Please release Mr. Brown's check that had been initially submitted to the City as a deposit for this nroiect. Please also accept our apology for the inconvenience that this abandoned project has caused you and your Department; our intention was to build our house in a timely manner. Initially we had difficulty findina a builder in Tvbee-out of the five builders we contacted only Mr. Brown was available and willing to bid.We submitted the plans to him in July and did not receive any numbers from him until September-the written broken down bid did not arrive from him until October. We finally were able to obtain a bid from JT Turner in October as well. but the numbers were too high. We are now in the process of redesianina the house with a new architect. We will not make the same mistakes as before and will wait until we have hard numbers on costs before the plans are submitted to the City. Again, please accept our heartfelt apology. No person shall make, continue, or cause to be made or continued, except as permitted, any noise disturbance, or any noise in excess of the limits for such noise established in this Section. a. Maximum permissible sound levels. With the exception of sound levels elsewhere specifically authorized by this Ordinance, Table 1 sets forth the maximum permissible sound levels allowed at or within the real property boundary of a receiving land use. Any activity or use that produces a sound in excess of such noise levels for a receiving land use shall be deemed a"noise disturbance" and is in violation of this Ordinance. b. Measurement of sound. The measurement of sound or noise shall be made with a sound level meter meeting the standards prescribed by the American National Standards Institute or its successor body. The instrument shall be maintained in calibration and good working order. Octave band corrections may be employed in meeting the response specification. A calibration check shall be made of the system at the time of any noise measurement. Measurements recorded shall be taken so as to provide a proper representation of the noise source. The microphone used during measurement shall be positioned so as not to create any unnatural enhancement or diminution of the measured noise. A windscreen for the microphone shall be used when required. Traffic, other transportation noise sources and other background noises shall not be considered in taking measurements except where such background noise interferes with the primary noise being measured. It is the intention that this sound to be measured is what is being created by the sound complained of excluding intruding noises from isolated identifiable sources,but including ambient sound level. The measure of all sound levels shall be made as close to the property line of the receiving land use as is practical. I am writing in reference to the two live oak tees located directly behind your house and the red maple located in front of your house at 1111 Laurel Avenue. Based on a recent inspection,the trees appear to be fairly healthy. However,it is my understanding that your house is going to be raised to bring it up to current standards_ The oak tree on the right,as looking at it from the back porch,leans over the house and clears the building by only a few inches. Any elevation of this portion of the house will leave you with no choice but to remove the tree. The oak tree on the'atlas a large section of the tree growing over the house,with clearance of a few feet. At a minimum,this section will need to be removed to provide clearance to the building. Removing such-a large percentage of the tree's crown will most likely cause a lot of stress on the tree itself My recommendation would be to remove the tree entirely to avoid any future problems associated with excessive pruning, The maple in front is only two feet away from the house at the base.
