CITY OF TEMPLE CITY
CITY COUNCIL
MINUTES
November 18, 1975
INITIATION:
1. Mayor Gilbertson called the regular meeting of the City Council
to order at 7:32 p.m. on Tuesday, November 18, 1975 in the
Council Chamber of the City Hall.
2. The invocation was given by Councilman Merritt.
3. The Pledge of Allegiance to the Flag was led by Mayor Gilbertson

Councilman Dennis moved to excuse Councilman Tyrell for cause,
seconded by Councilman Greenberg and carried.
5. APPROVAL OF MINUTES:
Councilman Greenberg moved to approve the minutes of the regular
meeting of the City Council held Tuesday, November 4, 1975, as
written, seconded by Councilman Dennis and carried.
Councilman Merritt moved to approve the minutes of the adjourned
meeting of the City Council held Saturday, November 8, 1975, as
written, seconded by Councilman Dennis and carried.
UNFINISHED BUSINESS:
6. ORDINANCE NO. 75- 423 -A: 2nd read. REGULATING NEWS RACKS IN PUBLIC
RIGHTS -OF -WAYS
City Attorney Martin presented Ordinance No. 75 -423 -A AN ORDINANCE
OF THE CITY OF TEMPLE CITY REGULATING NEWS RACKS IN PUBLIC RIGHTS-
OF-WAYS for second reading by title only. Councilman Merritt moved
to waive further reading and adopt, seconded by Councilman Greenberg
and carried.
NEW BUSINESS:
7. RECOMMENDATIONS FROM TRAFFIC COMMISSION - Meeting of November 5, 1975
A. BROADWAY AND ENCINITA AVENUE - Restricted Parking
City Manager Koski presented background information, stating subject
intersection was investigated for a possible traffic hazard at the
request of Council, and Traffic Engineer recommended that 18 ft.
of red curb be placed on the east side of Encinita Avenue extending
north of Broadway in order to make a smoother transition from a
12' lane south of Broadway. Traffic Commission concurred with the
Traffic Engineer's findings, and recommended the placement of red
curb.
By means of a diagram, Traffic Engineer Envall explained the
configuration of the intersection as it now exists.
Councilman Merritt moved to approve Traffic Commission recommendation
that 18 ft. of red curb be placed on the east side of Encinita Avenue,

extending north of Broadway within the curbed portion, seconded
by Councilman Greenberg and carried,
B. AMENDMENT TO TEMPLE CITY MUNICIPAL CODE (RECODIFIED) ADDING
SECTION 3331 RELATING TO TRAFFIC REGULATIONS
City Manager Koski presented background information, stating City
Council adopted a resolution utilizing Section 21107.8 of the
California Vehicle Code to regulate illegal parking in the fire
lanes in front of the Ralph - Thrifty shopping center; Sheriff's
Department has subsequently questioned the validity of enforcing
parking under this section although signs have been posted. The
matter was referred to the City Attorney for review and he advised
Section 21107.6 of the Vehicle Code is more appropriate to utilize.
An ordinance was prepared, reviewed by the Sheriff's Department
and Traffic Commission recommends adoption of the ordinance to pro-
hibit illegal parking in shopping centers.
City Attorney Martin introduced Ordinance No. 75 -425 AN ORDINANCE
OF THE CITY OF TEMPLE CITY ADDING NEW SECTION 3331 TO THE TEMPLE
CITY MUNICIPAL CODE (AS RECODIFIED) RELATING TO TRAFFIC REGULATIONS
for first reading by title only, Councilman Dennis moved to waive
further reading, seconded by Councilman Greenberg and carried.
C. BICYCLE REGULATIONS - REPEAL OF EXISTING ORDINANCES
City Manager Koski presented background information, stating the
Traffic Commission has reviewed the use of and need for bicycle
racks placed by the City within the central business district and
City ordinances governing bicycles. A survey of surrounding cities
in the San Gabriel Valley was conducted to determine what they did
in regard to placement of bicycle racks and the Chamber of Commerce
was consulted to determine their attitude with the result that the
business community is opposed to enforcement of signs posted in the
downtown area prohibiting bicycles from being parked in other than
bicycle racks. Traffic Commission, in reviewing the present
ordinances, noted ambiguities in the City's ordinance and also felt
the Vehicle Code relating to bicycles adequately covers bicycle laws
Commission felt in the absence of manpower to enforce the City
ordinances existing ordinances on bicycles, with the exception of
licensing, be repealed.
Councilman Greenberg moved to approve Traffic Commission recommendation
to repeal Sections 3333 to 3333,4 of the Temple City Municipal Code,
remove all signs associated with the present ordinances, authorize
requests for bicycle racks to be referred to Traffic Commission to
issue encroachment permits in public right of way, with specifications
to be determined by the Cominission, expense of the bicycle rack to be
borne by the party making the request, and instruct the City Attorney
to prepare the appropriate ordinance to repeal Sections 3333 to 3333.4,
seconded by Councilman Merritt and carried.
8. RECOMMENDATIONS FROM PLANNING`COMMISSION - Meeting of November 11, 1975
A. PROPERTY NUISANCE CASE NO. 75 -31 - 5611 -5617 Sultana Avenue
City Manager Koski advised the Planning Commission, at their regular
meeting of November 11, 1975, held public hearing and adopted
Resolution No, 75 -660PC determining that a public nuisance exists
on subject property, appeal period has expired with no appeal having
been made.
Assistant Planner, Pat Richards, advised the property owner is in
the process of removing exterior debris, has moved the trash bin
but it is still visible, that upon inspection this date it was
noted that new tenants are in the process of moving in.

Councilman Merritt moved to adopt Resolution No. 75 -1498 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING CERTAIN
PREMISES TO BE A PUBLIC NUISANCE, AND ORDERING ABATEMENT THEREOF,
seconded by Councilman Greenberg and carried.
B. PROPERTY NUISANCE CASE NO. 75 -32 - 5434 Welland Avenue
City Manager Koski advised the Planning Commission, at their regular
meeting of November 11, 1975, held public hearing and adopted
Resolution No, 75 -661PC determining that a public nuisance exists
on subject property, appeal period has expired with no appeal having
been made.
Assistant Planner Richards advised the property was insr,icted this
date and no improvement has been made on the property; that he ob-
served one additional broken window,
Councilman Greenberg moved to adopt Resolution No. 75 -1499 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING CERTAIN
PREMISES TO BE A PUBLIC NUISANCE, AND ORDERING ABATEMENT THEREOF,
seconded by Councilman Merritt and carried.
9. GOLDEN WEST AVENUE, SOUTH OF HALLWOOD - APPROVAL OF PLANS
City Manager Koski presented background information, stating City
Council, at their regular meeting held March 18, 1975, authorized
survey and design of curb and gutter improvements on Golden West
Avenue, terminating in a cul de sac approximately 460 feet south of
Hallwood Drive, and authorized staff to obtain the dedication of
the two remaining properties in exchange for the improvements.
Staff contacted the Flood Control District to determine what partici-
pation they would agree to for the drainage connection from the cul
de sac to the flood control system at Lower Azusa Road and as of this
date, they have indicated they will not participate in the project
due to budgetary restrictions. Staff proposed to combine the con-
struction of sidewalks on the south side of Live Oak Avenue from
Golden West to Baldwin Avenues, approved in the current budget, in
order to have a bid package of sufficient size to receive more favor-
able bids, Both improvement projects are to be funded completely by
the City. Staff recommends the Los Angeles County Road Department
be authorized to prepare the specifications for the curb and gutter
improvement on Golden West Avenue and sidewalks on the south side of
Live Oak Avenue, with bid specifications to be returned no later than
December 16 for Council authorization to go to bid.
Councilman Merritt moved to approve plans for Golden West Avenue
approximately 460 feet south of Hallwood Avenue and authorize the
preparation of specifications for Golden West Avenue improvement
project and the sidewalk project on the south side of Live Oak
Avenue from Golden West to Baldwin Avenues, seconded by Councilman
Greenberg and carried.
10. RESOLUTION NO, 75 -1497: WARRANTS & DEMANDS, Demand Nos. 3158 thru
3238 in the amount of $65,438,20.
Councilman Merritt moved to adopt Resolution No. 75 -1497 A RESOLUTION
OF THE. CITY COUNCIL OF THE,CITY OF TEMPLE CITY ALLOWING CLAIMS AND
DEMANDS IN THE SUM OF $65,438.20,, DEMAND NOS. 3158 THRU 3238,
seconded by Councilman Dennis and carried, Councilman Greenberg
abstaining as to Item No. 32160

A. Kiwanis Club Request re: Line of Dimes - January 23, 1976
City Manager Koski advised the Traffic Commission, at the request
of the City Council, reviewed request by Kiwanis Club for per-
mission to conduct their Annual Line of Dimes campaign on
January 23, 1976. Traffic Commission recommends the Kiwanis Club
request be approved with the provision that the traffic signal at
the intersection of Las Tunas Drive and Temple City Boulevard
remain on the normal 3 -phase operation and the hours of the
campaign be conducted from 10:00 a.m. to 4 :00 p.m.
Councilman Dennis moved to approve the recommendation of the Traffic
Commission, approving all other items in the request from Kiwanis
Club dated October 31, 1975, seconded by Councilman Merritt and carried.
B. Ellis Lane, south of Lower Azusa Road - Review as a Potential
Truck Route
On motion by Councilman Dennis, seconded by Mayor Gilbertson,
Council received and filed report from the Traffic Commission
regarding a request from City Council to study Ellis Lane between
Temple City Boulevard and Lower Azusa Road as a possible truck route.
C. Longden Avenue and Encinita Avenue - Request for Additional
Regulations
On motion by Councilman Dennis, seconded by Councilman Merritt,
Council received and filed a report from the Traffic Commission
regarding a Council referral to investigate the subject inter-
section to determine if additional regulations are warranted.
D. Offers to donate trees for Live Oak Park
On motion by Councilman Merritt, seconded by Councilman Greenberg,
Council accepted with appreciation, offers from Mrs. Margarita
Melvin of 9422 E. Live Oak Avenue to donate two Floss Silk trees
and Mr. Robert Nelson of 10148 E. Olive Street to donate a Liquid
Ambar tree for Live Oak Park.
E. Council received and filed a status report regarding the
abatement of a public nuisance at 10603 Freer Street.
F. 1976 General Municipal Election - Proposal for Services
Councilman Merritt moved to accept the proposal from Martin and
Chapman Company in the amount of $2,373080 to include pick up
and delivery of sample ballots for the 1976 General Municipal
Election, seconded by Councilman Greenberg and carried.
G. 1976 General Municipa,1 Election - Policy re: Candidates Statement
On motion by Councilman Dennis, seconded by Councilman Merritt,
and carried, Council adopted a policy authorizing City Clerk to prepare

a written statement with regard to the availability of providing
services to have Candidates Statements printed and distributed
with sample ballots, and the method by which a levy will be imposed
for those wishing to avail themselves of such service, to be pro-
vided to each candidate or his representative at the time he picks
up his nomination papers.
Ho Councilman Greenberg inquired as to whether an educational'
program had been initiated with regard to the operation of signals
at various intersections along Las Tunas Drive, the subject having
come up at the recent Town Hall Meeting. Councilman Greenberg was
advised that officers on special foot patrol beginning December 8
for the holiday season, will incorporate an educational program
whenever possible,
I. Councilman Merritt introduced a resolution opposing handgun
control measures which he proposed be forwarded to California Contract
Cities Association for support. Councilman Merritt moved to adopt
Resolution No, 75 -1500 A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TEMPLE CITY OPPOSING HANDGUN CONTROL MEASURES, seconded by
Councilman Dennis and carried,
J. Mayor Gilbertson distributed amended by -laws for the San Gabriel
Valley Association of Cities and a resolution adopted at their meeting
November 13, 1975 requesting approval by all cities in the San Gabriel
Valley to become Charter Members of the Association, approval for the
payment of dues in the amount of $350 to cover organizational costs
and conduct of its operational activity to June 30, 1976, elect a
Delegate and Alternate to hold voting rights on their behalf, and to
participate in the organizational meeting to be held December 18, 1975
which will include the election of Charter Officers and Directors.
Councilman Merritt moved to approve Items.1 through 4 contained in
subject resolution, seconded by Councilman Greenberg and carried.
Councilman Dennis moved to appoint Mayor Gilbertson, Delegate, and
Mayor Pro Tem Greenberg, Alterna.te,'to the San Gabriel Valley
Association of Cities, seconded by Councilman Merritt and carried.
K. Mayor Gilbertson congratulated Mrs. Marcia Dennis on her Keyman's
Award by the Pasadena YMCA recognizing her contributions to the
Temple City extension YMCA,
L. Mayor Gilbertson directed Council's attention to the League of
California Cities summary of Preprint AB 1, stating he felt the
Council should communicate strong exception to our legislators.
15 ADJOURNMENT:
On motion by Councilman Greenberg, seconded by Councilman Dennis,
meeting adjourned at 8 :58 p,m. Next regular meeting of the City
Council will be held Tuesday, December 2, 1975, 7 :30 p.m. in the
Council Chamber of the City Hall.
