REQUEST: Provide a copy of all records (including communications and reports) relative
to the comnliance or non-compliance with the ADA for the Pronerties owned by the Town of Gulf
Stream. This request is made for the period beginning January 1, 2010 and through October 15, 2015.
ADDITIONAL INFORMATION REGARDING REQUEST: The term "Town of Gulf Stream" shall
mean each of the following: the Town of Gulf Stream- its Commissioners. its Manager, its emnlovees. its
Police Department, its Police Officers and its Counsel (including, without limitation, the following law
firms) Sweetanole. Broeker & Varkus: Richman Greer- PA: and Jones. Foster, Johnston & Stubbs.
(including, without limitation- the attorneys, emolovees and Dartners of each such law firm.)
THIS REQUEST IS MADE PURSUANT TO ARTICLE I, SECTION 24 OF THE FLORIDA CONSTITUTION AND CHAPTER 119,
FLORIDASTATUTES
IF THE PUBLIC RECORDS BEING SOUGHT ARE MAINTAINED BY YOUR AGENCY IN AN ELECTRONIC FORMAT PLEASE
PRODUCE THE RECORDS IN THE ORIGINAL ELECTRONIC FORMAT IN WHICH THEY WERE CREATED OR RECEIVED.

ORDER OF A COURT OF COMPETENT JURISDICTION AFTER NOTICE TO ALL AFFECTED PARTIES'."

Provide a copy ofall records (including, without limitation, billings, memos, text messages, emails,
audio tapes and videos) wherein the League of Cities was a Receiver or Sender; and where the
Town of Gulf Stream was a Receiver or Sender for the period January 1, 2013 through October
15, 2015 which are in possession of the Town of Gulf Stream. The term "Town of Gulf Stream "
shall mean each of the following: the Town of Gulf Stream, its Commissioners, its Manager, its
employees, its Police Department, its Police Officers and its Counsel (including, without
limitation, the following law firms) Sweetapple, Broeker & Varkus; Richman Greer, PA; and
Jones, Foster, Johnston & Stubbs, (including, without limitation, the attorneys, employees and
partners of each such law firm.)

Police Station at 246 Sea Rd, Delray Beach, FL 33483
Dear Sir:
This agreement is for A.D.A. Compliance Team, Inc. and David Pedraza to assist you in
preparation for trial and to act as an expert witness in this matter. Services are to be performed
by A.D.A. Compliance Team, Inc. and David Pedraza with Bill Thrasher, City of Gulfstream as
Client, on behalf of 100 Sea Road, Gulfstream, FL 33483 and 246 Sea Rd, Delray Beach, FL
33483.
Retainer: To bind this agreement, you agree to pay a retainer of $1,250.00 to A.D.A.
Compliance Team, Inc. and David Pedraza. This is a non-refundable fee. You may not identify
A.D.A. Compliance Team, Inc. and David Pedraza as either a testifying or non -testifying expert
until such time as the retainer fee has been paid. Work will proceed when the retainer fee and
Retainer Agreement are received by A.D.A. Compliance Team, Inc. and David Pedraza.
Any charges for additional work performed by A.D.A. Compliance Team, Inc. and David
Pedraza that exceed the amount of the Retainer will be invoiced monthly and will be due and
payable immediately.
Fees: Our fees for services would be based on an hourly rate as follows:
David Pedraza @ $200.00 an hour
Courtroom trial testimony @ $200.00 an hour
Expert witness depositions @ $200.00 an hour
Clerical, Drafter, Technical @ $95.00 an hour
Deposition testimony: You are responsible for assuring that reasonably estimated deposition
fees will be paid by attorneys and will be paid within thirty working days of the deposition. If
payment is not received by this time, you are responsible for any deficiencies in payment by
deposing attorneys.
Trial testimony: When testimony at trial is scheduled, the balance for any outstanding time and
expense is due immediately. An additional retainer of $400.00 is due to cover trial preparation
and testimony. Any credit balance from a previously received retainer will contribute to this
retainer. Additional consulting or testimony (if any) will be invoiced upon completion of
consulting activity or oral testimony.
Expenses: In addition to paying hourly consultation services, you agree to pay reimbursable
expenses incurred by A.D.A. Compliance Team, Inc. and David Pedraza that will be billed. You

agree that you are liable for any debt incurred by A.D.A. Compliance Team, Inc. and David
Pedraza on this project.
Payment: All invoices are due & payable upon receipt. A late fee of 1.5% will be added each
month to invoices 30 days or more past due. All outstanding balances must be paid in full before
additional work is performed. You are responsible for all payments as outlined in this contract,
regardless of any arrangement you may have with any party or parties you represent. In no case
will payment be based on a contingency or lien, or deferred until settlement of the case.
Payment to A.D.A. Compliance Team, Inc. and David Pedraza for the services provided is not
dependent upon our findings, nor on the outcome of any legal action, mediation, arbitration, or
the amount or terms of any settlement of the underlying legal cause, nor on any contractual
arrangement between you and any other person or party.
Collection: You agree to pay any and all collection expenses including attorney's fees and any
other costs A.D.A. Compliance Team, Inc. and David Pedraza incurs in connection with the
collection of A.D.A. Compliance Team, Inc. and David Pedraza's consulting fees and expenses.
Termination: You may discharge A.D.A. Compliance Team, Inc. and David Pedraza at
anytime by providing a written notice (effective upon receipt). Regardless of any such
discharge, payment in full for services rendered prior to the effective date of such notice as well
as costs incurred by A.D.A. Compliance Team, Inc. and David Pedraza will be due immediately
upon receipt of final invoice from A.D.A. Compliance Team, Inc. and David Pedraza. A.D.A.
Compliance Team, Inc. and David Pedraza may withdraw from the case at any time with your
consent for good cause, or for breach of any part of this agreement. Not making payments when
due would constitute a breach of this agreement.
Limitation of Liability: The Americans with Disabilities Act (ADA) and the ADAAG
guidelines are extremely complex, and often open to interpretation. While A.D.A. Compliance
Team, Inc. and David Pedraza have many years of experience and an excellent track record on
interpretation of the ADA and ADAAG guidelines, we cannot guarantee that others will concur
with our assessment. The fact that another inspector, expert, lawyer, court or other entity may
disagree with our assessment, or may interpret the ADA or ADAAG differently, shall not be
construed as a failure by A.D.A. Compliance Team, Inc. and David Pedraza to perform services
in a careful or conscientious manner.
A.D.A. Compliance Team, Inc. and David Pedraza will provide the highest quality of service
possible. It is understood and agreed to, that A.D.A. Compliance Team, Inc. and David Pedraza
total liability for any and all injuries, claims, losses, expenses, damages or claim expenses arising
out of this agreement from any cause or causes will be limited to a maximum of the net fee
received by A.D.A. Compliance Team, Inc. and David Pedraza, not including direct project
expenses, for all services rendered on the project. Such causes include, but are not limited to
negligence, errors, omissions, strict liability, breach of contract or breach of warranty.
Governing Law: This Agreement shall be governed by, and construed in accordance with, the
laws of the State of Florida. All parties to this agreement expressly consent and submit to the
exclusive jurisdiction of the courts of the State of Florida for all purposes regarding this
Agreement. Any dispute at all relating to this Agreement or the services rendered hereunder shall
be heard in the Broward County Circuit Court.
In signing this agreement you agree to the above -stated terms.

In response to your email regarding the above referenced subject, please be advised
that the inspector you have engaged to inspect the Town's buildings for compliance with
ADA requirements is certainly welcome to inspect those spaces within the Town of Gulf
Stream's buildings which are traditionally open to the public including Commission
Chambers, the public library, bathroom facilities in Town Hall and entrances and exits to
and from Town Hall, including accessibility ramps and parking facilities. Please advise
as to whom you have retained and have that individual make an appointment with me
when he or she wishes to conduct the inspection so that I or other Town employees will
be available to assist.
If you have specific concerns in regard to ADA compliance, please advise. As you may
or may not know, the Town has previously hired an ADA inspector to assist in making
certain the Town Hall and its public facilities are ADA compliant. It is my intent, on the
basis of apparent concerns by you, to retain an ADA inspector to make sure the Town

Reference is made to the E -Mail below.
As of this moment, I have still not received a response to the below E -Mail. Would you kindly provide a
response by day's end (realizing that all we are looking for is access to the building to confirm compliance
with, inter alia, the ADA.
If I do not hear from you by the close of business today, I along with an engineer and (perhaps) others will
be on site tomorrow morning and will visit the public portions of the building and any other portions of
the building which you will permit us access to.
While on at the Town Meeting this past Friday, I noticed what I believe are numerous violations of the
ADA, which violations include, inter alia, the following:
1. The entrance ramp to the back of the building is much too steep.
2. The handicapped parking space is ill placed and I do not believe that the path from the existing
parking space to the ramp going into the rear door is of adequate size and slope.
3. I also do not believe that the rear door is not in compliance.
There are numerous other areas of the site and building which I believe are not in compliance with, inter
alia, the ADA and which should be remediated.
In addition to the above, the Police Department's handicapped space is woefully in violation and seems
easy to correct. As far as the inside of the Police Station, from my last visit, I believe that work needs to
be done to that property.
Mr. Thrasher, I want to work with the Town of Gulf Stream and assist them in making their properties
"barrier free", but I need your cooperation. In that connection, I suggest that the following occur:
1. That we have an expert (which I will pay for) look at the Town properties to determine which
properties are not in compliance and why they are not in compliance.
2. We work together to create a reasonable schedule for the sequence of the work.
3. We work together to create a reasonable schedule to implement the work.
I look forward to opportunity for you and I to work together for the betterment of the Town of Gulf
Stream and its residents.

easy to correct. As far as the inside of the Police Station, from my last visit, I believe that work needs to
be done to that property.
Mr. Thrasher, I want to work with the Town of Gulf Stream and assist them in making their properties
"barrier free", but I need your cooperation. In that connection, I suggest that the following occur:
1. That we have an expert (which I will pay for) look at the Town properties to determine which
properties are not in compliance and why they are not in compliance.
2. We work together to create a reasonable schedule for the sequence of the work.
3. We work together to create a reasonable schedule to implement the work.

Dear Mr. O'Boyle
In response to your email regarding the above referenced subject, please understand
that the Town of Gulf Stream considers ADA compliance an important matter and is
therefore willing to allow the inspector you have engaged to inspect the Town's
buildings for compliance with ADA requirements. To that end, your inspector is
welcome to inspect those spaces within the Town of Gulf Stream's buildings which are
traditionally open to the public, including the Commission Chambers, the public library,
bathroom facilities in Town Hall and entrances and exits to and from Town Hall,
including accessibility ramps and parking facilities. Please advise as to whom you
have retained and have that individual make an appointment with me when he or she
wishes to conduct the inspection so that I or other Town employees will be available to
assist.
As you may or may not know, the Town has previously hired an ADA inspector to assist
in making certain the Town Hall and its public facilities are ADA compliant. It is my
intent, however, on the basis of concerns you have referenced, to retain an ADA
inspector to make sure the Town facilities are ADA compliant.

Do you think it would be advisable for the Town to begin to develop a plan to work toward providing an ADA
compliant restroom facility. Or at least have an assessment demonstrating the modifications to be too
expensive to undertake without a significant impact on the budget. The Property Appraiser lists the
construction date as 1986 which is prior to the 1990 date provided in the code where all new construction and
building alterations must meet code to the maximum extent feasible.

Provide a copy of all records (including communications and reports) relative to the compliance
or non-compliance with the ADA for the properties owned by the Town of Gulf Stream. This
request is made for the period beginning January 1, 2010 and through October 15, 2015. The term
"Town of Gulf Stream" shall mean each of the following: the Town of Gulf Stream, its
Commissioners, its Manager, its employees, its Police Department, its Police Officers and its
Counsel (including, without limitation, the following law firms) Sweetapple, Broeker & Yarkus;
Richman Greer, PA; and Jones, Foster, Johnston & Stubbs, (including, without limitation, the
attorneys, employees and partners of each suich law firm.)

extensive clerical and supervisory assistance, well in excess of 15 minutes, gathering records

year time period, require extensive clerical or supervisory assistance by Town personnel.
Accordingly, in order to ensure that no record has been overlooked, the Town estimates that it will
take at least one additional 1 hour of administrative support at $40.51 per hour, the labor cost of
the personnel providing the service, and will require a deposit from you in that amount per Fla.
Stat. § I I9.07(4)(d). If the costs of producing these documents will exceed your deposit, the Town
will provide you with an initial production of responsive records and an estimate for the production
of any additional responsive records. If the costs of production are less than the deposit, the Town
will provide you with the responsive records and a refund.
