CITY COUNCIL
MINUTES
December 2, 1975
INITIATION:
1. Mayor Pro Tem Greenberg called the regular meeting of the City Council
to order at 7:40 p.m. on Tuesday, December 2,1975 in the Council
III Chamber of the City Hall.
2. The invocation was given by Dr. James Webster, First Baptist
Church of Temple City, 6019 N. Baldwin Avenue.
3. The Pledge of Allegiance to the Flag was led by Mayor Pro Tem
Greenberg.

4: ROLL CALL:
Present: Councilmen- Greenberg, Merritt, Tyrell
Absent: Councilmen- Dennis, Gilbertson
Also Present: City Manager Koski, City Attorney Martin, Assistant
City Manager Biel, Director of Planning.Dragicevich,
Parks and Recreation Director Kobett
Councilman Merritt moved to excuse Councilmen Dennis and Gilbertson
for cause, seconded by Councilman Tyrell and carried.
5. APPROVAL OF MINUTES:
Approval of the minutes of the regular meeting of the City Council
held November 18, 1975, was continued to December 16, 1975.
UNFINISHED BUSINESS:
6. ORDINANCE NO. 75 -425: 2nd read. AMENDMENT TO TEMPLE CITY MUNICIPAL CODE
( RECODIFIED) ADDING SECTION 3331 RELATING TO TRAFFIC REGULATIONS
City Attorney Martin presented Ordinance No. 75 -425 AN ORDINANCE OF
THE CITY OF TEMPLE CITY ADDING NEW SECTION 3331 TO THE TEMPLE CITY
MUNICIPAL CODE (RECODIFIED) RELATING TO TRAFFIC REGULATIONS for
second reading by title -only. Councilman Tyrell moved to . waive
further reading and adopt, seconded by Councilman Merritt and carried.
7. ORDINANCE NO. 75 -426: 1st read. REPEALING SECTIONS 3333 TO 3333.4
City Attorney Martin presented Ordinance No. 75 -426 AN ORDINANCE OF
THE CITY OF TEMPLE CITY REPEALING SECTIONS 3333, 3333.1, 3333.2,
3333.3, AND 3333.4 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO THE
PARKING OF BICYCLES for first reading by title only. Councilman
Merritt moved to waive further reading, seconded by Councilman Tyrell
and carried.
8. PUBLIC HEARING: ADJUSTMENT OF ZONE BOUNDARIES - TEMPLE CITY
MUNICIPAL LIGHTING DISTRICT
City Manager Koski presented background information, stating City
Council, at their regular meeting held November 4, 1975, adopted
Resolution No. 75 -1494 declaring its intention to order certain
changes in zones in the Temple City Municipal Lighting District and
setting public hearing December 2, 1975 pursuant to Street Lighting
Act of 1919; legal notices were published and posted as required.
Three street lights were installed on the north side of Green Street,
easterly of Baldwin Avenue pursuant to conditions related to RPD
Case 74 -424; monies were deposited with the City by the developer
for interim energy and maintenance of the street lights pending
annexation of the entire tract to Zone A of the Temple City Municipal
Lighting District.

Mayor Pro Tem Greenberg declared the public hearing open. There
being no further staff report, Mayor Pro Tem Greenberg invited anyone
wishing to speak in favor of, or in opposition to the proposed adjust-
ment of zone boundaries to come forward. There being no one wishing
to speak, Councilman Merritt moved to close public hearing, seconded
by Councilman Tyrell and carried.
Mayor Pro Tem Greenberg stated the Environmental Impact Report was
covered under the Residential Planned Development and Subdivision
Tract 29602.
Councilman Merritt moved to adopt Resolution No. 75 -1501 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ORDERING AN ADJUST -
MENT OF THE ZONE BOUNDARIES OF THE STREET LIGHTING DISTRICT WITHIN
THE CITY, seconded by Councilman Tyrell and carried.
9. PROPERTY NUISANCE CASE 75 -30: 6445 Temple City Boulevard
City Manager Koski advised that City Council, at their regular meeting
held November 4, 1975, reviewed Planning. Commission Resolution
No. 75 -652PC determining that a public nuisance exists on subject
property, and in view of the fact the property owner has taken out
building permits and a plot plan was approved by the Planning Department
to rehabilitate the structure, continued the matter to their meeting of
December 2, 1975. Staff has conducted follow -up inspections on the
subject property and has evidenced extensive improvement, the exterior
finish the only item remaining to be completed, and would recounnend the
matter be continueito give the property owner sufficient time to com-
plete the rehabilitation.
Councilman Tyrell moved to continue the matter to January 6, 1976,
seconded by Councilman Merritt and carried.
IIINEW BUSINESS:
10. RESOLUTION. NO. 75 -1504: WARRANTS & DEMANDS, Demand Nos. 3239 thru
3316 in the amount of $64,689.48
II/ 12. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
Councilman Merritt moved to adopt Resolution No. 75 -1504 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND
DEMANDS IN THE SUM OF $64,689.48, DEMAND NOS. 3239 THRU 3316, seconded
by Councilman Tyrell and carried.
11. COMMUNICATIONS:
A. Junior Woman's Club - Request to Recycle Christmas Trees
City Manager Koski presented a communication from the Junior Woman's
Club of Temple City requesting the City join with their Club and
the County Flood Control whereby residents would bring Christmas
trees to Live Oak Park during specific hours the first week of.
January, 1976, to have the trees put through the City chipper, the
County Flood Control to haul the mulch to project areas to be used
on equestrian trails.
Councilman Merritt moved to approve the request of the Junior Woman's
Club of Temple City, schedule to be coordinated through Parks and
Recreation Director Victor Kobett, seconded by Councilman Tyrell
and carried.
Mary Lou Swain, Treasurer, Quota Club of Temple City, presented the
club's check in the amount of $490 for the installation of two drinking
fountains in connection with the redevelopment of Live Oak Park. Mayor
Pro Tem Greenberg accepted the check, with appreciation, on behalf of
the City Council.

Mrs. McCormick, 9114 E. Broadway, requested relief from City Council,
stating she has converted a garage and has been informed by staff
that the existing driveway approach must be removed and the driveway
provides a convenient off - street parking area for hero
Mrs. McCormick was advised that staff would make a full investigation
and report back to City Council December 16, 1975.
IIIRECESS TO CRA:
The City Council recessed at 8:05 p.m. to meet as the Community Redevelop-
ment Agency, Mr. Dennis and Mr. Gilbertson being absent, approved agreement
modifying contract with Donahue -La Moureaux, Inc., accepted work completed
under Demolition Contract No. 3 and authorized payment, adopted resolution
approving warrants and demands, accepted work relating to the preparation
and processing of Parcel Map No. 6145 and approved payment, approved pro-
posal from Seaboard Engineering Company for work relating to the completion
of the development of Parcel "B" of the Redevelopment Project and instructed
General Counsel to prepare agreement, and received report on Option, Main-
tenance and Management Agreement, setting public hearing December 22, 1975,
7:30 p.m. The minutes are set forth in full in the minutes of the Agency.

RECONVENE AS CITY COUNCIL:
13. ACTION ON REQUEST BY CRA:
There was no action to be taken.
14. MATTERS FROM CITY OFFICIALS:
A. Councilman Tyrell moved to adopt Resolution No. 75 -1502 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY LIMITING CANDIDATE'S
STATEMENT TO 200 WORDS, seconded by Councilman Merritt and carried.
Councilman Tyrell moved to adopt Resolution No. 75 -1503 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY LIMITING CAMPAIGN
MATERIAL TO BE INCLUDED WITH SAMPLE BALLOT, seconded by Councilman
Merritt and carried.
B. EVALUATION OF STUDENT AND THE LAW
City Manager Koski presented new evaluation forms to be completed by
students regarding the Student and the Law Program which were compiled
by Deputy Green, coordinator, and the participating schools. Council-
man Tyrell moved to concur with the form, seconded by Councilman
Merritt and carried,
C. PRELIMINARY ALLEY LIGHTING REPORT
City Manager Koski stated in response to Council inquiry, staff has
prepared a preliminary report relative to street lighting within City
alleys. Councilman Tyrell moved to receive and file subject report
dated November 25, 1975, seconded by Councilman Merritt and carried.
D. MATCHING FUNDS: SECTION 230 HIGHWAY SAFETY ACT OF 1973
City Manager. Koski gave background information, stating City Council,
at a study session held May 7, 1974, approved submission of projects
to the Federal Highway Administration for funding under Section 230
of the Highway Safety Act of 1973. Representatives from CALTRANS
and the Federal Highway Administration met with staff for a field review
for preliminary consideration of two projects: Oak Avenue from
Garibaldi to Las Tunas Drive, and Garibaldi Avenue from Oak Avenue
to Golden West. The only requirement at this time is a commitment
from the City funding 10 % of the cost, 90% to be funded by the
federal government.

Councilman Tyrell moved to authorize staff to submit a letter of
commitment to CALTRANS for 10% match funding under Section 230 of
the Highway Safety Act of 1973, seconded by Councilman Merritt and
carried.
E. PEDESTRIAN SIGNAL TIMING - Las Tunas, Sultana to Golden West
City Manager Koski presented staff report pursuant to Council inquiry
relative to the pedestrian crossing times along Las Tunas Drive
between Sultana and Golden West Avenues.
Councilman Merritt moved to receive and file, seconded by Councilman
Tyrell and carried.
F. Councilman Tyrell moved to adopt Resolution No, 75 -1505 A
RESOLUTION OF COMMENDATION TO JOHN H. GARVER, seconded by
Councilman Merritt and carried
G. STAFF TRAINING
City Manager Koski presented a request for Assistant City Manager
attendance to the League of California Cities 10th Annual Labor
Relations Institute to be held in Los Angeles, January 21 -23, 1976.
Councilman Tyrell moved to authorize the attendance of Assistant
City Manager Biel to the 10th Annual Labor Relations Institute, and
approve registration in the amount of $50, seconded by Councilman
Merritt and carried.
H. JOE VENANZI ENTERPRISES
Following brief discussion regarding the problems subject business
has encountered with having opened a business in Temple City with
a San Gabriel address, Councilman Tyrell moved to instruct the
City Attorney prepare an appropriate resolution requesting federal
legislators consider a change of boundary within the U. S. Postal
Service, seconded by Councilman Merritt and carried.
I. On motion by Councilman Tyrell, seconded by Councilman Merritt
and carried, Council placed Agreement for Operation and Maintenance
of Parking Facilities between the City and the operators of the
Community Shopping Center on the December 16, 1975 agenda.
J. Mayor Pro Tem Greenberg expressed his concern regarding the
number of yard sales with attendant signs being conducted over the
weekends in the City and felt Council should initiate some action to
control garage sales and activities. Council concurred in instructing
the City Attorney to prepare an appropriate ordinance relating to yard
sales and signs to be brought to City Council on December 16, 1975.
In response to Mayor Pro Tem Greenberg's inquiry regarding the
development project at Live Oak Park, City Manager Koski advised bids
for the demolition of Glickman Avenue will be presented to City Council
on December 16, 1975; that the development of the park will go out to
bid as soon as the State has approved the plans and specifications
which is projected to be received before the end of December.
15. ADJOURNMENT:
On motion by Councilman Tyrell, seconded by Councilman Merritt,
meeting adjourned at 8 :40 p.m. Next regular meeting of the City
Council will be held Tuesday, December 16, 1975, 7:30 p.m. in the
Council Chamber of the City Hall.
