HomeMy Public PortalAbout2009.211 (11-17-09)RESOLUTION NO. 2009.211 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, AUTHORIZING AND APPROVING THE PROGRAM INCOME REUSE PLAN FOR THE STATE OF CALIFORNIA NEIGHBORHOOD STABILIZATION PROGRAM, AND ANY AMENDMENTS THERETO WHEREAS, on July 30, 2008, under Title III of the National Housing and ..Economic Recovery Act (HERA) of 2008, the United States Department of Housing and Urban .Development (HUD) authorized the distribution of $3.9 billion in new, supplemental Community Development Block Grant (CDBG) funding to States and local jurisdictions through a Neighborhood Stabilization Program (NSP) for the redevelopment of abandoned and foreclosed upon homes and residential properties; and WHEREAS, the HUD has provided $530 million in NSP funding for use throughout California; $385 million of that funding was provided directly to selected city and county governments, and $145 million has been provided to the California Department of Housing and Community Development (HCD) for distribution among the remaining California local jurisdictions; and WHEREAS, HCD established $1,000,000 as the minimum NSP grant award for jurisdictions to apply for funding individually under Tier 1 and allowing contiguous jurisdictions within the same county to jointly apply for funding under Tier 2 in order to reach the minimum application amount of $1,000,000 when operating under a joint powers agreement; and WHEREAS, HCD issued a .Notice of Funding Availability (NOFA) for the NSP funds, allocating $916,161 to the City of Lynwood $1,329,065 to the City of Carson to assist low-, moderate- and middle-income households with incomes at or below 120% of area median income (LMMI); and WHEREAS, on June 2, 2009, the City Council of the City of Lynwood (City Council) approved an application for funding and authorized the City to enter into a joint agreement with the City of Carson to effectuate administration and implementation of the grants to City of Lynwood and City of Carson (collectively, Cities), and for the City of Carson, as the Lead Agency, to be responsible for administration and implementation of any grants from HCD; and WHEREAS, on September 17, 2009, the Cities were sent formal notification of approval of the application and the total allocation of $2,245,226 in NSP funds for both jurisdictions and of the Standard Agreement #09-NSP1-6107 with HCD; and WHEREAS, the Cities are required to prepare a Program Income Reuse Plan, Program Guidelines and Rehabilitation Standards to be eligible for CDBG funds from HCD and must approve the Program Income Reuse Plan by .resolution by the legislative body of the local jurisdiction; and WHEREAS, NSP Applicants required to comply with all. citizen, participation requirements of Sections 24 CFR 91.105 or 91.115 as modified by NSP by conducting public meetings on the Program Income Reuse Plan phases; and WHEREAS, on November 17, 2009, the City Council held a public meeting to receive comments on the Program .Income Reuse Plan. NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS: Section 1. The foregoing recitals are true and correct. Section 2. The City Council hereby approves the NSP Program Income Reuse Plan, NSP Program Guidelines, and NSP Rehabilitation Standards., which establish guidelines on the ,policies and procedures for the administration and utilization of program .income received as a result of activities funded under the Neighborhood Stabilization Program funds.
