HomeMy Public PortalAbout2018.05.30 Special MeetingMINUTES McCall City Council Special Meeting McCall City Hall -- Legion Hall May 30, 2018 Call to Order and Roll Call Approve the Agenda Business Agenda Executive Session Return to Open Session Adjournment CALL TO ORDER AND ROLL CALL Mayor Aymon called the special meeting of the McCall City Council to order at 10:04 a.m. Mayor Aymon, Council Member Giles, Council Member Holmes, Council Member Nielsen and Council Member Sowers all answered roll call. City staff members present were Anette Spickard, City Manager; BessieJo Wagner, City Clerk; Justin Williams, Police Chief; Dallas Palmer, Police Lieutenant APPROVE THE AGENDA 1 Council Member Holmes moved to approve the agenda as submitted. Council Member Nielsen seconded the motion. In a voice vote all members voted aye and the motion carried. ;BUSINESS AGENDA AB 18-143 Request for Approval of a remodel contract for the new police facility located at 550 Deinhard Ln In accordance with the State law, a bid package was created for the facility remodel of 550 Deinhard Ln. (County Juvenile Detention Facility). This agenda bill addresses the FY18 Police Facility Remodel project. The project consists of a facility redesign and remodel to convert the current detention facility into a functional police facility. Bidding was published in the paper of record according to State law. A bid tabulation summary was prepared following the bid opening, and a recommendation for contract award is for Falvey's LLC in the amount of $280,428.93. Chief Williams answered questions from the Council regarding the project. MCCALL CITY COUNCIL May 30, 2018 Special Meeting Page 1 of 3 Council Member Sowers moved to approve the police facility remodel contract with Falvey's LLC in the amount of $280,428.93 and authorize the Mayor to sign all necessary documents. Council Member Holmes seconded the motion. In a roll call vote Council Member Sowers, Council Member Holmes, Mayor Aymon, Council Member Giles and Council Member Nielsen all votes aye and the motion carried AB 18-122 McCall Fourth of July 2018 Beachfront Park Alcohol Restrictions On April 17, 2018, multiple agencies gathered together to discuss 2018 Fourth of July alcohol restrictions in State and City Parks. There was an all agency meeting on April 17, as a result of that meeting staff prepared a recommendation regarding alcohol restrictions within McCall City Beachfront Parks during July 2018 for the Council to consider at their May 10 meeting. After significant discussion of the Council during the May 10 meeting, the Council decided to table the discussion prior to a motion as only 4 out of the 5 Council Members were present and all felt that all members needed the opportunity to weigh in. Chief Williams presented the staff recommendation to Council that there be alcohol restriction placed on city beach front parks from 8:00 p.m. July 3 through 8:00 a.m. July 5, 2018. He gave the Council a recap of the history of the alcohol restriction and the agreement with the other agencies. He spoke to the Council from a health and safety perspective stating that by placing this restriction has changed the type of calls they receive during this time frame. There was no further Council discussion. Council Member Giles moved to uphold the Chiefs recommendation to impose alcohol restriction for Lake front Parks from 8:00 p.m. July 3 through 8:00 a.m. July 5, 2018. Council Member Sowers seconded the motion. In a roll call vote Council Member Giles, Council Member Sowers, Mayor Aymon, Council Member Holmes, all voted aye and Council Member Nielsen voted no and the motion carried. Justin Williams, Police Chief; Dallas Palmer, Police Lieutenant left the meeting. EXECUTIVE SESSION At 10:29 am Council Member Giles moved to go into Executive Session for litigation pursuant to Idaho Code §74-206 (1)(f) To communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated. The mere presence of legal counsel at an executive session does not satisfy this requirement. Council Member Sowers seconded the motion. In a roll call vote Council Member Giles, Council Member Sowers, Mayor Aymon, Council Member Holmes, and Council Member Nielsen all voted aye and the motion carried. Also present for the Executive Session were Bill Nichols, City Attorney (via phone); Michelle Groenevelt, Community and Economic Development Director; Morgan Bessaw, City Planner. Council discussed possible legal issues with a pending cell tower. In a roll call vote all members voted aye and the motion carried. Council directed staff to invite the cell tower applicants to present their project to the City Council.
