AN ORDINANCE: AMENDING CHAPTER 2 (ADMINISTRATION), ARTICLE V
(BOARDS AND COMMISSIONS) OF THE LEESBURG TOWN
CODE
WHEREAS, the Leesburg Town Council has the authority to adopt ordinances and to
promulgate rules and regulations that pertain to its government and affairs, and to review,
interpret and amend its ordinances, rules and regulations; and
WHEREAS, the Leesburg Town Council desires to make amendments to Town Code
Chapter 2 concerning boards and commissions in order to modify and clarify membership
requirements as well as the rules regarding meetings and compensation for members; and
WHEREAS, all prior ordinances and resolutions in conflict herewith are repealed; and
WHEREAS, based upon the foregoing, the Leesburg Town Council has determined
that it is necessary, advisable and in the best interests of the Town of Leesburg and its residents
to amend its Town Code as set forth below.
THEREFORE, ORDAINED, by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. Chapter 2 (Administration), Article V (Boards and Commissions) is hereby
amended as follows:
Sec. 2-195. Duties.
(a) The board/commission shall elect its chair annually. The commission shall elect
annually the officers it deems necessary. Elections are encouraged to occur
between January and March. At its first meeting. at the beginning of each
calendar vear the board/commission. other than the Planning Commission or
the Board of Zoning Appeals. whose schedules are determined by anvlicable
state law. shall set a schedule for its regular meetings for the rear. After
adoption of the schedule. a vote of the m4joritv of the board/commission shall
be required to modify that schedule
(b) The chair shall record and report attendance of each member to the town clerk. If
any member is absent from three consecutive regularly scheduled meetings or is
absent from any four regularly scheduled meetings within any calendar year, then

the member shall automatically be removed from the position and the town
council shall fill the vacancy in the manner set forth in Town Code section 2-194.
The foregoing shall not apply to the Planning Commission or the Board of Zoning
Appeals, where appointment and removal are govemed by applicable state law.
Members removed for absenteeism shall not be elkible for reappointment to any
Town board or commission for 12 months from the date of removal.
(c) The board/commission shall meet monthly, at least nine times during the
calendar year with no more than one regular meeting in any month, and may
meet as necessary upon the call of the chair or two or more members. Unless
otherwise noted, failure to attend rescheduled meetings or additional meetings
called by the chair or at least two members shall not count against the monthly
attendance requirement set forth in Section 2-195(b).
(d) The board/commission shall provide at least annually a report to the town council
on the activities and accomplishments of the board/commission.
(e) The board/commission shall adopt rules/bylaws governing the conduct of its
business and meetings.
(f) The board/commission shall be knowledgeable of the requirements of the State
Virginia Freedom of Information Act (Code of Virginia, § 2.2-3700 et seq.), State
and Local Govemment Conflict of Interests Act (Code of Virginia, § 2.2-3100 et
seq.) requirements, and the town's board and commission handbook.
Sec. 2-196. General meeting requirements.
(b) Meetings shall be noticed and open to the public under the State Virginia Freedom
of Information Act (Code of Virginia, § 2.2-3700 et seq.).
Sec. 2-197. Compensation.
(a) Compensation for the mayor and councilmembers, after July 1, 2013, shall be
$16,200.00 and $15,600.00 per annum, respectively, payable in equal monthly
installments. Compensation for the mayor and councilmembers shall be adjusted
in the same manner as the pay rates for the town's employees for any Cost -of -
Living Adjustment ("COLA") effective on or after July 1, 2022. The Department
of Human Resources shall maintain a reference table for Council compensation
after July 1.2022
(b) Unless specifically noted, compensation for the chairs of boards and commissions

regularly scheduled pay period for Town staff following the month in which
each meeting the chair or member actually attended.
(c) To be compensated, every board and commission member must present themselves
with proper identification to the appropriate town department and must complete
and submit all federal and state payroll tax withholding forms, as required by law.
A board or commission member may decline compensation and a member's
failure to turn in the required documentation related to compensation shall be
deemed a waiver of compensation for the period prior to the submittal of proper
documentation.
DIVISION 2. SPECIFIC BOARDS AND COMMISSIONS
Sec. 2-220. Leesburg Board of Architectural Review.
(a) Recreated and reestablished. The Leesburg Board of Architectural Review is
hereby recreated and reestablished. Membership shall be as set forth in the
applicable section of the Leesburg Zoning Ordinance.
(c) Compensation.
(2) Compensation of voting members of the Leesburg Board of Architectural
Review exclusive of the councilmanic appointment shall be $3,600.00 per
annum, payable in equal monthly installments.
Sec. 2-222. Leesburg Environmental Advisory Commission.
Id) Membership. Membership may consist of town residents or town property
owners. At least four members shall be town residents

(c) Membership. Membership, exclusive of the rules outlined in division 1 of this article,
may consist of town residents,
town property owners, town business owners, or anyone employed in the town. At
least four members shall be town residents. An additional non -voting member
shall be appointed by the county board of supervisors to serve a two-year term and
shall serve as the liaison to the county board of supervisors. If the businesses
located at the airport create an association of such businesses (the "Airport
Business Association" or "ABA"), then the ABA may designate one member to
serve on the airport commission as a voting member, the term of such ABA
representative to be determined by the ABA. In addition, the Leesburg Economic
Development Commission may designate a member as a non -voting liaison to the
airport commission.

Sec. 2-225. Leesburg Parks and Recreation Commission.
(d) Membership. Membership may consist of town residents or town property
owners. At least four members shall be town residents.
Sec. 2-227. Leesburg Commission on Public Art.
(d) Membership. Membership may consist of town residents or town property
owners. At least four members shall be town residents.
Sec. 2-228. Leesburg Technology and Communications Commission.
(d) Membership. Membership may consist of town residents or town property
owners. At least four members shall be town residents.
Sec. 2-229. Leesburg Tree Commission.
(d) Membership. Membership may consist of town residents or town property
owners. At least four members shall be town residents.
Sec. 2-233. Leesburg Diversity Commission.
(d) Membership. Membership may consist of town residents or town property
owners. At least four members shall be town residents
SECTION II. This ordinance shall be in effect upon its passage.
