HomeMy Public PortalAbout17-1989-17 RESOLUTION NO. 1989 - 17 A RESOLUTION ESTABLISHING A FISCAL PLAN FOR ANNEXATION OF TERRITORY AREA III-A (FILLMORE ROAD) WHEREAS, the Common Council of the City of Greencastle, Indiana, is considering the annexation of certain territory to the City of Greencastle, Indiana, and; WHEREAS, the area to be annexed is AREA III-A (Fillmore Road) , an approximately 8.7 acre tract which is located along Fillmore Road and Indiana 240 (17 residences) and which is legally described as follows: A. SINCLAIR-FERRAND SUBDIVISION as recorded in Plat Book 5 at page 122 in the Office of Putnam County Recorder. B. SAN MAR SUBDIVISION as recorded in Plat Book 5 at page 92 in the Office of Putnam County Recorder. C. A tract of real estate commencing at the Northwest corner of the San Mar Subdivision; thence North 157 feet to the Southwest corner of the Sinclair-Ferrand Subdivision; thence East 180 feet along the southern boundary of the Sinclair-Ferrand Subdivision to the Southeast corner of the Sinclair-Ferrand Subdivision; thence South to the northern boundary of the SanMar Subdivision; thence west along the northern boundary of the San Mar Subdivision to the point of beginning. D. A part of the South East quarter of Section Thirteen (13) , and a part of the North East quarter of Section Twenty-four (240) , all in Township Fourteen (14) North of Range Four (4) West, of the Second Principal Meridian, more particularly described to wit: Beginning at the North East corner of the San Mar Subdivision of a part of Section 13 and part of Section 24, all in Township 14 North, Range 4 West, as said subdivision is recorded in the Office of the Recorder of Putnam County, Indiana; thence from said beginning point South 415.7 feet to the south East corner of said subdivision, said South East corner being in the centerline of Indiana State Road 240; thence South 77 degrees East 105 feet with the centerline of said road; thence North 0 degrees 40 minutes West 371.4 feet to a point; thence North 55 degrees West 119.3 feet to the point of beginning, containing 0.9 acres, more or less. E. A part of the Northeast quarter of Section 24, Township 14 North, Range 4 West of the Second Principal Meridian more particularly described, to-wit: Beginning at a point in the centerline of Indiana State Road #240, which point is South 77 degrees East 105 feet from the Southeast corner of the San Mar Subdivision as said Subdivision is recorded in the Office of the Recorder of Putnam County, Indiana; thence South 77 degrees East 100 feet with the centerline of said State Road #240; 111 thence North 0 degrees 40 minutes West 393.9 feet to an iron pin; thence West 97.2 feet to an iron pin; thence South 0 degrees 40 minutes East 371.4 feet to the point of beginning, containing 0.862 acres, more or less. 1. F. A part of the Northeast quarter of Section 24, Township 14 North, Range 4 West of the Second Principal Meridian more particularly described to wit: Beginning at the Northeast corner of Section 24, Township 14 North, Range 4 West; thence South 735.8 feet with the east line of said Section 24, Township 14 North, Range 4 West, to a point; thence North 77 degrees West 1187.3 feet to the true point of beginning; thence North 0 degrees 40 minutes west 422.02 feet to a point; thence West 121.47 feet to a point; thence South 0 degrees 40 minutes east 393.9 feet to a point; thence South 77 degrees east 125 feet with the centerline of Indiana State Road 240 to the true point of beginning. WHEREAS, approximately 50% of this area's perimeter is contiguous to the existing Greencastle boundary, and; WHEREAS, in order to comply with I.C. 36-4-3-13(c) (3) (d) , the Common Council of the City of Greencastle, Indiana, is required to adopt a written fiscal plan prior to the passage of such annexation ordinance. NOW THEREFORE, be it resolved by the Common Council of the City of Greencastle, Indiana, that the written fiscal plan for the are proposed to be annexed is as follows: 1. Cost Estimates of Capital Services. 410 a. Water -- $500.00 b. Sanitary Sewer Construction -- $87,500.00 c. Street and Road Construction -- $ 0.00 d. Fire Hydrants -- 2 @ $1,500: $3,000.00 e. Signage: $130.00 2. Annual Cost Estimate of Planned Services. a. Police -- $5,000.00 * b. Fire -- $ 0.00 c. Fire Hydrants -- 2 @ 166.76: $333.52 d. Street Lights -- 2 @ 90.96: $181.92 e. Parks and Recreation -- $1,000.00 * f. Street and Road Maintenance: $392.00 g. Planning and Building Department: $500.00 * h. Administrative Services: 500.00 * * includes all proposed annexation areas. 3. Method of Financing Services. Sewer facilities will be financed with sewer funds available for expansion of services. The provision of police, fire protection, and maintenance of streets and 2. roads will be absorbed by the present budgets for those 410 departments. 4. Plan for Organization and Extension of Services. Sewer facilities will be extended within three (3) years after the effective date of annexation. Police, Fire, Street Maintenance and Trash Collection will be available immediately upon annexation. 5. Non-Capital Services. Planned services of a non-capital nature, including police protection, fire protection, street and road maintenance, and other non-capital services normally provided within the corporate boundaries, will be provided to the annexed territory within one (1) year after the effective date of annexation, and that they will be provided in a manner equivalent in standard and scope to those non-capital services provided to areas within the corporate boundaries that have similar topography, patterns of land use, and population density. 6. Capital Improvements. Services of a capital improvement nature, including street construction, street lighting, sewer facilities, water facilities, and stormwater drainage facilities, will be provided to annexed territory within three (3) years after the effective date of annexation, in the same manner as those services have been provided to area within the corporate boundaries that have similar topography, patterns of land use, and population density, and in a manner consistent with federal, state, and local laws, procedures, and planning criteria. 7. Plan for Hiring Governmental Employees. It is not anticipated that jobs of employees of other 014 governmental entities will be eliminated by the proposed annexation. Therefore, no plan for hiring such governmental employees is necessary. 3. 8. This Fiscal Plan is based upon the final Fiscal Impact Analysis For Proposed Annexation prepared by Triad Associates, Inc. The Common Council of the City of Greencastle hereby approves and adopts the foregoing as the written fiscal plan for the area sought to be annexed this 8th day of August, 1989.
