OCATOBER 23, 2023, CITY COUNCIL MEETING, AGENDA ITEM #5STANFORD UNIVERSITY MEDICAL CENTER DEVELOPMENT AGREEMENT I urge you to direct staff to return this agenda item to youwith a recommendation from the City Manager instead of arecommendation from a Department Director, and to supplementthe percentages shown with the actual numbers for each categoryreported. In the City of Palo Alto's Council-Manager system of localgovernment it is the City Manager who makes recommendations tothe City Council. As in all previous years, items on the CityCouncil agenda should be from one of the Council AppointedOfficers, or in the case of the City Manager, from the CityManager or the Assistant City Manager acting on behalf of theCity Manager. If and when you do consider the proposed agreement forapproval, you should not focus on a failed land developmentstrategy advocated by the Bay Area Council and Silicon ValleyLeadership group that requires lower-income employees to livefurther and further from work so that they have to usetransportation systems they don't want to use. Stanford owns substantial housing in the Sand Hill Roadcorridor that is within walking distance of the StanfordUniversity Medical Center, and Stanford has complete controlover its ability to increase the percentage and distribution ofStanford employees among faculty, senior staff, and other staffin that housing, as well as the distribution of those housingunits among Medical Center employees and other Stanfordemployees. Having more of those employees live within walking distance towork is a better solution for a Development Agreementamendment, than trying to get those employees to travel longdistances to work and changing the traffic monitoring andmitigation timelines. A deal is a deal, it seems, unless Stanford wants to change the rules. The threat of litigation should not be the reason to change this agreement. Looking at the data published in the Weekly, the big problem is that Stanford has not been successful in requiring their employees to forgo their private car usage. Please, the treat of possible litigation should not be the reason for a bad decision. Stanford knew what the agreement was and overtly violated it and should pay the penalty and the fine, both of which are way to modfest in my opinion given theharm that their insatiable need for growth has inflicted on patients and medicalprofessionals. Case in point: As soon as they got a huge grant to expand their Children's Healthfacilities, they IMMEDIATELY evicted all the medical and dental professionalsfrom 700 Welsh Road DURING THE PANDEMIC. There was NO reason for their immediate eviction since Stanford couldn't start construction work for years without plans but did they care about the damage they caused to all of the professionals andtheir patients? Of course not! My dental specialist was one of them and he was forced to camp out in otherdentists' offices so he could treat EMERGENCY patients while letting everyone else -- including me -- go without care until he could find a new office, find constructional professionals in the middle of the pandemic. Stanford showed no respect to the medical professionals who'd had offices at 700 Welsh Rd for DECADES even though some, like my dental specialist, were on the Stanford faculty. My dental specialist -- like all the other medical professionals -- is STILL playing catchup and years later, I'm STILL waiting. Their selfish arrogance is no excuse for knowingly violating their agreements andtheir claim about "no new car trips" has been an absurd joke? lie? for decades. Just say no to any exceptions and raise the penalties for their continued violations. If they wabt to sue, let them. They've certainly had enough well-deserved bad pressrecently so one more incident The two current council members who used to work for Stanford should recuse themselves from this and other decisions regarding Stanford. No maintenance to the customer. No worry about the heat pump wearing out or failing. There is some a little similar in Hibbing Minnesota. The local utility supplies steam to their customers. My friend and neighbor, John Guislin, has been working with Parks and Rec on this issue for years and little progress has been made. There are many of us whosupport his efforts. Hello City Council, In the latest issue of The Economist magazine ( Oct. 14 to Oct.20, page 10), there is an interesting article on energy. They talk about Carbon Pricing and how it is better than using incentives for people to change their ways. Second they suggest that instead of having everyone install their own heat pumps, that the Utility would have neighborhood heat pumps that would supply the energy to the homes. This what is done for large businesses and college campuses now. Instead of each building having it’s own furnace and AC, a central unit would do this job. The way this would be accomplished (if I understand the concept), There would be central heat pumps sprinkled around town that would pump hot and cold liquid to homes and businesses along with return lines. At each customer a meter would measure the liquid temperature and amount of the flow just as in a water meter. Then the customer would be billed just as is done now for water and electricity. William Wood Doug Wooley January 2014 Free Speech vs Hate Speech Practical Guidelines for Managing Public Forums BACKGROUND City Councils and other public agencies at times face very hostile testimony during Public Comments at their open public meetings. These comments can slip into profane, disruptive, and even threatening behaviors, impinging on the civil exchange of ideas and the ability of the public agency to do their regular business. While public input is guaranteed by the Brown Act, and freedom of speech is guaranteed by the U.S. Constitution, presiding officers at these public agencies have attempted to identify and protect the boundary where free speech becomes unduly disruptive, and to safeguard the rights of other residents to participate in the political and civic life free from bigotry and intimidation based on their race, religion, ethnicity, age, gender, sexual orientation, disability or other aspect of their being. OC Human Relations Commission was created in 1971 to eliminate prejudice, intolerance and discrimination and promote mutual understanding among Orange County’s diverse residents. In pursuit of this mission the Commission works with local cities and public agencies to develop strategies that create safe, respectful, inclusive communities. These guidelines are ideas to consider as public agencies attempt to balance the sometimes competing interests of Freedom of Speech, Disruption of a Meeting, and Hate Speech. This draft was prepared in consultations with city managers, police chiefs, elected officials, civil libertarians, and hate crime advocates. The Commission believes that civic leaders have a key role in establishing a community’s climate of respect for all people. Further that when leaders speak out to condemn hate and bigotry when it occurs, it helps set a standard of conduct that can deter hate and bigotry from taking root and growing. Definitions Free Speech: The political right guaranteed by the First Amendment to the U.S. Constitution to express your opinion orally, in written form, through the internet, or through art forms, with a few exceptions including: libel, slander, obscenity, copyright violation, sedition, inciting violence, fighting words, imminent threats. Hate Speech: Legally protected speech that vilifies an individual or group based on their perceived race, religion, sexual orientation, ethnicity, gender, disability etc., but does not rise to the level of a criminal threat or inciting violence, in which case it would be termed a hate crime. MISSION: Seek out the causes of tension and conflict, discrimination and intolerance, and eliminate those causes. Adopt a Code of Conduct: post them so they are visible to all attendees, attach to the speaker request forms, and post them on the podium where a speaker may place their notes. A Code of Conduct as it pertains to what a person says, should be thought of as “guidelines” that you promote not necessarily “enforce”, including: a. No profanity or obscenity. b. Refrain from personal threats or attacks. c. Respect all people. d. Refraining from hateful epithets and demeaning language based on hate of a person’s race, religion, sexual orientation, ethnicity, gender, or disability. e. No yelling or screaming. (This one you can enforce) f. Respect all people that are present or watching. g. Obey the direction of the Presiding Officer as to when and how long they can speak. (This one you enforce). 2. Understand the difference between offensive speech and ACTUAL disruption of a meeting. a. During public comments individuals have a right to say whatever they wish, as long as it does not disrupt the meeting. So they can swear, use hate epithets, say horrible things about councilmembers and staff and others etc. So long as it does not disrupt the meeting, these are within their legally protected right to freedom of speech. b. Things that disrupt the meeting are NOT within their rights such as: i. Exceeding their allotted minutes, (usually 3 minutes), ii. Yelling and screaming in a way that upsets the public and council to the point of not being able to continue the meeting, iii. Excessive profanity or slander, iv. Speaking without being recognized by the presiding officer, v. Specific threats that they are capable of following through on, vi. Inciting violence, or “fighting words”, vii. Issues that are not in the subject matter jurisdiction of the body, (this may be difficult to know without listening to the testimony which might seem to start off topic, but then a connection is made. This is a judgment call, but most horrible things are within their rights to say. 3. Manage Hate Speech at Public Meeting: Strategies for managing a hateful speaker while protecting the first amendment right to speak include: a. Stop the meeting to consult with your attorney for advice. If you think that a member of the public is disrupting the meeting by going over these lines, stop the meeting to ask for advice from the City Attorney. This will allow for a cooling off before reacting in the heat of the moment. b. Gavel and/or Mute Microphone: When bigoted epithets, profanity, personal attacks and other odious things are said the presiding officer can gavel to silence and/or mute a speaker’s microphone: i. If the presiding officer gavels a member of the public to silence, or mutes their microphone, they should also, MISSION: Seek out the causes of tension and conflict, discrimination and intolerance, and eliminate those causes. Inform them that their language, bigotry, hate, epithets, profanity, etc. are unwanted, unwelcome, and inappropriate, and that they interfere with the ability of those present to listen or take any of their points seriously… But not restrict or prohibit them from saying these words. 2. Allow other members of the council to use their free speech right to make statements condemning and abhorring the words of the speaker, but they should also reassure the speaker that they have the right to say them anyway, and 3. Inform the speaker that they will be given the full three minutes they are entitled to, in order to say whatever they wish. ii. The important point is that the presiding officer MAY NOT ORDER the person to stop saying whatever he/she is saying, even when it is very offensive. iii. In many cases it may be better to wait out the 3 minutes and then make statements, rather than getting into a back and forth with the problematic speaker. iv. Schedule a Council Members Comments section right after Public Comments to allow all members of the City Council or other public body, to share their perspectives, publically state their objections to the hate and bigotry that might have been aired in the Public Comments section, and return to a more civil, respectful meeting environment. c. Police Warning and Removal from Meeting: Uniformed law enforcement officers can help control this behavior as well as effect removal if the behavior warrants it. Elected officials need to keep in mind that they should not be publically prescriptive in telling police to remove an individual, rather ask for police intervention, seek advice of your attorney, and allow the law enforcement professional to make the judgment call about how to control the situation. They may want to take into consideration such things as the individual’s likely reaction, progressive steps of warnings, audience reaction, minimizing use of force, preventing violence, objective standards of enforcement, definition of “disruption”, etc. Police efforts to establish rapport with diverse communities, especially before they are at the public podium, can help police be positive “influencers” in controlling some potentially challenging members of the public. d. Calling for a Break in the Meeting: If the conduct is not brought within control or additional speakers or audience members continue the disruption, consider calling a break for a few minutes before proceeding. This can cool down anger and give community relations staff (police or otherwise) to talk with the members of the public and establish some respect that can bring more civil behavior upon resumption of the meeting. e. Clearing the Room: If the meeting is willfully interrupted, and you have consulted your attorney for an objective legal opinion of that judgment, and asked police to intervene and effect warnings and ultimately remove an individual, you can also have the room cleared before proceeding. Clearing the room can be done if you find the disruptions to be preventing you from doing the people’s business which is conducting the public meeting. Members of the press, unless involved in the disruption, shall be allowed to remain in the session while the remainder of the agenda items are discussed and acted upon. You may also set rules for readmitting individuals IF you wish. f. Adjourning the Meeting: If the other tactics do not control the disruption, the meeting can be adjourned to a future time when the business of the public body can be continued. I’m curious why the residents are the ones that are required to do the reporting when anyone can drive around town and with authority stopped to talk to the people breaking the law. I’m curious how the homeowners are allowed to have the law broken on their property. If these were guns they would be confiscated and people would be charged. In my opinion they are just silent killers that are ruining our lives physically mentally and emotionally. Another thing I’m confused about is how the Gardners are allowed to have the gas powered leaf blower‘s because they are illegal. How come the enforcement officer cannot just drive around town and see how many people are Breaking the law, destroying our climate, Our supposedly Nice town of Palo Alto, Our peace of mind and any chance at trying to enjoy time outside. I’ve witnessed pushback on the Charleston/Arastradero corridor improvements, the Ross Roadimprovements, the El Camino Real/Cal Ave intersection improvements, and the East Meadow bikewaysimprovements. Most notably, the East Meadow bikeways proposal was cancelled because residents on EastMeadow didn’t want to give up their parking spots in front of their homes on city-owned streets. Bikeway and pedestrian improvements might inconvenience drivers, but is the convenience of drivers the mostimportant factor? I believe the safety of our bikes/pedestrians is paramount. The City of Palo Alto staff can proposeprogressive bike/ped safety improvements, but those plans must be championed by the PTC and the City Council toreach fruition and increase safety. There is no public transportation, there is already strained street use. If you don’t expand parking requirements for developers, where will poeple park? We already see the effect if insufficient parking in other developments, for example, at El Camino and Arastradero, and also on E. Meadow Circle, where blocks of the street are completely taken up by overflow parking from RESIDENTS because there isn’t sufficient parking. It’s a dream to think people will forego a car to live in dense housing in Palo Alto, especially with the dearth of public transit in the city. The height limit will affect the privacy and views from our still mostly 1 and 2 story neighborhood — already the current 3 story townhouses on E. Meadow can be seen from the back yard of houses a block away, and they’re only 3 stories, not 80 feet! And where will all these people go? There are only 2 small parks in this part of Palo Alto — Ramos and Mitchell, and on summer afternoons, they’re both pretty full. Biking in this area is minimal, with limited bike lanes connecting us to the rest of Palo Alto. Bryant is a long way away, Middlefield is extremely dangerous, but is the major artery connecting us to Mountain View and Menlo Park, and it’s terribly unsafe for bicycles along most of it’s lenght. You’re spending a lot fo time arguing about zoning. How about city amenities and services? Will you need a new forestation? Additional polices? A new school? How will these services be paid for and provided? If we get hundreds of new residents without any thoughtful planning, we current residents and the new residents will have a poor quality experience of living in Palo Alto. I read the entire housing plan, and as far as I could tell, it only talked about locations and densities and zoning changes. There was nothing about providing city services and addressing the additional people and traffic that the housing will bring to this part of Palo Alto. Did I miss something? I think they’re thinking by these these messages that if people underestimate and under-value the asset, we the people will let the developers snooker us for the umpteenth time. The developers will buy it cheap, make billions and then give a kickback to the corrupt Weekly. The Weekly that is pro-development. And undermines our ability to self govern. And has flunkies in leadership like Pat Burt, Ed Lauing and Greer Stone (who we were stupid enough to vote for but they really work for the powers that be, point towards power like a magnet pointing towards the North Pole – the North Pole that Ginsberg calls Moloch Moloch Moloch! – excuse the mixed metaphor). It seems leadership, and the pro development press, want to suppress the fact that there have been many vital activities and ad hoc good use at the former high school, which shuddered in 1980, my freshman year at Gunn. I produced more than 150 events at 4000 Middlefield between 1994 and 2001, in the theatre, the multipurpose room or the amphitheater. Here is AFI from summer 1996. We sold 4o7 tickets at six dollars per head. The theatre seats 325 but we had standing room in the throw for another 80 or so. The picture is a little blurry, but that is singer/leader/composer Davey Havok flying through the air, not sitting on the drum kit riser. Many of the bands I used to book at the Cubberley now play the Guild— the Guild is a $35 million privately funded asset. Blink-182 played the auditorium and went on the sell 20 million records; they had 150 fans that Sunday in 1997 and earned me back $900. It was Earth Day. I think leadership or really We The People should assign -that’s the legal word for give away—all 30 acres to the Cubberley Alumni Association and let them figure it out. For example, Ed Fox and Paul Trainer of class of ‘71 who had a reunion with about 50 of their colleagues at Mitchell Park Sunday, but then came to our Mads Tolling show in the bowl. If I was a VC I could raise $50 million for just about anything, just among Cubberley people –and I didn’t even go there. But I played basketball for Hans Delannoy, who has invited me to Zotts with the Mulcahys and Earl Hansen, and also coached Tim Ruff— Brett Baird pointed out that a man I never heard — a former Cougar QB –of also built the Colorado State football stadium. There is a man name Twohy who scored one basket for Cubberley and draws cartoons for the New Yorker. I would trust him with the 30 acres more than Kou Stone Burt et al. Dividing the pie is literally dividing the house. PAUSD and We the People are the same. To pit us against each other is a ploy that benefits the developers. Yes, this is a good place to repeat my line that Don Austin seems like a guy who played Division III football without a helmet and has no idea. There were several hundred former Cubberley students at Gunn with me, many of whom wrote in the yearbook: Once a Cougar, Always a Cougar. Cross that credo with “Crouching Tiger, Hidden Dragon”, and maybe you’ll agree with my plan. These people can bring it! It was a mistake to shutter Cubberley. We wounded these people. They have a chip on their collective shoulders. So they have the capacity to make it whole again. Make us whole again.
