HomeMy Public PortalAboutResolution 02-4130 CUP Woman's Club1 RESOLUTION NO. 02 -4130 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING A REQUEST BY THE WOMAN'S CLUB FOR A CONDITIONAL USE PERMIT TO RENT OR LEASE THEIR FACILITY OR TO HAVE AN AGENT RENT OR LEASE THEIR FACILITY FOR THE PURPOSES OF ACCOMMODATING SPECIAL EVENTS SUCH AS WEDDING RECEPTIONS. THE PROPERTY IS ADDRESSED AS 5954 KAUFFMAN AVENUE. (CUP 02 -1504) The City Council of the City of Temple City does hereby resolve: SECTION 1. Based upon a public hearing for Conditional Use Permit number 02 -1504 and based upon information provided in Staff Reports and based upon testimony received at a public hearing before the Planning Commission, and based upon testimony and information received at a noticed public hearing before the City Council, the City Council grants a Conditional Use Permit for the Woman's Club of Temple City to utilize their space for special events at 5954 Kauffman Avenue in the R -3 zone, based upon the findings contained in Planning Commission Resolution No. 02- 2029PC. Said Conditional Use permit shall not become effective until and unless the Zoning Code is amended as described in Ordinance No. 02- 878. SECTION 2. This project should not result in significant effects upon the environment, and a Negative Declaration has been prepared in accordance with the State CEQA Guidelines. The initial statement as prepared indicates there is no potential for adverse impact to the environment as it relates to all wild animals, birds, plants, fish, amphibians and related ecological communities, including the habitat upon which the wildlife depends for its continued viability. Said Negative Declaration has been accepted by the Planning Commission. SECTION 3. Accordingly, this Conditional Use Permit is approved subject to the following conditions: 1. All social gatherings and /or events, shall cease all music and the serving of food and beverages no later than 10 p.m.; the premises shall be totally vacated no later than 11 p.m. on the evening of the event. All activities at the Woman's Club shall be subject to the criteria in the City's Noise Ordinance. 2. Security guards shall be present at all social gatherings and /or events that serve alcoholic beverages. Said security guards shall remain on the premises until the event is completely ended and the premises are vacated, which shall occur no later than 11:00 p.m 3. In terms of accommodating special events, including wedding receptions, alcoholic beverages may be served for such events until June 30, 2003; such events shall be monitored with adequate security guards so as to maintain the peace and so as to not constitute a nuisance to the neighborhood. During special events, such as wedding receptions, all music and the serving of food and beverages shall cease at 10:00 p.m. and the premises shall be totally vacated no later than 11:00 p.m. Additionally, there shall be no more that two (2) such "special events" such a wedding receptions, per month. 4. A formal parking agreement shall be devised between the Temple City Woman's Club and the City of Temple City for the Woman's Club to utilize nearby existing parking lot(s) to reduce the need for parking on the public streets in and around the Woman's Club. Prior to June 30, 2003, the City Council shall review this Conditional Use Permit to evaluate compliance with all conditions contained in this Resolution and to evaluate the overall operation in terms of impact upon the surrounding neighborhood and to consider the issue of on -site . serving and consumption of alcoholic beverages. 6. After June 30, 2003, the on -site serving and /or consumption of alcoholic beverages shall be prohibited, unless specifically authorized by the City Council at the above - referenced time of review. 7. The City of Temple City shall have the right to review the terms of any written or verbal agreement between the Woman's Club and a third party relative to the rental, operation, and /or catering of events at the Woman's Club. If the City of Temple City objects to any agreement with a third party, for whatever reason, the City may reject the prospective third party operator after conducting a noticed public hearing. 8. The above conditions may be enforced by Los Angeles County Sheriffs Department and /or Los Angeles Fire Department as well as City Staff. 9. If there are a sufficient number of legitimate complaints reported relative to special events at the Woman's Club, this Conditional Use Permit may be reviewed by the Planning Commission and /or the City Council and additional conditions may be imposed to address neighborhood complaints. 10. The applicant/property owner shall sign a copy of this Resolution, acknowledging acceptance of the conditions of approval as contained herein. 11. This Conditional Use Permit shall not be in effect unless and until the Zoning Code is amended and is in full force and effect.
