HomeMy Public PortalAbout1974-05-25 Meeting187 25, 1974 The Council of Bal Harbour Village met Saturday, May 25, 1974 at 9:30A X. in the Village Hail. Present: Messrs. Beatty, Brush, Printup and Taplin Absent: Mr. Scott Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village Clerk; and Robert Jarvis and Karl Hart, representing the Village Attorney. On motion of Mr. Beatty, seconded by Mr. Brush, and voted, the minutes of the previous meeting of April 27, 1974 were approved as submitted. The Village Clerk read ORDINANCE NO. 167 for final reading. It was moved by Mr. Beatty, seconded by Mr. Taplin and unani= mousily voted that the ordinance be adopted. The Clerk then read 3 ORDINANCE NO. 168 for first reading. It was moved by Mr. Brush, seconded by Mr. Beatty, and voted that the ordinance would be read for final reading at the next meeting. 3 A copy of the Public Notice pertaining to Ordinance No. 167 'and Ordinance No. 168 are'made part of these minutes. Mr. Karl Hart, attorney, discussed with the Council a propose suit against Standard Dredging Company to .recover damages.sustained by rebidding a portion of the beach restoration project, due to the company's refusal t;o execute ---,—a—contract a_ contract in accordance with their bid. After Mr. Hart outlined the basis on which his firm would undertake the suit it was moved by Mr. Beatty,,seconded by Mr: Taplin and unanimously voted that Shutts and Bowen be retained to file suit against Standard Dredging Company�on the Contingency Basis of 25%. plus,expenses Incurred. Mr. Maley said that inasmuch assother governmental agencies were in- volved in the payment of the beach restoration project that he would advise them of the Council's action. The Village Manager said that: -Astor Electric had designed a parking lot lighting system for under Baker's Haulover bridge and that there would,be no charge for the design if they were given the contract. The system calls•for six luminaires with shields to protect against vandalism for a cost of $7,737.00 bolted into the bridge piers or $8,555.00 if brackets have to be furnished. It was the Council's opinion that due to savings involved in the system design being furnished and the service rendered by Astor in the past to the Village, that it would be in order to award the contract to Astor Electric as the pro- tection afforded by this system was badly needed in this area. It wee moved by Mr. Taplin, seconded by Mr. Brush, and unanimously voted to accept the proposal of Astor Electric for $7,737.00. 188 Mr. Jarvis reviewed the status of the suit to force the Village to issue a building permit for the proposed building on Lot 11 of the Ocean- front District. Mr. Sibley maintains that both Ordinance No. 11, the original Zoning Ordinance and Ordinance No. 158, the present Zoning Ordinance are invalid. He said the Village had filed an,Appeal on April 7th, which had been denied by Judge Gale and the briefs were now being field in the Appelate Court. Mayor Printup said he had attended a meeting at the Chase Insurance Agency regarding liability insurance for public officials. Mr. Maley said that Mr. Beckham would bepresent at the June meeting to discuss the Village insurance needs with the•Council. Mr. Jarvis said that Judge Nathan has ruled that the Miami Beach water Rate is arbitrary and that Miami Beach must hold a public meeting to establish a reasonable rate. He said he would not comment further until he could study a copy of the written opinion which had not been received. Mr. John Looby and Mr. Neil Orange, his engineer, appeared to request that he be allowed to install a package sewer treatment plant on Lot 1 Block 8A and proceed with the construction of a thirty -six apartment building on the lot. He said that the State Pollution Control Board now allows treated sewage to be discharged into the present sewer mains and shAed the Council a rendering of a typical unit. It was moved by Mr. Beatty, seconded by Mr. Brush and voted - Messrs. Beatty, Brush and Printup, '"yes "$ Mr. Taplin, ' "no" to�allow this temporary installation with a proper bond to be furnished. The Council discussed upgrading the lighting system in the residential sections of the Village and also additional lighting for pedestrian safety on Collins Avenue. Mr. Maley said that in addition to proposals by the Village Engineers and a New York firm, that Florida Power acid Light was studying the situation and would have a recommendation soon. Also discussed was the possible resurfacing of residential streets and storm sewer renova- tions. Mr.-Maley said that North Miami Beach had advised that they intended to raise our water rate from twepty-five cents per thousand gallons to fifty cents. He said that a meeting *as scheduled with North Miami Beach officials, Bay Harbor Islands and Bal Harbour. Resignations from the Library Board were accepted from mfrs. David Exley and Mr. Fred Faulkner. Mr. Maley said he would like to submit the names of Mr. Jack Jones and Mrs. '.Sidney Schwartz to replace them. It was moved by Mr. Beatty, seconded by Mr. Taplin and unanimously voted that the appointments be made. Mr. Taplin said that he would like to see the fence separating the Harbour House North from the access walk to the beach constructed in the same manner as the present wall in front of the buildings. Mr. Maley said that Mr. von Oesen would work with Mr. Taplin on the plans and specifications for the fence. Mr. Maley said that the police department had met with him and were concerned about job security and had suggested an Ordinance creating a Personnel Review Board. The manager also stated that due to the fact that our budget to passed so early before the start of the fiscal year, our May 25,1974 police salaries are quite a bit below those now being offered by other communities. He suggested that a cost of living raise be implemented for all employees in July instead of October 1st, at a cost to the Village of approximately $12,800.00, one -half of this amount is available due to vacancies during the year. The Council said they would like to consider this matter further and discuss it at a meeting to be held June 8the - Mr. Jarvis suggested that Ordinance No. 158, as amended, be advertised and passed under the Home Rule Act to stay any further confusion about the status of Bal Harbour zoning. The Council agreed to start processing this Ordinance on June 8th. I On motion of Mr. Beatty, seconded by Mr. Brush, the meeting was adjourned at 11:50 A.M.
