SUMMARY STATEMENT:
After much input from the community, opinions from the City’s attorney, and discussions of the Council a
final version of the 3% Occupancy Local Option Tax Ordinance has been prepared for Council’s adoption.
The attached Ordinance, if approved by voters, will renew the tax for an additional 10 years. The rate of the
new tax being considered will remain at 3%. The new ordinance proposes a change in the makeup of
allowable uses and a change to the responsibilities of the Local Option Tax Commissioners. Those changes
are called out in the attached redlined sections of the ordinance.
RECOMMENDED ACTION:
1. Review and finalize the Ordinance
2. Suspend the rules and read by title only, one time only Ordinance ____.
3. Adopt Ordinance ____ renewing the Local Option Tax at 3% for 10 years, approve the publication of
the summary, and authorize the Mayor to sign all necessary documents.

November 9, 2017 Council had some suggested changes: 10 year term, add housing, and clarify public
purpose
November 30, 2017 Council asked City Attorney for some clarifying language for the ordinance to
reflect the results of the attorney opinion on legal disbursement of LOT Funds
January 11, 2018 Council requested a public meeting to get additional feedback
February 7, 2018 Council held a community conversation to educate the public and receive feedback
February 22, 2018 Council consensus on allowable uses and Council directed staff to work with
attorney to draft final ordinance
