APPROVING MEMORANDUM OF AGREE ME T
WHEREAS, the Carteret local PBA and SOA filed an unfair labor pr ctices charge
against the Borough with the NJPERC relating to the use and "bankin "of vacation time;
and
WHEREAS, the pat1ies have reached an agrecment to amicably resol e the matter and
wish to fonnalize the same pursuant to a Memorandum of Agreement.
NOW, THEREFORE, BE IT RESOLVED, hythe Mayor and Cou cil of the Borough
of Carteret as follows:
1. That the above-referenced Memorandum of Agreemen between the
Borough and the Carteret PBA and SOA is hereby app ovcd.
2. That the appropriate Borough Officials are hereby aut rized and directed
to execute the same and implement the settlement acco ding to its tenns.

MEMORANDUM OF AGREE
As an amicable resolution of the above captione unfair practice charge, the
parties agree as follows:
1. Officers will hereafter be permitted to carry fo ard unrestricted any and all
vacation time accumulated prior to December 31 2006. All said accumulated
vacation time may be permanently "banked." S ould an officer not have any
unused vacation time as of December 31, 2006, t en, in that case, said officer
may "bank" all of his/her allotted 2007 Calendar ear vacation time.
2. Except for those officers referenced in paragra 1 above that may not have
any 2006 Calendar Year available to "bank," b ginning January 1,2007, all
officers shall utilize at least fifty (50%) of thei allotted 2007 Calendar Year
vacation time, and then may carry forward the alance of said 2007 accrued
vacation time until December 31, 2008 only.
3. Thereafter, beginning on January 1,2008 each fficer's allotted vacation time
for the then current Calendar Year must be use by December 31 of the next
subsequent Calendar Year.
4. This agreement is subject to the Borough's erifícation of the amount of
vacation time each officer has accrued.
5. By this agreement, the Borough does not adn it any violation of the Public
Employer-Employee Relations Act, nor does t e PBA make any concession
that the Act was not violated.
6. This agreement is signed subject to the approva by the Borough and the PBA,
respectively. Upon such approval, and i exchange for the above
representations, the PBA will withdraw the unÐ ir practice charges.
