 75 -1469 pending approval of Tentative Tract No. 32581, seconded by Councilman Greenberg and carried. 10. ORDINANCE NO. 75 -404: 2nd read. ZONE CHANGE FROM R -3 TO C -2 IN ZONE CHANGE CASE 75 -441, Robert C. Stiegelmar - 9023 E. Broadway City Attorney Martin presented Ordinance No. 75 -404 AN ORDINANCE OF THE CITY OF TEMPLE CITY PROVIDING A CHANGE OF ZONE IN ZONE CHANGE CASE NO. 75 -441, for second reading by title only, Councilman Green- berg moved to waive further reading and adopt, seconded by Councilman Merritt and carried. 11. ORDINANCE NO. 75 -405: 2nd read. ZONE CHANGE FROM R -3 TO C -2 IN ZONE CHANGE CASE 75 -447 - Temple City Couununity Redevelopment Agency 8836 to 8929 E. Live Oak, north and south sides 8951 to 8929 E. Wedgewood, north side 8846 to 8910 E. Wedgewood, south side City Attorney Martin presented Ordinance No. 75 -405 AN ORDINANCE OF THE CITY OF TEMPLE CITY:. PROVIDING A CHANGE OF ZONE IN ONE ZONE CHANGE CASE NO. 75 -447 AND AMENDING THE ZONE MAP ACCORDINGLY, for second reading by title only. Councilman Merritt moved to waive further reading and adopt, seconded by Councilman Dennis and carried. 12 RESOLUTION NO, 75 -1467: GRANTING A CONDITIONAL USE PERMIT IN CONDI- TIONAL USE PERMIT CASE NO, 75 -440 - Las Tunas, Rosemead, Broadway, Eaton Wash City Attorney Martin presented Resolution No. 75 -1467 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY GRANTING A CONDITIONAL USE PERMIT IN ONE CONDITIONAL USE PERMIT CASE NO, 75 -440 by title only. Councilman Greenberg moved to adopt Resolution No. 75 -1467, seconded by Councilman Dennis and carried, INEW BUSINESS: 14. RECOMMENDATION FROM PARKS AND RECREATION COMMISSION - Meeting of June 18, 1975 POLICY ON COSPONSORSHIP Council Minutes, July 1, 1975 - Page 4 13. RESOLUTION NO. 75 -1468: GRANTING A VARIANCE IN VARIANCE CASE NO, 75 -444 - Las Tunas, Rosemead, Broadway, Eaton Wash City Attorney Martin presented Resolution No. 75 -1468 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY GRANTING A VARIANCE IN VARIANCE CASE NO. 75 -444 by title only. Councilman Merritt moved to adopt Resolution No. 75 -1468, seconded by Councilman Greenberg and carried. 1 1 City Manager Koski presented background information, stating the City Council, at their regular meeting held June 3, 1975, reviewed the recommendation from the Parks and Recreation Commission that an addi- tional requirement be added to the existing policy on cosponsorship requiring that any group cosponsored by the City must furnish a certificate of insurance naming the City of Temple City additionally insured. City Council, at that time, referred the matter back to the Parks and Recreation Commission for further study, and revoked co- sponsorship of any activity not conducted within the confines of any facility owned and operated by the City of Temple City. The Parks and Recreation Commission, at their regular meeting held June 18, 1975, recommended to City Council the City' :s present policy on cosponsorship be continued with the addition of an insurance requirement of $100,000/$300,000 bodily injury liability and $25,000 property damage liability naming the City additionally insured. Additional information is available from the Recreation Department, however, and City Manager Koski recommended Council continue the matter to their next regular meeting to give them the opportunity to study the additional report. Councilman Merritt moved to continue consideration of Policy on Co- sponsorship to the regular meeting to be held July 15, 1975, seconded by Councilman Greenberg and carried. 15. RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of June 24, 1975 A. SET PUBLIC HEARING: TENTATIVE TRACT NO. 32581 - Las Tunas, Rosemead, Eaton Wash, Broadway City Manager Koski presented background information advising the Planning Commission, at their regular meeting held June 24, 1975, held public hearing on Tentative Tract No. 32581 relating to the Community Shopping Center development on Parcel B, and adopted Resolution No. 75 -635PC recommending approval of said tract with conditions. Councilman Dennis moved to set public hearing August 5, 1975, seconded by Councilman Greenberg and carried. B. SET PUBLIC HEARING: SCENIC HIGHWAY ELEMENT OF THE GENERAL PLAN City Manager Koski advised the Planning Commission held public hearing on the Scenic Highway Element on June 24, 1975, and adopted Resolution No, 75 -636PC recommending an amendment to the General Plan relating to this Element. Section 65302(h) of the Government Plan requites that each city prepare and adopt a Scenic Highways Element as a part of its General Plan, deadline for this Element is September 20, 1975. Councilman Dennis moved to set public hearing August 5, 1975, seconded by Councilman Greenberg and carried, Council Minutes, July 1, 1975 - Page 5 C. SET PUBLIC HEARING: CHANGE OF ZONE FROM R -1 TO 0 -S (OPEN SPACE) IN ZONE CHANGE CASE NO, 75 -450 - City of Temple City, 10203 to 10227 Daines Drive City Manager Koski advised the. Planning Commission, at their regular meeting held June 24, 1975, held public hearing and adopted Resolution No. 75 -634PC recommending a change of zone from R -1 to 0 -S for the area outlined above. Councilman Dennis moved to set public hearing August 5, 1975, seconded by Councilman Greenberg and carried. 16. RENEWAL OF AGREEMENTS: 1 A. PUBLIC RELATIONS COORDINATOR City Manager Koski advised that City Council, in adopting the 1975 -76 budget authorized expenditure of the funds reflected in the agreement for services of Public Relations Coordinator for the City, providing a total payment of $4,800. for a period of one year for specified services on a twenty -four hours per month basis, including the preparation of the City Newsletter. Councilman Greenberg moved to approve agreement and authorize the Mayor and City Clerk to sign, seconded by Councilman Merritt and carried. B. TEMPLE CITY CHAMBER OF COMMERCE City Manager Koski advised the City received letter from the Chamber of Commerce requesting renewal of their agreement for the period July 1, 1975 to June 30, 1976; the City Council provided funding in the amount of $18,000 in the 1975 -76 budget. Councilman Dennis moved to approve agreement and authorize the Mayor and City Clerk to sign, seconded by Councilman Greenberg and carried. 17, RESOLUTION NO. 75 -1470: EMPLOYMENT OF PERSONNEL Councilman Dennis moved to adopt Resolution No. 75 -1470 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL, seconded by Councilman Merritt and carried. 18. RESOLUTION NO. 75- 1471: WARRANTS & DEMANDS, Demand Nos. 2306 thru 2388 in the amount of $51,326.30. Councilman Merritt moved to adopt Resolution No. 75 -1471 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND 1 DEMANDS IN THE SUM OF $51,326.30, DEMAND NOS. 2306 THRU 2388, seconded by Councilman Dennis and carried, Councilman Greenberg abstaining. 19. COMMUNICATIONS: There were no communications.. III0. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: 'Mr. Boyce O'Bannon, 10316 Olive Street, gave a progress report of the activities of the organization Concerned Taxpayer's of San Gabriel Valley. They have a membership of 1500; have written and asked County Tax Assessor Watson for a moratorium of reassessment and he has personally discussed the matter with the Assessor. He feels that an injunction could be brought against the tax assessor to stop reassessments. Mr. O'Bannon extended his appreciation to Mayor Gilbertson for the proclamation issued. Mayor Gilbertson commended Mr. O'Bannon for his excellent presentation before Supervisor Schabarum in El Monte and the work of the organization on behalf of the citizens, and felt that some progress had been made insofar as the tax rate is concerned. Mayor Gilbertson stated he Council Minutes, July 1, 1975 - Page 6 depended on the City Attorney for legal advice, and it is his under- standing that an injunction could not be brought until reassessments are out. The Mayor referred to the meeting held June 26, 1975 in- volving Mayors and City Councilmen throughout the valley, when a steering couunittee was formed to study the formation of a San Gabriel Valley Cities Association, and possibly secession from Los Angeles County. Mr. Iry Hoffman, 6349 Golden West Avenue, advised Council that yesterday e and his neighbor, Mrs. Funk at 6355 Golden West Avenue were advised of the City's intention to construct sidewalks in front of their residences, which he understands is to begin July 7, 1975. He stated they are opposed to the sidewalks which would take 10' of frontage from his property; that they would be happy to compromise with stepping stones to allow the public an area on which to walk. Mayor Gilbertson advised Mr. Hoffman of the Council's concern with getting children off the street, that Golden West Avenue has a high volume of traffic, Golden West Avenue is a select system and the sidewalks would be paid for entirely by the City. Councilman Greenberg expressed his concern for the safety of children, also, and requested some modification of the plans. Following brief discussion regarding the placement of the sidewalk and modification of the plans and specifications, Councilman Green- berg moved to place the 5' sidewalk next to the curb, seconded by Councilman Dennis and carried, Mrs, Oliver Grant, 5434 No El Monte, spoke on several subjects, in- cluding classification of skateboards, suggesting that outside lanes of El Monte Avenue be set aside for children to skateboard exclusively, and complaints on the use of illegal firecrackers., Councilman Tyrell arrived at 8:57 p.m. Harlos Gross, President, Temple City Chamber of Commerce, expressed his appreciation on behalf of the Chamber for Council's approval of their agreement and stated he looked forward to working with the City Council in the coming year. Mr. Gross also introduced his Vice- President, Bob Owens and 2nd Vice- President, Bob Grange. Fire Chief Nino Polito, stated that it is his hope that one day all fireworks will be banned and that they will be displayed, for the public at various parks. RECESS TO CRA: The City Council recessed at 8:59 p.m. to meet as the Community Redevelop- ment Agency, all members being present, approved the minutes of the regular meeting held June 17, 1975, adopted resolution approving warrants and demands, set public hearing for proposed sale and off -site relocation of structures, approved agreement for legal services, and approved proposal for preparation and analysis of traffic control devices on Rosemead Boulevard. The minutes are set forth in full in the minutes of the Agency. ECONVENE AS CITY COUNCIL: 10 ACTION ON REQUESTS BY CRA: A. Request of Funds Councilman Merritt moved to approve an advance of additional funds in the amount of $11,583.26 as a loan to the Community Redevelopment Agency and amend the agreement with the Agency accordingly, seconded by Councilman Greenberg and carried, Council Minutes, July 1, 1975 - Page 7 "22, MATTERS FROM CITY OFFICIALS: A. CETA - SUMMER YOUTH EMPLOYMENT PROGRAM City Manager Koski presented background information, stating Alhambra City Schools have been funded by the County of Los Angeles to act as prime agent to provide summer youth employment to residents of Temple City; twenty positions at $2.10 per hour, 25 hours per week, for approximately 9 weeks, have been designated for Temple City residents, Administration would be the responsibility of the Alhambra City Schools, the only responsibility of the City would be in providing the positions and supplying adequate supervision. Staff has identified 9 recreation and maintenance helper positions that could be utilized as well as one clerical position for the Chamber of CoInmerce. Councilman Tyrell moved to authorize the City's participation in Summer Youth Employment Program, seconded by Councilman Dennis and carried. B. City Attorney Martin presented Ordinance No, 75 -406 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 9391(B)" and 9401 (B) OF THE TEMPLE CITY ZONING CODE RELATING TO MINIMUM LOT WIDTHS IN THE COMMERCIAL ZONES AND DECLARING THE URGENCY THEREOF AND THAT THIS ORDINANCE SHALL TAKE IMMEDIATE EFFECT by title only. Councilman Tyrell moved to adopt, seconded by Councilman Greenberg and carried on a roll call vote: ROLL CALL: AYES: Councilmen- Dennis, Greenberg, Merritt, Tyrell, Gilbertson NOES: Councilmen -None C, City Manager Koski presented letter of resignation from Traffic Commissioner Kenneth Eastman. Councilman Merritt moved to accept, with regrets, seconded by Councilman Tyrell and carried. D. Councilman Merritt advised he had heard that Cardinal Manning spoke at a Peace Officer's luncheon last week and stated that govern- ment can pass all the laws on drugs and gun control, but until the citizen feels the responsibility in their hearts, there is not too much that can be done. 23, ADJOURNMENT: On motion by Councilman Tyrell, seconded by Councilman Dennis and carried, City Council adjourned at 9:17 p.m. Next regular meeting of the City Council will be held Tuesday, July 15, 1975, 7:30 p.m. in the Council Chamber of the City Halle ATTEST: )(/41Lec.- Z-f&', __,L,2__ Chie Deputy City Clerk
