Key Issues Considered During Review: Side setbacks Recommendation: A motion to approve a Level II Architectural Site Plan Review, based on a finding that the proposed plans are consistent with applicable review standards, based on the following conditions. 1. Basis for Recommendation: This application amends application #000 -06, which included a 1625 square foot, second story addition to be placed over the central portion of the existing home. The renovations approved under the previous application are underway. The current proposal adds two rooms at the rear of the home, changes the column design, and alters the window placement and size. The setback situation is unusual and may warrant discussion by the ARPB. Items to be discussed by the ARPB The current development regulations require that side setbacks must total 30% of the lot width (in this case, 30% of 150' is 45') and shall not be less than 15 feet. The existing home is non - conforming in that the east side setback is only 12' and the west side setback is only 18 feet 7 inches totaling 30' or 20% of the lot width. The addition on the east side is proposed at approximately a 23' setback. When combined with the existing west setback, the total is 41' (27% of lot width). However, 23' represents greater than 50% of the required 45'. Given the circumstances, it seems reasonable to consider the west side setback grand fathered and to allow expansions on the east side of the home, as long as 50% of the required setback is provided and the FAR is in the allowable range. Staff seeks ARPB input on this approach. [Editor's Note: 50% approach in non - conforming situations approved by ARPB 11251011 Code Requirements that must be met prior to issuance of a Building Permit: 1.
