He said he had prepared a Resolution for °the Council's consideration and read RESOLUTION NO. 224 which would signify our intent to remove all references to Chapter 9837, No. 719, Special Acts, Laws of Florida, 1923 from Ordinance No. 158. It was moved by Mr. Taplin, seconded by Mr. Beatty, and on roll call vote Resolution No.224 was unanimously adopted. Mr. Anderson then read his suggested Ordinance covering this same matter and pointed out that the Ordinance would have to be passed at a regular meeting of the Council under our Charter provisions and that it-could be passed as an emergency measure due to the mandamus matter. The Council considered an application for a building permit for a 194 unti apartment building on Lot 14 of the oceanfront district which will replace the Kenilworth Hotel. Mr.. Patteram, the Building Inspector, told the Council that the plans have been checked and all was in order. He said thq owners would, like approval with the condition that they could amend their plans to take advantage of the new height restrictions. It was moved by Mr. Scott,�•seconded by Mr. Brush, and voted that the building permit be granted. ^.4 The Council reviewed the proposals of the Boston Company of the Southeast and Miami Beach First National Bank.for management of the employees pension funds and after discussion it was the opinion of the Council that for the time being the Council handle the investments themselves, Also,, that Mr. Maley should get quotes on the mutual funds we hold and the Council would then consider possible sale. There bong no further business on motion of Mr. Scott, seconded by Mr. Beatty and voted the meeting was adjourned at 5:05 P.M. Mayor -- ATTEST: ° Village Elerk April 11, 1974 April 27, 1974 The Council of Bal Harbour Village met Saturday, April 27, 1974 at 9:30A.M. In the Village Hall, Present: Messrs. Beatty, Brush, Printup, and Scott Absent: Mr. Taplin Also present were Fred W. Maley, Village Manager; Mary T. Wetterer,Village Clerk; and Thomas H. Anderson, Village Attorney. 185 On motion of Mr. Beatty, seconded by Mr. Brush, the minutes of the previous meetings of March 30, 1974 and April I1, 1974 were approved as submitted. Mr. Anderson said an ordinance deleting a section of Ordinance No. 158 with reference to Chapter.9837, Laws of Florida, which had been read at the ,special meeting of the Council on April 11, 1974 would be read again for approval. The Village Clerk then read - ORDINANCE NO. 166 and on motion of Mr. Brush, seconded by Mr. Beatty, on roll call vote was unani- mously passed. ORDINANCE NO. 167 changing the height reference in the Oceanfront District to U.S.E.D. Bay Datum was read by the Village Clerk. It was moved by Mr. Brush, seconded by,Nr. Scott, and unanimously voted on roll call vote that the Ordinance be passed on first reading. Mr. Maley stated that notices concerning Ordinance No. 166 and 167 had been sent by certified mail to all property owners on the oceanfront, copies of which are attached to these minutes. ,Mr. Maley said he had received no written comments on these ordinances and it was noted that Mr. Wassel of the Singapore Hotel was the only owner present and stated that he hadrno objections to either of these ordinances. Mr. Anderson reported that he would file a Petition for Rehearing and Clarification of Judge Gale's Order directing us to issue a building permit for the -proposed apartment on Lot 11 of the Oceanfront District. After further discussion 'it was moved by Mr. Beatty, seconded by Mr. Brush and unanimously voted that Mr. Anderson be authorized to file Appeals if necessary. On motion of Mr. Brush, seconded by Mr. Beatty, and voted, the Americana _Hotel was granted permission to use the garage area for convention purposes during ce..`tain periods through December 1974. Mayor Printup said that he would like to reappoint Mr. Beatty as the Bal Harbour representative on the Board of Directors of the Dade County League of Cities. The matter of purchasing an additional Bond for the Manager or using two signatures on checks over $25,000. was deferred until Mr. Maley could confer with Mr. Perry of the Sun Bank. It was moved by Mr. Scott, seconded by Mr. Brush and voted that Bal Harbour Village objects to the plan of creating a Shopping Village in conjunction with the rebuilding of the Lighthouse Restaurant and that the Village Manager should wrmte the County Manager stating our opinion that we do not believe another shopping area Is needed in this vicinity. After consideration, on motion of Mr. Beatty, seconded by Mr. Scott, and voted the audit for the first six months was filed for audit. ' Mr. Maley told the Council that the parking of trucks in the Residential Districts of the Village wad becoming a problem and an annoyance to neighbors. Mr. Maley was instructed to have an ordinance prepared for the next meeting. April 16, 1974 Gentlemen: 655 NINETY -SIXTH STREET BAL HARBOUR, FLORIDA 33154 This is a supplemental notice to the one given on April 12, 1974, regarding an amendment to the Zoning Ordinance of Bal Harbour Village, No. 158. In the third paragraph there is reference made to the repeal of a legal reference in Section 2 of the Ordinance, which has no force and effect. What the Council intends to do is to adopt an ordinance on April 27, 1974, deleting from Section 2, Ordinance No. 158, the following language 11 .... , and like authority is conferred upon BAL HARBOUR VILLAGE by the provisions of Chapter 9837, No. 719, Special Acts, 1923,11 A separate ordinance would amend the references used to determine the maxi- mum height of buildings. For technical reasons, our consulting engineers consider it preferable to relate the height of buildings to Mean Low Water, United States Engineer Department (USED) Bay Datum, rather than relating them to street grade. Copies of the proposed ordinances are enclosed for your information. The ordinances, of course, are subject to amendment when they are brought before the Council. Maley Village Managez FWM:bc Enclosures INC OR PO RATED i 946 gentlemen: G55 NINETY -SIXTH STREET BAL HARBOUR, FLORIDA 33154 April 12, 1974 On April 14, 1973, Bal Harbour Village adopted a new Zoning Ordinance for the Village, No. 158, which imposed new regulations controlling the Oceanfront District of Bal Harbour. At the forthcoming meeting of the Bal Harbour Village Council on April 27, 1974, two changes to that ordinance will be considered for adoption. These changes are as follows: 1. The repeal of a legal reference contained in Section 2 of the Ordinance, which has no force and effect. 2. The clarification of the maximum height of buildings and accessory buildings to be allowed. The proposed change will express these heights using U. S. Engineer Department (USED) Bay Datum, rather than their relationship to the street. The maximum height of buildings and accessory buildings will remain approximately the same. The change is necessitated, due to fluctuations in the street grade. Maley Village Manager FWM:bc cc: Property Manager 186 The Village Manager said he received two estimates for engineering services to upgrade the street lighting in the Village. From 2urwelle- Phittaker: $2,000.00 to survey the area, make recommendations and selection of fixtures. An additional $5,000.00 would be required to draw plans and specifications suitable for bidding; and an additional $21,000.00 for super- vision of construction, The engineers estimate that a complete new wiring ' system will be required at a cost of approximately $100,000.00. A second proposal was received from Howard Brandston Lighting Design, New York, for selection, design and plans for new lighting fixtures: $4,000.00. This would not include plans for new wiring, if required. However, this company believes that it may be possible to provide-high intensity lighting without re- wiring the complete system. 'hie would be possible if special transformers could be installed to our present system. The Council asked Mr. Maley to get this answer from the New York firm before they considered it further. As discussed at previous meetings, the Council reviewed the fact that police calls now being taken by the Metro dispatcher are not resulting in the Immediate response that the residents would like. After discussion it was moved by Mr. Scott, seconded by Mr. Brush and voted that Mr. -Maley be authorized to hire personnel to answer the telephones in the Village Hall after normal working hours. Mr. Maley reported that Miami Beach and the Town of Surfside have fiat rates to the airport by taxis serving their residents. He said that he would like to wait until after the close of the Legislature to see if either the State or the County will be regulating taxis. If not, when applications for permits are filed, we might also ordain a flat rate. Mr. George Ling of Kruse, O'Connor and Ling discussed with the Council various suggested changes in the Employees Pension Plan. He said that many of the suggested benefit changes can be made without additional cost to the Village. The Council said they would study these recommendations thoroughly before making any changes. Mr. Maley and Mr. Ling' will make firm recommenda- tions in the near future.
