A RESOLUTION APPROVING ATTORNEY FEES
FOR LITIGATION
WHEREAS, Chapter 829 of the Greencastle City Code provides
that the City Attorney shall have the authority to bring a civil
action for an injunction to restrain any person from violating
the Planning and Zoning Ordinance;
WHEREAS, it may be necessary for the Building Commissioner
of the City of Greencastle to bring an action to enjoin the usage
of 407 Melrose Avenue as a professional office;
WHEREAS, the City Attorney, Larry J. Wilson, is unable to
represent the City of Greencastle in such action due to his need
to avoid any appearance of a conflict of interest;
NOW THEREFORE, BE IT RESOLVED by the Common Council of the
City of Greencastle, Indiana, that Larry J. Wilson, as City
Attorney, is authorized to employ Jerald D. Calbert, Attorney at
Law, as special counsel for the City of Greencastle in any cause
of action to enjoin the zoning violation at 407 Melrose Avenue
/'"N and that Jerald D. Calbert shall be compensated at an hourly rate
of $80 per hour for all work incurred in regard to said
litigation. Further that said payment should be based upon
itemized time billings submitted on a monthly basis and shall be
paid from the litigation account.
PASSED AND RESOLVED BY THE COMMON COUNCIL OF THE CITY OF
GREENCASTLE THIS 194\ DAY OF OCTOBER, 1989.
