The Council of Bal Harbour Village met Saturday, June 8, 1974 at
9:30 A.M. in the Village Hall.
Present: Messrs. Beatty, Brush and Printup
Absent: Messrs. Scott and TaplIn
Also present were Fred W. Maley, Village Manager and Mary T.Wetterer
Village CLerk.
On motion of Mr. Beatty, seconded by Mr. Brush and voted, the minutes
of the previous meeting of May 25, 1974 were approved as submitted.
ORDINANCE NO. 168
prohibiting the parking of trucks, etc, in the Residential Districts, was read
In full by the Village Clerk for the second and final time. On motion of
Mr. Brush, seconded by Mr. Beatty and unanimously voted the ordinance was
adopted.
ORDINANCE NO. 169
the Zoning Ordinance, was read by the Clerk by title for first reading. The
Clerk Informed the Council that a notice would be published in the Miami Herald
on June 10, 1974 stating that a Public Hearing would be held on the Ordinance
on June 29, 1974. It wee moved by Mr. Brush, seconded by Mr. Beatty and unani-
mously voted that the ordinance be adopted on first reading.
Mr. Maley said that our Insurance Agent had researched Florida Law
and found that there are no statutory bond requirements for Village Managers
In this State. After discussion it was moved by Mr. Beatty, seconded by Mr.
Brush, and unanimously voted that the Manager's Bond be left at $259000.00
and that two of the three authorized signatures be required on checks written
for amounts over $15,000.00.
Mr. Maley said that Mr. Karl Bart of Shutte and Bowen had called
regarding the fees quoted at the previous meeting for handling the suit against
Standard Dredging Corporation. He said that in addition to the fee quoted for
the Circuit Court Hearing there would be an additional fee of 5% for taking it
to the Appellate Omrt, and another additional fee of 5% if taken to the
Supreme Court.
It was the Council's decision that the matter of granting coat -of-
living salary increases to employees effective on july, let would be held for
the meeting of June 29th.
The Mayor read a letter of resignation from Mr. Scott stating that
due to illness he would not be able to complete his term of office on the
Council. It was moved by Mr. Brush, seconded by W. Beatty and unanimously
voted that Mr. Scott's resignation be accepted with regret and a suitable
plaque be presented to him. It was the Council's decision to consider
filling this vacancy at the next meeting.
Mr. Maley explained to the Council that the garbage trucks had been
replaced in 1970 and it is necessary to purchase one more truck due to the
increased work load and repairs which taken a needed truck out of circula-
tion. He also stated that the Americana Hotel garbage could not be handled
with our new containers and he suggested that the solution to this will be
leaving a truck on the promises hooked up to a separate power unit so that
the hotel staff can run the compactor on our truck, but will not be able to
move the vehicle. It was moved by Mr. Beatty, seconded by Mr. Brush, and
unanimously voted that due to the urgency of this matter, the Village Manager
be authorized to purchase a truck the same as our other vehicles, the cost of
which is approximately $23,300.00.
Mr. Printup read a letter from the Bal Harbour Resort Association
asking the Council to purchase a page in the 1975 AAA Tour Book for $2,866.05.
It was moved by Mr. Brush, seconded by Mr. Beatty and unanimously voted to
approve this request for an expenditure from the Resort Tax.
It was moved by Mr. Beatty, seconded by Mr. Brush and unanimously
voted that Bal Harbour Village would join Bay Harbor Islands in requesting the
United States Coast Guard to relocate the Bay channel markers further away from
the seawalls due to the excessive wakes.
Mr. Maley reported on a meeting held with representatives of Bay
Harbor Islands and North Miami Beach regarding the desire of North Miami Beach
to raise our water price. He said our attorneys maintain that our existing
contract is valid and that any changes would be in accordance with our agreement.
There being no further business, on motion of Mr. Brush, seconded by
Mr. Beatty the meeting was adjourned at 11:00 A.M.

Village Clerk; and Thomas H. Anderson, Village attorney.

minutes of the previous meeting of June 80 1974 were approved as submitted.
