DEVITT III ROBERT W. HOPKINS II WILLIAM A. LYNCH January 30, 2001 Heydt Five Enterprises, LLC 540 Banyan Road Gulf Stream, Florida 33483 RE: 540 Middle Road Dear Mr. Heydt: Telephone (561) 276 -5116 Fax (561) 737 -0188 Town Manager KRISTIN KERN GARRISON Town Clerk RITA L TAYLOR This is to confirm that at the Public Hearing held on January 25, 2001 by the Architectural Review and Planning Board, your application for a Level 2 Architectural /Site Plan Review for 540 Middle Road to permit the addition of two first floor rooms, consisting of 623 square feet, supplementing the addition of a second story that was approved on April 27, 2000, and a change in the window design that was also approved on April 27, 2000, was considered. The Level 2 Architectural /Site Plan Review was approved, based on a finding that the proposed plans are consistent with applicable review standards, subject to the following conditions: 1) The Construction Traffic Management Plan submitted with the application shall be followed during construction; 2) A driveway removal agreement is required for the new paver driveway; 3) Exterior colors shall comply with the provisions of the design manual; 4) The property owner is requested to bury electrica.' cable and phone service lines underground as agreed to at this meeting; 5) The smooth white stucco columns on the front of the house shall be narrower than shown on the rendering and shall match the columns on the rear of the home. The revised columns are subject to approval by the Town Manager. The approval shall expire on January 25, 2002 if a Building Permit Application, including the aforementioned improvements, has not been applied for. Very truly.yours, Rita L. Taylor 1 Town Clerk' cc: Leigh Gove 100 SEA ROAD, GULF STREAM, FLORIDA 33483 TOWN OF GULF STREAM ARCHITECTURAL REVIEW AND PLANNING REPORT Application #: 000 -20 Current Owner: Heydt Five Enterprise, Inc. Address: 540 Middle Road Agent /contract Purchasers: Leigh Gove Proposed Improvement: The current proposal includes two additional rooms at the rear of the home totaling 956 S.F. The color swatches submitted with the application show a light beige principal color with slightly darker beige shutters. Approvals Requested: Architectural/ Site Plan Review -Level 2 (Additions are less than 50% of existing home) Special Exception(s): N/A Variances: N/A Gross Lot Area: 23,250 S.F. Effective Lot Area: 22,500 S.F. (Less submerged lands) Permitted Floor Area: 7,100 S.F. Proposed Floor Area: 7,081 S.F. Zoning District: RS-C/ Core Proposed Height: (30' max. for 2nd story) Finished Floor Elevations: existing is 8 ft. (basement 7 ft) Existing Architectural Style: Gulf Stream Bermuda, one -story Adjacent Residences: Adjacent to the west is a two -story G.S. Bermuda style residence under construction; to the east is an "other /various style" home. Key Issues Considered During Review: Side setbacks Recommendation: A motion to approve a Level II Architectural Site Plan Review, based on a finding that the proposed plans are consistent with applicable review standards, based on the following conditions. 1. The Construction Traffic Management Plan submitted with the application shall be followed during construction. 2. A driveway removal agreement is required for the new paver driveway. 3. Exterior colors shall comply with the provisions of the design manual. 4. The property owner is requested to bury electrical, cable and phone service lines underground has agreed at the 1125101 meeting]. 5. The smooth znhite stucco columns on the f ont of the horse shall be narrozner than shoum on the rendering and shall match the columns on the rear of the home. The revised columns are subject to approval by the Toznn Manager. Basis for Recommendation: This application amends application #000 -06, which included a 1625 square foot, second story addition to be placed over the central portion of the existing home. The renovations approved under the previous application are underway. The current proposal adds two rooms at the rear of the home, changes the column design, and alters the window placement and size. The setback situation is unusual and may warrant discussion by the ARPB. Items to be discussed by the ARPB The current development regulations require that side setbacks must total 30% of the lot width (in this case, 30% of 150' is 45') and shall not be less than 15 feet. The existing home is non - conforming in that the east side setback is only 12' and the west side setback is only 18 feet 7 inches totaling 30' or 20% of the lot width. The addition on the east side is proposed at approximately a 23' setback. When combined with the existing west setback, the total is 41' (27% of lot width). However, 23' represents greater than 50% of the required 45'. Given the circumstances, it seems reasonable to consider the west side setback grand fathered and to allow expansions on the east side of the home, as long as 50% of the required setback is provided and the FAR is in the allowable range. Staff seeks ARPB input on this approach. [Editor's Note: 50% approach in non - conforming situations approved by ARPB 11251011 Code Requirements that must be met prior to issuance of a Building Permit: 1. Unless the home is connected to the private Sewer System, Health Department approval of the septic system will be required prior to issuance of a building permit. ARPB Date: January 25, 2001 Action: Approved subject to the five conditions listed above (5 -0) ARPB # 99 -06, page 2 APPLICATION FOR DEVELOPMENT APPROVAL I ED DEc; a 1 2= Stream, PL 6uiWi ref Level III i nis form is to be used for all development review applications to be heard by the Town of Gulf Stream Architectural Review and Planning Board, Board of Adjustment, and /or Town Commission. As you will see this is in balance with the features of the house and is visibly more proportioned to the house at 3425 Polo Drive. These sizes will allow us to cover the metal supporting columns currently there, while keeping with the classic ............................ styling used in the Bermuda -style homes. I am enclosing also the original elevation showing the over- scaled columns which proved to be objectionable. For your additional information I am also enclosing some photocopies of the manufacturers literature on the columns we intend to purchase. The superior order should always be placed over the inferior, that is Corinthian over Ionic, Doric,Tuscan.
