AN ORDINANCE REGULATING THE USE OF PUBLIC RIGHT-OF-WAY
THE CITY COUNCIL OF THE CITY OF MEDINA DOES ORDAIN AS FOLLOWS:
SECTION I:
Section 476. Definition. For purposes of this ordinance, the term
Right -Of -Way is defined as follows: Land designated by the City
Council for public vehicular and pedestrian traffic by easement,
dedication, statutory user, common law dedication, or any other
instrument or legal right, including in any event, that portion
of any road lying within 33 feet of either side of the center line
of the travelled track of such road.
Section 477. Conduct Prohibited. The following conduct is prohibited
within any right-of-way as defined herein:
1) The obstruction of any right-of-way:
2) Plowing, digging, and the removal or addition of any earth.,
gravel, rock, or other mineral matter within any
right-of-way;
3) The erection of any fence or other obstruction
within the right-of-way;
4) The obstruction of any ditch, water passage or
drainage way within the right-of-way;
S) The placement of any building or structure within
the right-of-way;
6) The damaging, tampering with, or other alteration
of any portion of the right-of-way, the road, the
bridges, culverts, guard rails, and other highway
appurtenances within the right-of-way;
7) The removal, displacement or destruction of any
signs, markers or monuments within the right-of-
way;
Section 478. Order for Removal of Obstruction. Upon its own motion,
or at the request of the Road Supervisor, the City Council may, where
the convenience, safety or necessity of the public requires, order the
owner, occupant or other authorized person in charge of property, who
has violated any provision of this ordinance, to remove, eliminate or
restore any obstruction or damage to any right-of-way, which may
result from such violation. The owner, occupant or other person in
charge of property shall be notified by the City Clerk of the date
of the hearing on said Order and shall be given opportunity to be
heard.
Section 479. Penalty. Any person violating any provision of this ordinance,
or refusing to comply with an Order of the City Council within the time
limits prescribed by the City Council, shall, upon conviction thereof, be
punished by a fine not to exceed Five Hundred and no/100 ($500.00) Dollars,
or by imprisonment not to exceed ninety (90) days, or both.
SECTION II:
This Ordinance becomes effective upon its adoption and publi tion. Adopted
