HomeMy Public PortalAbout154 Affidavit of PublicationNOTICE MEDINA ORDINANCE NO. 154 AN ORDINANCE PERMITTING DEFERMENT OF SPECIAL ASSESSMENTS THE CITY COUNCIL OF THE CITY OF MEDINA DOES ORDAIN: Section 1. Purpose. The Medina City Council hereby finds that there is a need to establish a procedure per- mitting deferment of special assessments pursuant to Minn. Statutes 444.22-444.24 in cases where they may create a hardship for elderly homeowners. Section 2. Application. Application for deffered assessment shall be made to the City Council upon forms prescribed by the Hennepin County Department of Finance and by the City Council and shall contain true statements of such information as is requested thereon. Application for deferment of assessments beginning in any year shall be made by Sep- tember 15 of the preceeding year. Section 3. Approval. The City Council shall approve or disapprove each application on the basis of whether payment of the assessment would constitute hardship, based upon family income, assets, expenses, and other available information reasonably applied by the Council against stan- dards and statistics they may indicate hardship, including but not limited to eligibility requirements for public assistance and government indeces on various standards of living. The City Council may grant a deferment in whole or in part. Section 4. Interest. Interest as provided by law shall continue to ac- crue upon any principal amount of special assessment which may be deferred until the same is paid. Section 5. Termination. The defer- ment shall terminate and all principal amounts accummulated plus ap- plicable interest shall become due upon occurrence of any of the following: death of the owner, provided the sur- viving spouse is not eligible for defer- ment, sale, transfer or subdivision of the property or any part thereof ; loss of homestead status for the property; determination by the City Council that a hardship no longer exists. Section 6. Funding. The City Council annually may transfer to the ap- propriate bond repayment funds from the general fund amounts equal to deferred assessments, including principal and interest. The Council may levy for such amounts for the general fund in addition to all other levies. The General Fund shall be reim- bursed for such transfer upon payment of the deferred assessments, including principal and interest. Section 7. Severability. The finding of any part of this ordinance to be null and void shall not affect the remaining parts. Approved by the Medina City Council this day of 1975.
