ATTEST: Village Clerk October 26, 1974 i11 � i -s — Mayor' November 30, 1974 The Council of Sal harbour Village met Saturday, November 30, 1974 at 9:30 A.M. in the Village Hall. rresent: Messrs. Beatty, Brush, Printup, Taplin and VLlleneuve Also present were Fred il. Maley, Village Manager; Mary T. Wetterer, Village Clerk; and Robert A. Jarvis representing the Village Attorney. On motion of Mr. Beatty,seconded by Mr. Taplin and voted, the minutes of the previous meeting of October 26,1974 were approved as submitted. The Village Manager reported that Notices had been sent to all property owners within 375 feet of the Bal Harbour Shops property, for which a 50 foot variance into the Park Drive set -back area had been requested. Mr. Stanley Whitman, owner, explained to those present at the Public Hearing that he is requesting a variance for a three -level parking structure which would not exceed 44 feet in height. The garage and stores would also have roof -level parking. The parking structure, including the surrounding ground level parking, would provide for the parking of 1730 cars. Mr. Eldridge Lovelace, Sr. Partner Harland- Bartholomew 6 Associates, presented diagrams of a parking structure previously authorized by a variance granted in 1962, but not yet built, and also views of the proposed structure. After discussion from the property owners present, the Mayor informed them that some letters had also been received re- garding the matter which will be given consideration. It was moved by Mr. Beatty, seconded by Mr. Taplin and unanimously voted that the Council take the matter under advisement for one month. Mr. Jarvis told the Council that he has serious doubts about the validity of the 1962 variance, inasmuch as it might be considered abandoned and also due to the fact that a new Zoning Ordinance has been passed. He said that he would research the matter and advise before the meeting to be held on December 28th. The Village Clerk reported that a Notice had been published regarding consideration of ORDINANCE NO. 171 amending Ordinance No. 1699 as it relates to parking in the Business district. The Ordinance was read in full on second reading and on motion of Mr. Brush, seconded by Mr. Taplin, the Ordinance was adopted. Mr. Maley reported that afer consultation with Mr. Villeneuve and the pension board members, orders had been placed to sell all Sentinel Mutual Funds held and to purchase $40,000.00 of Consumer Power lot Mortgage Bonds, and $30,000.00 of Florida Power and Light Company Notes. On motion of Mr. Brush, seconded by Mr. Taplin and voted the action was ratified. Mr. Jarvis reported that Judge Mehrtens had rendered a summary judgement in favor of Sal Harbour Village against Standard Dredging Company and their bonding company. A separate hearing will be held in Federal Court In Miami to determine damages due. Mr. Maley read a letter from Beach Cleaning Service, Inc. containing a proposal for cleaning the beach, explaining that this is the only firm in the County that performs this service. It was moved by Mr. Taplin, seconded by Mr. Bwattv and voted that Beach Cleaning Service be retained to clean the oceanfront beach as outlined. Mr. Douglas Ruth discussed with the Council some proposals he had for treatment and landscaping the beach, when completed. Mr. Maley advised him that under State law this type of work must be done under competitive proposals. Mr. Jarvis said that Mr. Anderson had informed him that he had checked with the Clerk of the Supreme Court in Tallahassee and that our case against Mrs. Giblin was ready for presentation to the Court and would be considered after the first of the year. Mr. John Looby appeared and requested an exemption from the Noise Ordinance for the concrete and forming company working on the Kenilworth Apartment job. The Council said that in consideration of the winter season tenants this would be impossible. Mr. Maley explained that our contractors and Dade County are still utilizing the parking spaces at Harbour House North and Harbour House am- plyees are without parking facilities. It was moved by Mr. Beatty seconded by Mr. Brush to allow the Harbour House forty parking permits for the Baker's Haulover Bridge lot until May 1, 1975. The motion was passed with Mr. Taplin abstaining due to a conflict of interest. Ordinance No. 172 adopting a Code of Ordinance* for Bal Harbour Village was read in full by the Village Clerk. On motion of Mr. Taplin, seconded by Mr. Beatty and voted the Ordinance was passed on first reading. The Americana Hotel was granted permission to use the garage area for exhibition purposes for several conventions through May, 1975 on motion of Mr. Brush, seconded by Mr. Villeneuve and voted. Mr. Printup said that inasmuch as the Village Manager does not share in the Employees Christmas Fund that he thought Mr. Maley should be given a bonus as in past years. It was moved by Mr. Beatty, seconded by Mr. Brush and unanimously voted to award Mr. Maley a $600.00 Christmas bonus. November 309 1974 Mr,Printup read a letter from Mr. Alan Johnson, Chairman of the Board of Saks Fifth Avenue regarding the proposed parking garage at Bal Harbour Strops. Mr. Jarvis said he would prepare an answer for the Mayor's signature. There being no further business on motion of Mr. Taplin,seconded by Mr. Villeneuve, the meeting was adjourned at 12:05 P.M. The May,,r t.ulcl th:,v? present that Mr. Stanley Whitman had asked for a postponement of his request for a variance for a parking garage in order to cam ?13, with the request of the Village for proper plans and specifications. The residents present expressed their opinions that the proposed parking garage would be a detriment to the community. The Mayor told the effected property owners present that they would ])a notified of the time of the next variance hearing for Mr. Whitman. ORLZNANC; No. 172 adopting e. Code of Ordinances for the Village was read by title for final reading, having beer+ advertised on November 15, 1974, a copy of the notice is attached, and read in full on November 30, 1976. . On motion of Mr. Villeneuve, seconded by Mr. Beatty and unanimously voted the Ordinance was adopted. Fir, James Reeves, Village Tngineer, outlined the rough cost estimates of improvements to the. residential district as requested. He submitted figures of $2300600, for new storm sewers; $56,125, for repni.rinc su.i addint; to the present storm sewers; "x93,508, for repavini; o.f the streets; and $125,000. for u pgradink, the Lighting system using the lresent Standards and brackets. 1t. was
