RESOLUTION NO. 02 -4115
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY AUTHORIZING CITY ACCESS TO SUMMARY CRIMINAL
HISTORY INFORMATION FROM THE STATE OF CALIFORNIA
DEPARTMENT OF JUSTICE FOR EMPLOYMENT, LICENSING OR
CERTIFICATION PURPOSES
WHEREAS, Penal Code Sections 11105(b)(10) and 13300(b)(10) authorize cities,
counties and districts to access state and local summary criminal history information for
employment, licensing or certification purposes; and
WHEREAS, Penal Code Sections 11105(b)(10) and 13300(b)(10) require that there be a
requirement or exclusion from employment, licensing, or certification based on specific criminal
conduct on the part of the subject of the record; and
WHEREAS, Penal Code Sections 11105(b)(10) and 13300(b)(10) require the city council
of a city to specifically authorize access to summary criminal history information for employment,
licensing or certification purposes.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES
HEREBY RESOLVE:
Section 1. The City of Temple City is hereby authorized to access summary criminal
history information for employment screening including volunteers and contract employees,
licensing, or certification purposes.
Section 2. The City of Temple City shall not consider a person who has been
convicted of a felony or misdemeanor involving moral turpitude as eligible for employment
(including volunteers and contract employees), or licensing; except that such conviction may be
disregarded if it is determined that mitigating circumstances exist, or that the conviction is not
related to the employment, volunteerism or license in question.
SECTION 3. The City Clerk shall certify to the adoption of this resolution.
PASSED, APPROVED, AND ADOPTED on this 3rd day of September 2002.

I, City Clerk of the City of Temple City, do hereby certify that Resolution No. 02 -4115
adopted at a regular meeting of the City Council of the City of Temple City held on the 3rd day of
September, 2002. It was duly passed, approved and adopted by said Council, approved and
signed by the Mayor and attested by the City Clerk at a regular meeting held on the 3rd day of
September, 2002 by the following vote:
AYES: Councilman - Souder, Wilson, Zovak, Vizcarra, Gillanders
NOES: Councilman -None
