Home My Public Portal About053-2000 - Grant - INDOTORDINANCE NO. 53-2000 AN SPECIAL ORDINANCE VACATING A PORTION OF NORTH 2ND STREET WHEREAS, the Wayne County Board of Commissioners has petitioned the Common Council of Richmond requesting the vacation of a portion of North Second Street in the City of Richmond, Indiana, the same being vacation petition No. 1-2000; and WHEREAS, Wayne County is the only owner of land abutting the above described public way; and WHEREAS, the abutting land owner has waived notification by the City Clerk as required by Indiana Law; and WHEREAS, Common Council, pursuant to Indiana ode 36-7-3-12, conducted a public hearing on said petition September 5, 2000, after publishing legal notice thereof at least 10 days in advance of said hearing as required by statute; and WHEREAS, the, Richmond Advisory Pan Commission, pursuant to Richmond Code 155.04(b), conducted a public hearing on said petition August 24, 2000, after publishing legal notice thereof at least 10 days in advance of said hearings as required by City Code; and WHEREAS, it is desirable to vacate a portion of said pubic way in order to facilitate the construction of a new Wayne County jail. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that subject to the preservation of easements for existing utilities, the public way described in attached exhibit “A” is hereby vacated and the abutting property owner shall acquire ownership of the land heretofore dedicated as a pubic way as described in Exhibit “A” and illustrated in Exhibit “B”, both of which Exhibits are attached hereto and hereby incorporated by reference.
