RESOLUTION OPPOSING SENATE BILL S-638/A-2527- RE TRICTION ON
DAYS TO OPEN BIDS
WHEREAS, Senate Bill #638 and Assembly Bill #2527 seek to amend the Local
Public Contracts Law and the Public Schools Contracts Law to pro ibit the receipt of
bids on Mondays or any day dircctly following a State or Federal H liday; and
WHEREAS, this legislation, in effect, re-focuses Pllblic contractin to accommodate
the contractor rather than uphold the requirements of the Public Co racts Law; and
WHEREAS, Compressing business to four days could affect th ability of local
governing bodies to conduct meetings, issue addendums and not b able to award a
contract in a timely manner, the result being delayed projects and ncreased costs to
taxpayers; and
WHEREAS, vendors should be prepared no mattcr the day or tin e to submit bids,
since under the Local Public Contracts Law bids arc advertised in a vance of the date
lixed for receiving the same in order to promote competitive biddin
WHEREAS, the Legislature should not be focused on reducing he time wherein
municipalities conduct business, but rather the State should help en ure a climate for
municipalities to obtain the best available options for taxpayers; and
WHEREAS the New Jerscy League of Municipalitics strongly pposes S-638/A-
2527 as released and has requestcd that all of its members to go 0 record similarly
opposing the same.
NOW, THEREFORE, BE IT RESOLVED by the Mayor an
Borough of Carteret, County of Middlesex, State of New Jersey, as
Council of the
lIows:
l. That the Borollgh of Carteret hereb opposes Senate
Bill #638 and Assembly Bill #2527.
2. That a copy of this Resolution be forw rded to Senator
Joseph F. Vitale, Assemblyman Joh 1 S. Wisniewski
and Assemblyman Joseph Vas.
