HomeMy Public PortalAbout01-1990-1 RESOLUTION NO. 1990 - 1 A RESOLUTION ESTABLISHING A FISCAL PLAN FOR ANNEXATION OF TERRITORY SOUTHERN HIGHWAY WHEREAS, the Common Council of the City of Greencastle, Indiana, is considering the annexation of certain territory to the City of Greencastle, Indiana, and; WHEREAS, the area to be annexed is the following described real estate: A part of the Northwest Quarter, of the Northwest Quarter of Section Twenty-Eight (28) , and a part of the Northeast Quarter, of the Northeast Quarter of Section Twenty-Nine (29) all in Township Fourteen (14) North, Range Four (4) West of the second Principal Meridian in Putnam County, Indiana described as follows: Commencing at a stone marking the southwest corner of the Northwest Quarter, of said Section Twenty-Eight (28) ; thence North 00 degrees 00 minutes 13 seconds East 2,007.96 feet along the west line of said Section Twenty-Eight (28) to the south right-of-way line of the Southern Highway (INDOT Project No. M-Q108 (1) ) , said point being the POINT OF BEGINNING of this description; thence along said south right-of-way line the following five courses: 111 North 82 degrees 24 minutes 28 seconds West 234.09 feet; thence North 66 degrees 19 minutes 57 seconds West 314.72 feet; thence South 70 degrees 46 minutes 39 seconds West 66.98 feet; thence South 29 degrees 29 minutes 22 seconds West 265.00 feet; thence South 53 degrees 17 minutes 43 seconds West 92.91 feet to the east boundary of the Manhattan Highway (formerly the Greencastle- Manhattan Road) and being the east boundary of the corporate limits of the City of Greencastle; thence North 29 degrees 29 minutes 22 seconds East 625.60 feet along said east boundary to a point on the south boundary of the city corporate limits, said point being 220 feet South of and measured at right angles to the north line of Section Twenty- Nine (29) ; thence South 89 degrees 33 minutes 08 seconds East 480.54 feet along said south bound- ary, and parallel to said north Section line, to the west line of Section Twenty-Eight (28) ; thence continuing along the south boundary of the city corporate limits being 220 feet South of and parallel to the north line of Section Twenty-Eight (28) South 89 degrees 39 minutes 31 seconds East 1322.76 feet to the east line of the Northwest Quarter, of the Northwest Quarter of said Section Twenty-Eight (28) ; thence South 00 degrees 03 minutes 57 seconds East 210.16 feet along said east quarter, quarter line to the south right- of-way line of the aforementioned Southern Highway; thence along said south right-of-way line the following six courses: Southwesterly 46.37 feet along an arc to the right and having a radius 2879.57 feet and subtended by a long chord having a bearing of South 82 degrees 09 minutes 43 seconds West and a length of 46.37 1. feet; thence South 77 degrees 15 minutes 08 seconds West 100.93 feet; thence South 88 degrees 40 minutes 43 seconds West 100.50 feet; thence 550.00 feet thence South 80 degrees 06 minutes 20 seconds West 100.12 feet; thence South 82 degrees 35 minutes 56 seconds West 437.29 feet; to the point of beginning and containing 13.506 acres, more or less. All bearings in this description are based on the bearing system for State Highway Project M-Q108 (1) . WHEREAS, approximately 50% of this area's perimeter is contiguous to the existing Greencastle boundary, and; WHEREAS, in order to comply with I.C. 36-4-3-13(c) (3) (d) , the Common Council of the City of Greencastle, Indiana, is required to adopt a written fiscal plan prior to the passage of such annexation ordinance. NOW THEREFORE, be it resolved by the Common Council of the City of Greencastle, Indiana, that the written fiscal plan for the area proposed to be annexed is as follows: 1. Cost Estimates of Capital Services. a. Water -- $ 0.00 b. Sanitary Sewer Construction -- $ 0.00 • c. Street and Road Construction -- $ 0.00 d. Fire Hydrants -- $ 0.00 e. Signage: $ 0.00 2. Annual Cost Estimate of Planned Services. a. Police -- $0.00 b. Fire -- $ 0.00 c. Fire Hydrants -- $ 0.00 d. Street Lights -- $ 0.00 e. Parks and Recreation -- $0.00 f. Street and Road Maintenance: $ 0.00 g. Planning and Building Department: $0.00 h. Administrative Services: $0.00 3. Method of Financing Services. The provision of police and fire protection, and maintenance of streets and roads will be absorbed by the present budgets for those departments. 4. Plan for Organization and Extension of Services. Water and sewer facilities are available to the territory to be annexed. Police, Fire, Street 2. Maintenance and Trash Collection will be available immediately upon annexation. 5. Non-Capital Services. Planned services of a non-capital nature, including police protection, fire protection, street and road maintenance, and other non-capital services normally provided within the corporate boundaries, will be provided to the annexed territory within one (1) year after the effective date of annexation, and that they will be provided in a manner equivalent in standard and scope to those non-capital services provided to areas within the corporate boundaries that have similar topography, patterns of land use, and population density. 6. Capital Improvements. Services of a capital improvement nature, including street construction, street lighting, sewer facilities, water facilities, and stormwater drainage facilities, will be provided to annexed territory within three (3) years after the effective date of annexation, in the same manner as those services have been provided to area within the corporate boundaries that have similar topography, patterns of land use, and population density, and in a manner consistent with federal, state, and local laws, procedures, and planning criteria. 7. Plan for Hiring Governmental Employees. It is not anticipated that jobs of employees of other governmental entities will be eliminated by the proposed annexation. Therefore, no plan for hiring such governmental employees is necessary. 410 3. The Common Council of the City of Greencastle hereby n approves and adopts the foregoing as the written fiscal plan for the area sought to be annexed this 25th day of January, 1990.
