AN ORDINANCE REGULATING TRESPASS AND
LICENSING OF RECREATIONAL MOTOR VEHICLES
THE CITY COUNCIL OF THE CITY OF MEDINA ORDAINS AS FOLLOWS:
SECTION I:
Section 520 of the Code of Ordinances of the City of Medina is
amended by the addition of the following:
520:20. Definitions: The following words and phrases
shall have the meanings ascribed to them.
a) Recreational Motor Vehicle is any motorized, self-
propelled vehicle designed or used for recreational
purposes, including without limitation, All -Terrain
Vehicles, Trail Bikes, Motorcycles, and rotorized
Bicycles, but excluJing Snowmobiles.
b) Public Lands are lands which include, without limita-
tion, Parks and School Grounds, Frozen Lakes, Recre-
ational Areas, Streets, Sidewalks, Public Easements,
Golf Courses, Trailways, Cemeteries, and other similar
areas.
520:30 Identification Plate Required. No person shall
park, keep, store or operate a Recreation Motor Vehicle in the
City of Medina without displaying identification plates as
required herein unless such Recreational Motor Vehicle is pro-
perly licensed by the State of Minnesota for operation on the
public highways.
a) Application. Identification plates shall be obtained
from the City Clerk by filing an application and paying
a fee to be set by resolution of the City Council.
Identification plates shall be issued to the owner of
the Recreational Motor Vehicle and are not transferr-
able.
b) Displays. Two identification plates shall be displayed
on each Recreational Motor Vehicle in a manner which
makes the Recreational Motor Vehicle identifiable thereby,
from either side.
520:40 Trespass Prohibited. No person shall operate a
Recreational Motor Vehicle upon, or enter therewith upon any
public or private lands within the City of Medina without the
written consent of the owner thereof, previously given.
520:50 Certain Conduct Prohibited. No person shall
operate a Recreational Motor Vehicle:
a) While under the influence of alcohol or any controlled
substance as defined by Minnesota Statutes.
b) At a speed which is not reasonable under the circumstances
existing within the area of travel.
c) In a manner which endangers or is likely to endanger
a person or property, including the Recreational Motor
Vehicle and the operator and passengers thereof.
d) In any manner which creates dust, noise, fumes or other
dangers which disturb the peace of any person.
520:60 Application to Motor Vehicles. Section520•1 Tiereof
relating to trespass, and Section5ZU.5Ohereof relating to certain
prohibited conduct shall apply to Motorcycles, Motorized Bicycles,
and other Motor Vehicles licensed by the State of Minnesota for
travel on the public highways when any such vehicle is operated
on public or private lands which have not been specifically
designated for vehicular travel.
SECTION II:
Penalty. Any person violating any provision of this
Ordinance shall be guilty of a misdemeanor and shall be punished
by a fine not to exceed $500 or by imprisonment not to exceed
ninety (90) days, or both.
SECTION III:
This Ordinance becomes effective upon its adoption and
publication. Adopt by he City Council of the City of Medina
