HomeMy Public PortalAboutResolution 02-4088" RESOLUTION NO. 02 -4088 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY UPHOLDING THE DECISION OF THE PLANNING COMMISSION AND APPROVING CONDITIONAL USE PERMIT 01 -1473, SUBJECT TO CERTAIN CONDITIONS, AT 9700 LAS TUNAS DRIVE (TCUSD /SPRINT PCS) THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE: SECTION 1. Based upon information contained in the staff report to the City Council and information contained in the Planning Commission staff report as well as the Planning Commission minutes; and based upon testimony received at a noticed pubic hearing before the Planning Commission on April 9, 2002 and December 11, 2001 and testimony received at a noticed public hearing before the City Council on June 4, 2002, the City Council approves the Conditional Use Permit based upon the findings and subject to the conditions contained in Planning Commission Resolution No. 02- 2009PC: SECTION 2. This project should not result in significant effects upon the environment, and a Negative Declaration has been prepared in accordance with the State CEQA Guidelines. The initial statement as prepared indicates there is no potential for adverse impact to the environment as it relates to all wild animals, birds, plants, fish, amphibians, and related ecological communities, including the habitat upon which the wildlife depends for its continued viability. For a detailed Environmental Analysis of an application similar to the proposed project, refer to the previous Airtouch Cellular application (CUP 93 -1187) to locate a cellular antenna at Temple City High School. An Expanded Negative Declaration studying the potential health effects from non - ionizing electromagnetic radiation (EMR) was prepared by EIP Associates for the project. The Expanded Negative Declaration contains an Environmental Checklist as well as the Negative Declaration and concluded that the proposed cellular facility would not have a significant effect on the environment. SECTION 3. Accordingly, Conditional Use Permit 01 -1473 is approved subject to the conditions contained in Planning Commission Resolution No. 02- 2009PC. SECTION 4. Accordingly, Conditional Use Permit 01 -1473 is hereby approved, subject to the aforementioned conditions.
